HomeMy WebLinkAbout3877 RESOLUTION NO. 3877 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ARCADIA, CALIFORNIA, DENYING A ZONE VARIANCE TO PERMIT THE CONSTRUCTION OF AN APARTMENT ABOVE GROUND FLOOR OFFICES ON REAL PROPERTY LOCATED AT 414 SOUTH FIRST AVENUE IN SAID CITY. THE CITY COUNCIL OF THE CITY OF ARCADIA, CALIFORNIA, DOES DETERMINE AND RESOLVE AS FOLLOWS: SECTION 1. That there was filed with the City Planning Commission on March 29, 1966, the application of Arcadia - Monrovia Realty, as optionee, for a zone variance to permit the construction of an apartment above ground floor offices on property located at 414 South First Avenue in the City of Arcadia, County of Los Angeles, State of California, more specifically described as follows: Lot 3, Block 64, Arcadia Santa Anita Tract, per map recorded in Book 15, pages 89 and 90, of Maps, in the office of the County Recorder of said County. That after due notice as required by the Zoning Ordinance of said City a public hearing was duly held on the matter by and before the City Planning Commission on April 12, 1966, at which time all inter- ested persons were given a full opportunity to be heard and to pre- sent evidence. That said City Planning Commission thereafter on April 12, 1966, adopted its certain Resolution No. 585 wherein and whereby it recommended the denial of the requested variance. That within ten (10) days thereafter a written appeal from said decision and recommendation was duly filed by applicant, pursuant to which after notice duly given a publiC hearing was held before the City Council of the City of Arcadia on May 3, 1966, at which time all interested persons were given full opportunity to be heard and to present evidence. -1- 3877 SECTION 2. That the granting of the requested variance and the development and use of the property as requested thereby will adversely affect the comprehensive general plan, particularly as recommended by the recent amendments to the zoning ordinance, and will therefore be materially detrimental to the public health and welfare and injurious to the property and improvements in such zone or vicinity in which the property is located. That there are no exceptional or extraordinary circumstances or conditions applicable to the property involved, or to the intended use of the property, that do not apply generally to the property or class of use in the same zone or vicinity. That such variance is not necessary for the preservation and enjoyment of a substantial property right of the applicant possessed by other property in the same zone and vicinity. SECTION 3. That for the foregoing reasons the requested zone variance to permit the construction of an apartment above ground floor offices on the above-described property is hereby denied. SECTION 4. The City Clerk shall certify to the adoption of this resolution.
