HomeMy WebLinkAbout3843 RESOLUTION NO. 3843 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ARCADIA, CALIFORNIA, ORDERING THE FORMATION OF A LIGHTING MAINTENANCE DISTRICT, DESIGNATED,AS "LIGHTING MAINTENANCE DISTRICT NO. 26", TO PAY THE COSTS AND EXPENSES FOR THE. MAINTENANCE AND OPERATION OF A STREET LIGHTING SYSTEM ON PORTIONS OF CERTAIN DESIGNATED STREETS IN SAID CITY. THE CITY COUNCIL OF THE CITY OF ARCADIA, CALIFORNIA, DOES HEREBY ORDER, FIND AND RESOLVE AS FOLLOWS: SECTION 1. That pursuant to the provisions of Resolution of In- tention No. 3833, passed, approved and adopted November 2, 1965, and after a public hearing on the matter in conformance with the provisions of the Municipal Lighting Maintenance District Act of 1927, being Division 14, Part 3, of the Streets and Highways Code of the State of California, it is hereby ordered that a lighting maintenance district be and the same is hereby formed and that the boundaries of such lighting maintenance district, which district is to pay the cost and expenses for the maintenance and operation of a street lighting system on portions of the following desig- nated streets in said City: Cornell Drive Hungate Lane Southview Road Naomi Avenue Norman Avenue Melanie Lane Sharon Road Wistaria Avenue Holly Avenue Rosemarie Drive Duarte Road Lyndon Way Drake Road El Sereno Drive Leafwood Lane Rodell Place Longley Way Magna Vista Avenue Windsor Road Greenfield Avenue Second Avenue Third Avenue Leda Lane Fourth Avenue Fifth Avenue Peachtree Lane Robbins Drive Coyle Avenue Eighth Avenue Doolittle Avenue Altura Road Andrews Road La Ramada Avenue Oakglen Avenue Las Flores Avenue Tulip Lane -1- Newman Avenue Sunset Boulevard Sierra Madre Boulevard Oakwood Avenue Wilson Avenue Elevado Avenue Grandview Avenue Oaks Place White Oak Drive Elkins Place Canyon Road Carolwood Drive Cabrillo Road Palm Drive Palm Circle Estrella Avenue El Capitan Avenue Highland Vista Drive 3843 Fairview Avenue Azure Way Santa Anita Terrace Santa Anita Avenue Camino Real Avenue Birchcroft Street Lee Avenue Longden Avenue Winnie Way Grace Avenue Louise Avenue Watson Drive La Sierra Drive Ilene Drive Altern Street Pamela Road Tenth Avenue Ninth Avenue Encino Avenue Camino Grove Avenue Sixth Avenue Bungalow Place Loganrita Avenue Magnol"ia Lane Oakwood Drive Highland, Oaks Drive Woodland Avenue Orange Grove Avenue Ontare Road Marendale Lane Yorkshire Dri ve Virginia Drive Santa Maria Road Vista Avenue Angelo Place Marilyn Place Hillgreen Place Topaz Place Rodeo Road Orangewood Lane Anita Crest Drive Andrea Lane Stone House Road Chantry Drive Grand View Avenue Orlando Drive Colorado Street San Carlos Road Merry Oak Lane over and above the fifty percent (50%) of the total maintenance and operation costs and expenses thereof to be paid out of the treasury of the City of Arcadia from the general fund of said City, shall be and the same are hereby finally established in conformance with and shown on that certain map entitled "Diagram of Lighting Maintenance District No. 26", heretofore prepared by the City Engineer and approved and adopted by Resolution No. 3832 of the City Council of the City of Ar- cadia on November 2, 1965, and on file in the office of the City Clerk of said City. That the boundaries of said Lighting Maintenance District No. 26 and the properties included therein are defined, bounded and described as follows: ., -2- 3843 LIGHTING MAINTENANCE DISTRICT NO. 26 BOUNDARY DESCRIPTIONS CITY OF ARCADIA Parcel 26-1 Beginning at the southwest corner of Lot 5, Tract No. 19503, as per map recorded in Book 584, pages 27 and 28, of maps in the office of the Recorder of Los Angeles County; thence northerly along the westerly line of said Tract to a point of inter- section with the westerly prolongation of the center line of an alley contiguous to the northerly line of said Tract; thence easterly along said prolongation and center line to a point of intersection with the northerly prolongation of the easterly line of Lot 12 of said Tract No. 19503; thence southerly along said last mentioned line and prolongation to the southerly property line of Southview Road; thence westerly along said property line to the northeast corner of Lot 7 of Tract No. 22220, as