A RESOLUTION OF THE CITY COUNCIL OF
THE CITY OF ARCADIA, CALIFORNIA,
GRANTING A ZONE VARIANCE TO PERMIT A
HOUSEHOLD PET CLINIC IN ZONE C-l ON
PROPERTY LOCATED AT SECOND AVENUE
AND FOOTHILL BOULEVARD IN SAID CITY.
THE CITY COUNCIL OF THE CITY OF ARCADIA, CALIFORNIA, DOES
DETERMINE AND RESOLVE AS FOLLOWS:
SECTION 1. That there was filed with the City Planning
Commission on March 29, 1966, the application of M. D. Schmutz,
D.V.M., as Lessee, for a zone variance to permit the operation of
a household pet clinic in Zone C-l on property located in the pro-
posed Highlander Shopping Center at the northwest corner of Second
Avenue and Foothill Boulevard in the City of Arcadia, County of Los
Angeles, State of California, which property is more specifically
described as follows:
Lot 9, Tract No. 23972, per map recorded in Book
748, pages 63, 64 and 65, of Maps, in the office
of the County Recorder of said County.
That after due notice as required by the Zoning Ordinance of said
City a publiC hearing was duly held on the matter by and before the
City Planning Commission on April 12, 1966, at which time all inter-
ested persons were given a full opportunity to be heard and to pre-
sent evidence. That said City Planning Commission thereafter on
April 12, 1966 adopted its certain Resolution No. 584 wherein and
whereby it recommended the granting of the requested variance.
SECTION 2. That veterinary hospitals or clinics are per-
mitted in Zone C-2, subject to the issuance of a conditional use
permit, but not in Zone C-l. That the proposed use of the property
constitutes an exceptional circumstance or condition applicable to
the intended use of the property that does not apply generally to

the property or class of use in the same zone or vicinity. The
granting of said variance upon the conditions hereinafter recom-
mended will not be materially detrimental to the public health or
welfare or injurious to the property or improvements in said zone
or vicinity, and is necessary for the preservation and enjoyment of
a substantial property right of the applicant possessed by other
property in the same zone and vicinity as stated in the application,
and the granting of such variance will not adversely affect the
comprehensive general plan.
SECTION 3. That for the foregoing reasons a variance is
hereby granted to permit the operation of a household pet clinic in
Zone C-l on the above-described property upon the following con-
ditions:
1. That no animals shall be kept or maintained on the
premises overnight.
2. That no animal shall be left unattended on the prem-
ises, and a licensed veterinarian shall be assigned full time to
and be on call for duty at said location at all times during which
said pet clinic is open for business or any animal is kept or main-
tained therein.
3. That the variance hereby granted shall be for a period
of one year only. That prior to the expiration of one year the
City Planning Commission shall review the past operation of the pet
clinic and report its findings and recommendations to the City
Council, the City Council reserving the right to extend the vari-
ance from year to year, after similar review and report, and to
modify the conditions and to add new conditions thereto as found to
be necessary, all without the necessity of further notice or hearings
in the matter.

SECTION 4. The City Clerk shall certify to the adoption
of this resolution.
I HEREBY CERTIFY that the foregoing resolution was adopted
at a regular meeting of the City Council of the City of Arcadia held
on the 17th
day of

, 1966, by the affirmative vote of
at least three Councilmen, to wit:
