HomeMy WebLinkAbout3708 RESOLUTION NO. 3708 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ARCADIA, CALIFORNIA DENYING A. ZONE VARIANCE FOR PARKING ON R-1 PROPERTY LOCATED AT 9977 WOODRUFF AVENUE AND 2580 BALDWIN AVENUE IN SAID CITY. WHEREAS, there was filed with the City Planning Commission on June 19, 1964, the application of the First Baptist Church of Temple City by Kermit G. Dunkelberger, Pastor, for a zone variance to permit the use of two Zone R-l lots for church parking lot purposes on property located at 9977 Woodruff Avenue and 2580 Baldwin Avenue in the City of Arcadia, County of Los Angeles, State of California, described as follows: Parking Lot No. 1 - 9977 Woodruff Avenue: Portion of Lot 6 of Tract No. 6561 per map recorded in Book 72, pages 34 and 35, Official Records of said County; Parking Lot No. 2 - 2580 Baldwin Avenue: Lot 14 of Tract No. 6501, per map recorded in Book 66, page 84, Official Records of said County; That after due notice as required by the Zoning Ordinance of said City, a public hearing was duly held by and before said City Planning Com- mission on July 14, 1964, at which time all interested parties were given a full opportunity to be heard and to present evidence. That said City Planning Commission thereafter on June 28, 1964, adopted its certain Resolution No. 522 wherein and whereby it recommended the denial of the requested variance; NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF ARCADIA, CALIFORNIA, DOES DETERMINE AND RESOLVE AS FOLLOWS: SECTION 1. That applicant's need for additional parking results from its construction of additional church and related faci1i- ties on property owned and heretofore used by applicant for parking purposes; that such construction is being done under a variance granted by an adjacent jurisdiction, which variance requires applicant -1- 3708 to furnish additional parking. That it has not been shown either by the application itself or by any testimony presented that the granting of the requested variance is necessary for the preservation or enjoy- ment of a substantial property right of the applicant possessed by other property in the same zone and vicinity; on the contrary the evi- dence presented shows that applicant owns other property within the same block and within the same political jurisdiction as its church, which property is not being used for church or church parking purposes; likewise that applicant does not even own Parking Lot No.1. That the granting of the variance will be materially detrimental to the publiC health or welfare by permitting parking lots across the street from the facility intended to be served thereby; that particularly with respect to parking Lot No. 2 situated on the east side of Baldwin Avenue the users thereof will have to cross a heavily travelled thoroughfare at an unsignal1ed intersection, while the users of Parking Lot No. 1 will have to cross a less heavily travelled street but at its inter- section with a heavily travelled thoroughfare. That neither in the application nor by any evidence presented was it shown that the grant- ing of the requested variance will not adversely affect the comprehen- sive general plan of the area; on the contrary, the properties on both sides of Woodruff Avenue from Baldwin Avenue to Holly Avenue and in fact all the properties between Baldwin Avenue and Holly Avenue from Wood- ruff Avenue northerly to at least Longden Avenue are zoned R-1, and all of the properties on the west side of Baldwin Avenue between Woodruff Avenue and Garibaldi Avenue are zoned R-3, in neither of which zones are permitted the proposed uses of subject property. SECTION 2. That for the foregoing reasons the requested zone variance for parking on R-1 property as hereinbefore described is hereby denied. -2- 3708 , .SECTION 3. The City Clerk shall certify to the adoption of this Resolution.