per map recorded in Book 626, Pages 32 and 33 of Maps in the office of said Recorder; thence southerly along the easterly line of Lot 7 of said Tract No.22220 and along its southerly prolongation to the center line of an alley contiguous to the south- erly line of said Tract No. 19503; thence westerly along said center line and its westerly prolongation to the westerly line of said Tract; thence northerly along said westerly line to the point of beginning. SECTION 2. That the items of expense of maintenance and operation of the said lighting system in said District to be furnished and to be assessed in part against the lands within the district (ex- clusive of improvements) for the first year, commencing December 31, 1965, are the rate charge by the utility company for electric power (which rate includes the cost of repairs, replacements, maintenance, - labor and materials) and the cost of publication, posting of notices and engineering costs in the formation of the District. That the es- timated amount of electric power necessary for said system for each year is five hundred eight thousand, five hundred twenty-seven and sixty-five hundredths (508,527.65) kilowatt hours and the estimated cost of said electric power for the first year of maintenance and operation is the sum of Twenty six thousand two hundred fifty-seven and 80/100 dollars ($26,257.80) and the estimated cost of other items of maintenance and operation for the first year is Three thousand two hundred eighty-five and 78/100 dollars ($3,285.78). That the total estimated cost of the first year's maintenance and operation is Twenty . . nine thousand five hundred forty-three and 58/100 dollars ($29,543.58). SECTION 3. That the percentage of the total expenses of the aforesaid maintenance and operation to be paid by the aforesaid dis- trict, as set forth in aforesaid Resolution No. 3833 of the City Council of the City of Arcadia, shall be paid by special assessment taxes levied upon all lands, exclusive of improvements, within said district as hereinabove formed and established. SECTION 4. That fifty percent (50%) of the total expenses of maintenance and operation of said district shall be paid out of the treasury of the City of Arcadia from the general fund of said City and the remainder of the total expenses of maintenance of said district shall be paid by said district. -29- 3843 .' SECTION 5. That a certified copy of this resolution shall be filed with the Assessor who makes the assessments for the general city taxes, and thereafter the Assessor in making up the city assess- ment roll shall segregate the property included within the district hereby formed on the assessment roll under the district designation contained in the resolution, to wit: "Lighting Maintenance District No. 26n. SECTION 6. That Lighting Maintenance District No. 15 was - formed by Resolution No. 3343 of the Arcadia City Council, adopted January 17, 1961; that Lighting Maintenance District No. 20 was formed by Resolution No. 3625 of the Arcadia City Council, adopted November 5, 1963; that Lighting Maintenance District No.. 22 was formed by Resolution No. 3639 of the Arcadia City Council, adopted January 21, 1964; that Lighting Maintenance District No. 24 was formed by Resolution No. 3756 of the Arcadia City Council adopted January 19, 1965; that all properties included within aforesaid Lighting Maintenance Districts Nos. 15, 20, 22 and 24, as described in Section 1 of each of aforesaid Resolutions Nos. 3343, 3625, 3639 and 3756 respectively, are included within Lighting Maintenance Dis- trict No. 26 hereinbefore ordered formed. That no further assessments will be levied under aforesaid Lighting Maintenance Districts Nos. 15, 20, 22 and 24. That Resolutions No. 3343 adopted January 17, 1961, No. 3625 adopted November 5, 1963, No. 3639 adopted January 21, 1964, and No. 3756 adopted January 19, 1965 are hereby rescinded, and the City Council hereby directs and requests that all tax code areas here- tofore established by the County of Los Angeles solely by reason of aforesaid Lighting Maintenance Districts Nos. 15, 20, 22 and 24, be abolished and discontinued. -30- 3843 SECTION 7. The City Clerk shall certify to the adoption of this resolution.
