HomeMy WebLinkAbout3920 RESOLUTION NO. 3920 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ARCADIA, CALIFORNIA, GRANTING A VARIANCE FROM SECTION 9263.3.1 OF THE ARCADIA MUNICIPAL CODE FOR PROPERTY LOCATED AT 1220 SOUTH BALDWIN AVENUE IN SAID CITY. THE CITY COUNCIL OF THE CITY OF ARCADIA, CALIFORNIA, DOES DETERMINE AND RESOLVE AS FOLLOWS: SECTION 1. That there was filed with the City Planning Commission on October 26, 1966, the application of Lum's of Arcadia, Inc. for a variance from Section 9263.3.1 of the Arcadia Municipal Code to permit the conduct of an outdoor eating establishment with- out providing the full amount of parking required on property lo~ cated at 1220 South Baldwin Avenue in the City of Arcadia, County of Los Angeles, State of California, more specifically described as follows: All of Lot 3 and the southerly 4 feet of Lot 2 of Tract No. 5659, as recorded in Book 115, page 100, of Maps, in the office of the Recorder of said County. ~ That after due notice as required by the Zoning Ordinance of said City a public hearing was duly held on the matter by and before the City Planning Commission on November 8, 1966, at which time all interested persons were given a full opportunity to be heard and to present evidence. That said City Planning Commission there- after on November 22, 1966 adopted its certain Resolution No. 603 wherein and whereby it recommended the granting of the requested variance. SECTION 2. That the southerly thirty-four (34) feet of the existing building is proposed to be remodeled and occupied -1- 3920 , by an outdoor eating place. That a metal shed at the rear of said property is to be removed to provide three (3) parking spaces; that four (4) additional parking spaces are shared with 1218 South Baldwin Avenue which occupies the northerly twenty (20) feet of subject property; that there is a parking agreement with property owners along Baldwin Avenue to mutually use for parking purposes a strip of land approximately seventy (70) feet in width adjacent to the easterly side of the alley behind the stores, said agreement to expire in 1972. That additional land (196 feet by 91 feet) immediately adjacent to the parking area described in said agreement is restricted by covenant for parking purposes and available for use for the benefit of the businesses on Baldwin Avenue, including subject property. That exceptional circumstances are applicable to subject property not generally applicable to property in the same vicinity because subject property is an older development surrounded by new development which has severely limited subject property's ability to provide additional parking. That the granting of the requested variance will not be materially detrimental to the public health and welfare or injurious to the property in the vicinity as the proposed use is one properly per- mitted in Zone C-2, and the removal of the non-conforming structure will be an improvement and provide extra parking spaces. That other property in the same zone and vicinity are permitted uses without the required amount of parking. That the use complies with the requirements of the General Plan and is permitted in the zone. SECTION 3. That for the foregoing reasons a variance from Section 9263.3.1 of the Arcadia Municipal Code is hereby granted with respect to the above-described property to the extent -2- 3920 necessary to permit the conduct of an outdoor eating establish- ment without providing the full amount of parking required by Section 9263.3.1 of the Arcadia Municipal Code. SECTION 4. The City Clerk shall certify to the adoption of this resolution. I HEREBY CERTIFY that the foregoing resolution was adopted at a regular meeting of the City Council of the City of Arcadia held 'on the 6th day of December, 1966, by the affirmative vote of at least three Councilmen, to wit: AYES: Councilmen Arth, Hage and Considine NOES: None Councilmen Butterworth and Form ~ #1#1 City Clerk of the City of Arcadia SIGNED AND APPROVED this 6th day of December, 1966.
