RESOLUTION NO. 3875
A RESOLUTION OF THE CITY COUNCIL OF
THE CITY OF ARCADIA EXPRESSING ITS
OPPOSITION TO THE ADOPTION OF ANY
MANDATORY NATIONAL OR STATE BUILDING
CODE.
WHEREAS, the City of Arcadia has for many years operated
very satisfactorily under the Uniform Building Code as recommended
by the International Conference of Building Officials; and,
WHEREAS, said Code is designed particularly for the 10-
cali ties in which it is adopted, and is reviewed annually by prac-
tieing building officials in order that said Code may be amended
to reflect desirable changes in building practices; and,
WHEREAS, The Advisory Commission on Intergovernmental
Relations has approved a recommendation that a National and state
Building Code be developed by each State, which will eventually be
adopted as mandatory requirements, and has further recommended
establishment of State licensing, Appeals Boards and staffing re-
quirements for building inspection; and,
WHEREAS, such recommended legislation is not only un-
necessary and undesirable, but would violate the principle of home
rule, would obviate the many benefits to be gained under the Uni-
form Building Code, and would constitute another unwarranted
usurpation of local authority and control by a higher level of
government;
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF ARCADIA,
CALIFORNIA, DOES HEREBY EXPRESS its strong opposition to the adop-
tion of any such National or State Building Code or building in-
spection requirements, if the purpose or the effect of the adoption
of any such National or State Building Code or building inspection
requirements be to pre-empt the field of legislation in such areas
of regulation, to preclude the adoption and enforcement of similar,
more restrictive or additional regulations in the same fields at
lower levels of government, or to do anything more than to estab-
lish minimum state-wide or nation-wide standards of construction.

The City Clerk shall certify to the adoption of this
resolution and shall cause a copy hereof to be forwarded to the
United States Senators Thomas H. Kuchel and George Murphy, to
Congressman Glenard P. Lipscomb, to the International Conference
of Building Officials and to the League of California Cities.
I HEREBY CERTIFY that the foregoing resolution was
adopted at a regular meeting of the City Council of the City of
Arcadia on the 3rd
day of

vote of at least three Councilmen, to wit:
