HomeMy WebLinkAbout3894 RESOLUTION NO. 3894 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ARCADIA, CALIFORNIA, SUSTAINING THE ACTION OF THE CITY PLANNING COMMISSION AND DENYING A REQUEST FOR A CONDITIONAL USE PERMIT TO CONSTRUCT A SERVICE STATION ON PROPERTY LOCATED AT 600, 604 AND 610 NORTH SANTA ANITA AVENUE IN SAID CITY. WHEREAS, there was filed with the City Planning Commission on May 12, 1966, the application of Atlantic Richfield Company for a conditional use permit to construct a service station on property located at 600, 604 and 610 North Santa Anita Avenue in the City of Arcadia, County of Los Angeles, State of California, more specifically described as follows: Lots 17, 18 and 19 of Haven Tract per map recorded in Book 13, pages 22 and 23, of Maps, in the office of the County Recorder of said County; which property is situated at the northeast corner of the intersection of Santa Anita Avenue and Newman Avenue. That after due notice as required by the Zoning Ordinance of said City, a public hearing was , held on the matter by and before said City Planning Commission on June 14, 1966, at which time all interested persons were given full opportunity to be heard and to present evidence. That said City Plan- ning Commission thereafter on June 28, 1966, adopted its certain Reso- lution No. 592 wherein and whereby it made certain findings and deter- minations and denied the requested conditional use permit for the reasons therein stated. That within ten (10) days thereafter a written appeal from said decision was duly filed by applicant, in accordance with Section 9275.2.9 of the Arcadia Municipal Code, pursuant to which after notice duly given a public hearing was held before the City Council of the City of Arcadia on August 2, 1966, at which time all interested per- sons were given full opportunity to be heard and to present evidence: -1- 3894 NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF ARCADIA, CALIFORNIA, DOES DETERMINE AND RESOLVE AS FOLLOWS: SECTION 1. That subject property is in Zone M-l P.I.D. and is presently developed with four (4) non-conforming residential structures, plus garages. That the proposed development would re- move the existing buildings in order to construct a service station facility. That the location of a service station on subject site does not meet the criteria of essential services as provided for in the legislative intent section of the M-l Division of the Zoning Ordinance. That two other service stations are located within 500 feet of subject property and are adequate;to serve the needs of this industrial area and more particularly the industrial area adjacent to Santa Anita Avenue. That the granting of a conditional use permit would be adverse to the comprehensive general plan. SECTION 2. That for the foregoing reasons this City Council sustains the action of the City Planning Commission in denying the request for a conditional use permit to construct a service station on the above-described property, and said request is hereby denied. SECTION 3.
