HomeMy WebLinkAbout3835 , RESOLUTION NO, 3835 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ARCADIA, CALIFORNIA, DENYING A ZONE VARIANCE TO PERMIT THE DEVELOPMENT OF TWO TWELVE OR EIGHT STORY AND PENTHOUSE RESIDENTIAL STRUCTURES ON PROPERTY LOCATED AT 515-603 WEST DUARTE ROAD IN SAID CITY. WHEREAS, there was filed with the City Planning Commission on August 31, 1965, the application of Claflin Ballance as owner in escrow, for a zone variance to allow the development of two (2) twelve (12) or eight (8) story and penthouse residential (condominium owner- - . . ship) structures on property located at 515-603 West Duarte Road in the City of Arcadia, County of Los Angeles, State of California, more specifically described as follows: Lots 45, 46, and 47, except that portion of said Lot 47 lying easterly of a line extending northerly from a point in the south line of said Lot 47, distant westerly thereon 17.06 feet from the south- east corner of said lot to a point in the north line of said Lot 47 distant westerly thereon 16.88 feet from the northeast corner of said Lot 47, of Tract No. 3430, per map recorded in Book 42, page 32, of Maps, in the office of the County Recorder of said County. That after due notice as required by the Zoning Ordinance of said City, a public hearing was duly held by and before said City Planning Com- mission on September 28, 1965, at which time all interested parties were given a full opportunity to be heard and to present evidence. That said City Planning Commission thereafter on October 7, 1965 adopted its certain Resolution No. 566 wherein and whereby it recommended the denial of the requested variance. That within ten (10) days thereafter a written appeal from said decision and recommendation was duly filed by applicants, pursuant to which after notice duly given a public hearing was held before the City Council of the City of Arcadia on November 2, 1965, at which time all interested persons were given full opportunity to be heard and to present evidence; -1- 3835 , NOW, THEREFORE, THE C~TY COUNCIL OF THE CITY OF ARCADIA, CALIFORNIA, DOES DETERMINE AND RESOLVE AS FOLLOWS: SECTION 1. That subject property is in Zone R-l with an existing variance to use the site for apartments at the rate of one (1) dwelling unit for each two thousand (2,000) square feet of land, - whereas the application requests permission to have one (1) unit for each one thousand seven hundred seventy-eight (1,778) feet, a dif- - ference of seventeen (17) units, That the height limit of subject property is two (2) stories not to exceed thirty-five (35) feet, whereas the proposed buildings have twelve (12) stories, plus a pent- house with a total height of one hundred thirty-two (132) feet. That - . applicant alternately proposes an eight (8) story development. SECTION 2. That there are no exceptional or extraordinary circumstances or conditions applicable to the property involved, or to the intended use of the property, that do not apply generally to the property or class of use in the same zone or vicinity. That the granting of the requested variance will be materially detrimental to the public health or welfare or injurious to the property or improve- ments in such zone or vicinity in which the property is located. That such variance is not necessary for the preservation and enjoyment of a substantial property right of the applicant possessed by other prop- erty in the same zone and vicinity as evidenced by the amount of apart- ment development in the immediate vicinity under the same zoning and variance as is applicable to subject property. SECTION 3. That for the foregoing reasons the requested zone variance to permit the development of two:(2) twelve (12) or eight (8) story and penthouse residential structures on the above- described property is hereby denied. -2- 3835 , '- SECTION 4. The City Clerk shall certify to the adoption of this Resolution. I HEREBY CERTIFY that the foregoing Resolution was adopted at a regular meeting of the City Council of the City of Arcadia held on the 7th day of December , 1965, by the affirmative vote of at least three Councilmen, to wit: AYES: Councilmen Balser, Considine, Forman NOES: Councilmen Turner and Reibold ABSENT: None ~' ~~ ~ ~~-u; .
