HomeMy WebLinkAbout3901 RESOLUTION NO. 3901 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ARCADIA, CALIFORNIA, DECLARING ITS INTENTION TO FORM A LIGHTING MAINTENANCE DISTRICT NO. 27, WHICH DISTRICT IS TO PAY 'I'HE COST AND EXPENSES FOR THE MAINTENANCE AND OPERATION OF A STREET LIGHTING SYSTEM ON PORTIONS OF CERTAIN DESIGNATED STREETS IN SAID CITY AND FIXING A TIME AND PLACE FOR HEARING OBJECTIONS TO THE FORMATION OF SAID DISTRICT OR TO THE EXTENT THEREOF. THE CITY COUNCIL OF THE CITY OF ARCADIA, CALIFORNIA, DOES HEREBY RESOLVE AS FOLLOWS: SECTION 1. That the public interest and convenience require and it is the intention of the City Council of the City of Arcadia to form a lighting maintenance district to be known as Lighting Mainten- ance District No. 27, for the purpose of assessing said district to pay a portion of the cost and expenses of maintaining and operating a street lighting system consisting of two hundred forty-eight (248) 2,500 lumen lamps, sixty-six (66) 4,000 lumen lamps, five (5) 6,000 lumen lamps, thirteen (13) 7,000 lumen lamps, and six (6) 20,000 lumen lamps in said district on portions of the following designated streets: Alster Avenue Alta Oaks Avenue Altern Street Andrews Road Arthur Avenue Azure Way Beverly Drive Birchcroft Street Burnell Oaks Lane Camino Real Canyon Road Cielo Place Danimere Avenue Doshier Avenue Duarte Road El Monte Avenue Ellen Way Encino Avenue Ewell Lane Fairview Avenue Flamingo Way Florence Avenue Foothill Boulevard Grandview Avenue Greenfield Avenue Greenfield Place Haven Avenue Highland Oaks Drive Hunga te Lane Ivyland Avenue La Ramada Avenue Las Flores Avenue Lee Avenue Leland Way Lenta Lane Le Roy Avenue Loganrita Avenue Longden Avenue Lorena Avenue Louise Avenue Magna Vista Avenue Magnolia Lane Monte Place Newman Avenue Oakglen Avenue Palm Drive -1- / / Pamela Road Paxson Lane Rosemarie Drive Rolyn Place St. Joseph Street Sandra Avenue Santa Anita Avenue Santa Anita Terrace Sharon Road Southview Road Standish Street Sycamore Avenue Terra Lane Wilson Avenue 'Winnie Way Wistaria Avenue 1st Avenue 2nd Avenue 3rd Avenue 6th Avenue 8th Avenue 9th Avenue 3901 / SECTION 2. The items of expense of maintenance and operation of the said lighting system to be furnished and to be ,assessed in part against the lands within the district (exclusive of improvements) are the rate charge by the utility company for electric power (which rate includes the cost of repairs, replacements, maintenance, labor and materials) and the cost of publication, posting of notices, and engi- neering costs in the formation of the District. The estimated amount of electric power necessary for said system for each year is two hun- dred forty-one thousand, one hundred seventy-two (241,172) kilowatt hours and the estimated cost of said electric power for the first year of maintenance and operation is the sum of thirteen thousand, two hundred ninety-seven and 20/100 dollars ($13,297.20) and the esti- mated cost of other items of maintenance and operation for the first year is one thousand, eight hundred twenty-nine and 70/100 dollars ($1,829.70). That the total estimated cost of the first year's main- tenance and operation is fifteen thousand, one hundred twenty-six and 90/100 dollars ($15,126.90). SECTION 3. That the said contemplated maintenance and operation of said lighting system in the opinion of the City Council of the City of Arcadia is of more than local or ordinary pUblic bene- fit and said City Council hereby makes the expense of said mainten- ance and operation, exclusive of the amount to be paid by said City as stated in Section 5 hereof, chargeable upon a district, which district said City Council hereby declares to be the district bene- fited by said maintenance and operation and to be assessed to pay the cost and expense thereof; which said district shall, in general, include all of those lots fronting on said portions of said streets. A plat or map of said district, indicating by a boundary line the extent of the lands included in the proposed district, and indicating by symbol showing the type of lighting, was approved and adopted by the City Council of said City of Arcadia, and is on file in the office -2- 3901 of the City ClerIc of the City of Arcadia. Reference is hereby made to said plat or rnap for further full and complete description of said Lighting Maintenance District No. 27, and said map so on file shall govern for all details as to the extent of such district. SECTION 4. That said maintenance and operation shall be furnished for said system for a period from the date of the forma- tion of said district to and including December 31, 1970. SECTION 5. The City Council of the City of Arcadia hereby orders that fifty percent (50%) of the total maintenance and opera- tion cost and expenses of said system be paid out of the treasury of said City froDI the General Fund of said City. SECTION 6. Notice is hereby given that on Tuesday, the 1st day of November, 1966, at the hour of 8:00 o'clock p.m. of said day, in the Council Chamber of said City Council of said City of Arcadia, in the City Hall of said City, 240 West Huntington Drive, any and all persons owning land or having any interest in lands within the dis- trict liable to be assessed for the expenses of said maintenance and operation or any portion thereof, may be heard and any of said per- sons may present any objections that they may have by protest. SECTION 7. All the proceedings for the aforesaid mainte- nance and operation of said system shall be had and taken under and in accordance with the provisions of an act of the Legislature of the State of California, known and designated as the Municipal Light- ing Maintenance District Act of 1927, being Division 14, Part 3, of the Streets and Highways Code of the State of California. SECTION 8. The Superintendent of Streets shall post or cause to be posted, copies of this resolution headed "Notice of Formation of Lighting Maintenance District" along all open streets within said district liable to be assessed, in the manner and form required by law. -3- 3901 SECTION 9. The City Clerk shall certify to the adoption of this resolution and shall cause the same to be published twice, to wit: on September 29, 1966, and on October 6, 1966, in the Ar- cadia Tribune, a newspaper of general circulation published and circulated in the City of Arcadia and hereby designated for that purpose.
