A RESOLUTION OF THE CITY COUNCIL OF
THE CITY OF ARCADIA, CALIFORNIA,
URGING GOVERNOR EDMUND G. BROWN TO
PERMIT LEGISLATIVE CONSIDERATION OF
THE MATTER OF STATE PRE-EMPTION AT
THE FORTHCOMING SPECIAL SESSION OF
THE LEGISLATURE.
vrnEREAS, the County Supervisors Association of California
has, since the decision of the Supreme Court in the Carol Lane Case,
proposed and supported legiSlative action to restore the right of
counties and cities to legislate in the fields of moral and vice;
and,
WHEREAS, legislation to restore and preserve the right of
counties and cities to legislate, particularly in the fields of
morals and vice, is strongly supported by school boards, realty
boards, churches, civic and fraternal organizations, and law en-
forcement officers and governmental officials throughout California;
and,
vrnEREAS, law enforcement in the City of Arcadia has suf-
fered from the effects of the Carol Lane case and subsequent court
cases based thereon; and,
WHEREAS, the City of Arcadia has consistently supported
and worked for the principles of home rule and for retention and
restoration of the power and authority to deal adequately with
peculiar local problems, including morals and vice generally; and,
WHEREAS, Governor Edmund G. Brown has indicated a willing-
ness to permit legislative consideration of the problem of pre-
emption at the forthcoming special sessi9n of the Legislature; and,
WHEREAS, a number of members of the Legislature have ex-
pressed a willingness to consider and act upon legislation to resolve
the problems of pre-emption in the fields of morals and vice; and,
vffiEREAS, affirmative legislative action on the problem at
the earliest possible time will benefit all the people of California;

NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF ARCADIA,
CALIFORNIA, DOES RESOLVE AS FOLLOWS:
SECTION 1. That the Honorable Governor Edmund G. Brown
be urged to permit legislative consideration of the field of state
pre-emption, and particularly in the fields of morals and vice, at
the forthcoming special session of the Legislature.
SECTION 2. The City Clerk shall certify to the adoption
of this resolution and shall cause certified copies to be forwarded
to the Honorable Governor Edmund G. Brown, Governor of the State of
California, Honorable Pearce Young, Assemblyman and Chairman of the
Assembly Committee on Criminal Procedure, Assemblyman Houston I.
Flournoy, the Board of Supervisors of the County of Los Angeles,
and to the League of California Cities.
I HEREBY CERTIFY that the foregoing resolution was adopted
at a regular meeting of the City Council of the City of Arcadia held
on the 1st day of February, 1966, by the affirmative vote of at
least three Councilmen, to wit:
AYES: Councilmen Balser, Considine, Turner and Reibold
NOES: None
ABSENT: Councilman Forman
