SECTION 2. That the granting of the requested variance
and the development and use of the property as requested thereby will
adversely affect the comprehensive general plan, particularly as
recommended by the recent amendments to the zoning ordinance, and
will therefore be materially detrimental to the public health and
welfare and injurious to the property and improvements in such zone
or vicinity in which the property is located. That there are no
exceptional or extraordinary circumstances or conditions applicable
to the property involved, or to the intended use of the property,
that do not apply generally to the property or class of use in the
same zone or vicinity. That such variance is not necessary for the
preservation and enjoyment of a substantial property right of the
applicant possessed by other property in the same zone and vicinity.
SECTION 3. That for the foregoing reasons the requested
zone variance to permit the construction of an apartment above ground
floor offices on the above-described property is hereby denied.
