HomeMy WebLinkAbout3842 RESOLUTION NO. 3842 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ARCADIA, CALIFORNIA, ORDERING THE FORMATION OF A LIGHTING MAINTENANCE DISTRICT, DESIGNATED AS "LIGHTING MAINTENANCE DISTRICT NO. 25", TO PAY THE COSTS AND EXPENSES FOR THE MAINTENANCE AND OPERATION OF A STREET LIGHTING SYSTEM ON PORTIONS OF PECK ROAD, BALDWIN AVENUE, DUARTE ROAD, NAOMI AVENUE, SANTA ANITA AVENUE, LOVELL AVENUE, SANTA CLARA STREET, FIRST AVENUE, THE ALLEY EAST OF BALDWIN AVENUE, HUNTINGTON DRIVE, MORLAN BLACE, AND SUNSET BOULEVARD IN SAID CITY. THE CITY COUNCIL OF THE CITY OF ARCADIA, CALIFORNIA, DOES HEREBY ORDER, FIND AND RESOLVE AS FOLLOWS: SECTION 1. That pursuant to the provisions of Resolution of Intention No. 3831, passed, approved and adopted November 2, 1965, and after a publiC hearing on the matter in conformance with the provisions of the Municipal Lighting Maintenance District Act of 1927, being Divi- sion 14, Part 3, of the Streets and Highways Code of the State of Cali- fornia, it is hereby ordered that a lighting maintenance district be and the same is hereby formed and that the boundariesiof such lighting maintenance district, which district is to pay the cost and expenses for the maintenance and operation of a street lighting system on portiona of Peck Road, Baldwin Avenue, Duarte Road, Naomi Avenue, Santa Anita Avenue, Lovell Avenue, Santa Clara Street, First Avenue, the Alley East of Baldwin Avenue, Huntington Drive, Morlan Place, and Sunset Boulevard in said City, over and above the sixty per cent (60%) of the total main- tenance and operation costs and expenses thereof to be paid out of the treasury of the City of Arcadia from the general fund of said City, shall be and the same are hereby finally established in conformance with and shown on that certain map entitled "Diagram of Lighting Maintenance Dis- trict No. 25", heretofore prepared by the City Engineer and approved and adopted by Resolution No. 3830 of the City Council of the City of Arcadia on November 2, 1965, and on file in the office of the City Clerk of said City. That the boundaries of said Lighting Maintenance District No. 25 and the properties included therein are defined, bounded and described as follows: -1- 3842 LIGHTING MAINTEN&~CE DISTRICT NO. 25 BOUNDARY DESCRIPTION CITY OF ARCADIA Parcel No, 25-1 Beginning at the intersection of the southerly property line of Huntington Drive, 80 feet wide, and the easterly line of Michillinda Avenue, 50 feet wide; thence northerly along said easterly line 384,86 feet; thence easterly to a point on the westerly line of Sunset Boulevard intersecting with a line that is tangent to a curve on the south line of Portola Drive, 60 feet wide, said curve being concave to the southeast having a radius of 20 feet and a length of 36,25 feet, said line being tangent at the easterly terminus of said curve, thence easterly along said tangent to the point of tangency; thence easterly along said south line of said Portola Drive 86.21 feet; thence southerly along a line parallel with the center line of said Sunset Boulevard 54.35 feet; thence easterly parallel with the centerline of Huntington Drive to the west line of Cortez Road; SECTION 2. That the items of expense of maintenance and operation of the said lighting system in said District to be furnished and to be assessed in part against the lands within the district (ex- clusive of improvements) for the first year, commencing December 31, 1965, are the rate charge by the utility company for electric power (which rate includes the cost of repairs, replacements, maintenance, labor and materials) and the cost of publication, posting of notices and engineering costs in the formation of the District. That the es- timated amount of electric power necessary for said system for each year is five hundred fourteen thousand, three hundred thirty eight and thirty-nine hundredths (514,338.39) kilowatt hours and the estimated cost of said electric power for the first year of maintenance and opera- tion is the sum of Twenty-four thousand four hundred forty-three and 76/100 dollars ($24,443.76) and the estimated cost of other items of maintenance and operation for the first year is Three thousand, one hundred four and 38/100 dollars ($3,104.38). That the total estimated cost of the first year's maintenance and operation is Twenty seven thousand, five hundred forty-eight and 14/100 dollars ($27,548.14). SECTION 3. That the percentage of the total expenses of the aforesaid maintenance and operation to be paid by the aforesaid dis- trict, as set forth in aforesaid Resolution No. 3831 of the City Council of the City of Arcadia, shall be paid by special assessment taxes levied upon all lands, exclusive of improvements, within said district as here- inabove formed and established. SECTION 4. That sixty percent (60%) of the total expenses of maintenance and operation of said district shall be paid out of the treasury of the City of Arcadia from the general fund of said City and the remainder of the total expenses of maintenance of said district shall be paid by said district. -9- 3842 SECTION 5. That a certified copy of this resolution shall be filed with the Assessor who makes the assessments for the general city taxes, and thereafter the Assessor in making up the city assess- ment roll shall segregate the property included within the district hereby formed on the assessment roll under the district designation contained in the resolution, to wit: "Lighting Maintenance District No. 25". SECTION 6. That Lighting Maintenance District No. 16 was formed by Resolution No. 3344 of the Arcadia City Council, adopted January 17, 1961; that Lighting Maintenance District No. 23 was formed by Resolution No. 3640 of the Arcadia City Council, adopted January 21, 1964; that all properties included within aforesaid Light~ng Maintenance Districts Nos. 16 and 23, as described in Section 1 of each of aforesaid Resolutions Nos. 3344 and 3640 respectively, are included within Lighting Maintenance District No. 25 hereinbefore ordered formed. That no further assessments will be levied under aforesaid Lighting Maintenance Districts Nos. 16 and 23. That Reso- lutions No. 3344 adopted January 17, 1961 and No. 3640 adopted January 21, 1964 are hereby rescinded, and the City Council hereby directs and requests that all tax code areas heretofore established by the County of Los Angeles solely by reason of aforesaid Lighting Maintenance Districts Nos. 16 and 23, be abolished and discontinued. SECTION 7.
