RESOLUTION NO. 3908
A RESOLUTION OF THE CITY COUNCIL OF
THE CITY OF ARCADIA, CALIFORNIA,
ORDERING THE FORMATION OF A LIGHTING
MAINTENANCE DISTRICT, DESIGNATED AS
"LIGHTING MAINTENANCE DISTRICT NO. 28",
TO PAY THE COSTS AND EXPENSES FOR THE
MAINTENANCE AND OPERATION OF A STREET
LIGHTING SYSTEM ON PORTIONS OF CERTAIN
DESIGNATED STREETS IN SAID CITY.
THE CITY COUNCIL OF THE CITY OF ARCADIA, CALIFORNIA, DOES
HEREBY ORDER, FIND AND RESOLVE AS FOLLOWS:
SECTION 1. That pursuant to the provisions of Resolution
of Intention No. 3903, passed, approved and adopted september 20,
1966, and after a public hearing on the matter in conformance with
the prOVisions of the Municipal Lighting Ma1.ntenance District Act of
1927, being Division 14, Part 3, of the Streets and Highways Code of
the state of California, it is hereby ordered that a lighting main-
tenance district be and the same is hereby formed and that the boun-
daries of such lighting maintenance district, which district is to
pay the cost and expenses for the maintenance and operation of a
street lighting system on portions of the following designated
streets in said City:
Peck Road
Baldwin Avenue
Duarte Road
Naomi Avenue
Foothill Boulevard
Golden West Avenue
Lovell Avenue
Santa Clara Street
First Avenue
Santa Anita Avenue
Second Avenue
Alley East of Baldwin Avenue
Huntington Drive
Morlan Place
Sunset Boulevard
Michillinda Avenue

over and above the forty percent (40%) of the total maintenance and
operation costs and expenses thereof to be paid out of the treasury
of the C1.ty of Arcadia from the general fund of said City, shall be
and the same are hereby finally established in conformance with and
shown on that certain map entitled "Diagram of Lightlng Maintenance
D1.strict No. 28", heretofore prepared by the City Engineer and ap-
proved and adopted by Resolution No. 3902 of the City Council of the
C1.ty of Arcadia on September 20, 1966, and on file in the office of
the City Clerk of said City. That the boundaries of said Lighting
Maintenance District No. 28 and the properties included therein are
defined, bounded and described as follows:

Beginning at the intersection of the southerly property line of Huntington Drive, 80
feet wide, and the southerly prolongation of the easterly line of Michi11inda Avenue, 50

in the office of the Recorder of Los Angeles County; thence northerly along said easterly
line to its intersection with the center line of Sunset Boulevard, as shown on the Map ,I

SECTION 2. That the items of expense of maintenance and
operation of the said lighting system in said District to be fur-
nished and to be assessed in part against the lands within the dis-
trict (exclusive of improvements) for the first year, commencing
December 31, 1966, are the rate charge by the utility company for
electric power (which rate includes the cost of repairs, replace-
ments, maintenance, labor and materials) and the cost of publica-
tion, posting of notices and engineering costs in the formation of
the District. That the estimated amount of electric power necessary
for said system for each year is six hundred four thousand, six hun-
dred seventy-n.ine and seventy-eight hundredths (604,679.78) kilowatt
hours and the estimated cost of said electric power for the first
year of maintenance and operation is the sum of Twenty-nine thousand
six and 16/100 dollars ($29,006.16) and the estimated cost of other
items of maintenance and operation for the first year is Three thou-
sand five hundred five and 62/100 dollars ($3,505.62). That the
total estimated cost of the first year's maintenance and operation
is Thirty-two thousand five hundred eleven and 78/100 dollars
($32,511.78).
SECTION 3. That the percentage of the total expenses of
the aforesaid maintenance and operation to be pald by the aforesaid
district, as set forth in aforesaid Resolution No. 3903 of the City
Council of the City of Arcadia, shall be paid by special assessment
taxes levied upon all lands, exclusive of improvements, within said
district as hereinabove formed and established.
SECTION 4. That forty percent (40%) of the total expenses
of maintenance and operation of said district shall be paid out of
the treasury of the City of Arcadia from the general fund of said
City and the remainder of the total expenses of maintenance of said
district shall be paid by said district.

SECTION 5. That a certified copy of this resolution
shall be filed with the Assessor who makes the assessments for
the general city taxes, and thereafter the Assessor in making up
the city assessment roll shall segregate the property included
within the distri,ct hereby formed on the assessment roll under
the district designation contained in the resolution, to wit:
"Lighting Maintenance Distri,ct No. 28".
SECTION 6. That Lighting Maintenance District No. 25
was formed by Resolution No. 3842 of the Arcadia City Council
adopted December 7, 1965; that all properties included with.in
aforesaid Lighting Maintenance District No. 25. as described in
Section 1 of aforesaid Resolution No. 3842, are lncluded within
L:1.ght:l..ng Maintenance Dlstrict No. 28 hereinbefore ordered formed.
That no further assessments will be levied under aforesaid Light-
ing Maintenance District No. 25. That Resolution No. 3842 adop-
ted December 7, 1965 is hereby rescinded, and the City Council
hereby directs and requests that all tax code areas heretofore
established by the County of Los Angeles solely by reason of
aforesaid Lighting Maintenance District No. 25, be abolished and
discontinued.
SECTION 7. The City Clerk shall certify to the adop-
tion of this resolution.
