RESOLUTION NO. 3821
A RESOLUTION OF THE CITY COUNCIL OF
THE CITY OF ARCADIA, CALIFORNIA,
DENYING THE APPLICATION FOR CHANGE
OF ZONE FROM ZONE C-2 TO ZONE C-l
ON PROPERTY LOCATED ON THE EAST SIDE
OF MICHILLINDA AVENUE NORTH OF
HUNTINGTON DRIVE IN SAID CITY.
THE CITY COUNCIL OF THE CITY OF ARCADIA, CALIFORNIA, DOES
HEREBY DETERMINE AND RESOLVE AS FOLLOWS:
"
SECTION 1. That there was filed with the City Planning Com-
mission on June 4, 1965, the application of Warren F. Paetz and
James R. Grimes, as owners of neighboring property, and the Santa Anita
Viilage Community Association, for a zone change from Zone C-2 to
Zone C-l of property located on the east side of Michillinda Avenue
north of Huntington Drive in the City of Arcadia, County of Los Angeles,
State of California, more specifically described as follows:
Lots 3 and 4, Tract No. 14846, as recorded
in Book 314, pages 8 and 9, in the office
of the County Recorder of said County.
That after notice required by the Zoning Ordinance of said City a
public hearing was duly held on Isaid application by and before said

City Planning Commission on June 22~1965, at which time all interested
persons were given a full opportunity to be heard and to present evi-
dence. That upon the expiration of thirty-five (35) days after the
close of said hearing the matter was referred to the Arcadia City
Council without recommendation, pursuant to Section 9291.2.6 of the
Arcadia Municipal Code. That thereafter, after notice duly given, a
public hearing on said matter was held by and before this City Council

on September &!, 1965, at which time all interested persons were
given full opportunity to be heard and to present evidence.

SECTION 2. That subject property is in Zone C-2, That
all property westerly thereof is in unincorporated territory, and
for the most part is zoned and used for single family residential
purposes. That all adjacent property in the City to the south,
east and northeast is zoned R-3 except for the property abutting
Sunset Boulevard between Balboa Drive and Michillinda Avenue which
is zoned R-l, That the corner properties to the east in the City
and to the west in unincorporated territory are developed and used
commercially. That sixty percent (60%) of subject property has
been developed and used for stores and shops, a bank, service
station, nursery and other commercial uses, and the balance thereof
is vacant. That the property owner has leased the major portion
of subject property to the May Company which is in the process of
developing the site under the existing zone with a department store
and parking structure.
That the subject application was filed by owners of neigh-
boring property who neither own nor have a financial interest in
any portion of the subject property; that the applicants' stated
objective of maintaining a neighborhood shopping center would not
necessarily be accomplished by granting the requested rezoning, as
subject site is far in excess of the land areas generally considered
to be adequate for neighborhood shopping centers.
That the development of subject property now in progress
will not materially add to any traffic problem of applicants because
the site is located on the periphery of the residential areas and is
bounded by arterial streets. That irrespective of the development
of subject property now in process, Michillinda Avenue is destined
to become more of a major traffic arterial in the near future than
it is at present, when it is extended north of the planned Foothill
Freeway to Foothill Boulevard.

That neither the public necessity, convenience, general
welfare or good zoning practice justify the requested reclassification.
SECTION 3. That for the foregoing reasons the requested
reclassification of the above-described property should be and the
same is hereby denied. That the within denial shall be without
prejudice to further consideration of and action concerning the
portions of subject property that directly abut Huntington Drive,
if studies hereafter undertaken by the Planning Department warrant
any reclassification of said portions of subject property.
SECTION 4. The City Clerk shall certify to the adoption of
this resolution.
I HEREBY CERTIFY that the foregoing resolution was adopted
at a regular meeting of the City Council of the City of Arcadia held
on the 5th day of October
