A RESOLUTION OF THE CITY COUNCIL
OF THE CITY OF ARCADIA, CALIFORNIA,
DETERMINING AND ESTABLISHING
REGULATIONS APPLICABLE TO REAL
PROPERTY LOCATED AT THE SOUTHWEST
CORNER OF SECOND AVENUE AND DUARTE
ROAD IN SAID CITY UPON ITS
CLASSIFICATION INTO ZONE D
(ARCHITECTURAL OVERLAY).
THE CITY COUNCIL OF THE CITY OF ARCADIA, CALIFORNIA, DOES

DETERMINE AND RESOLVE AS FOLLOWS:
SECTION 1. That the City Council has heretofore determined
that the property located at 134-138, 140, 150, 160 and 186 East Duarte
Road and 915-921 South Second Avenue in the City of Arcadia, County of
Los Angeles, State of California, described as follows:
PARCEL 1:
That portion of Lots 13 and 14, Tract No. 808,
City of Arcadia, Book 16, page 82 of Maps.
described as follows:
Beginning at a point in the northerly line of
said Lot 13. distant easterly 117.5 feet from
the northwest corner thereof; thence easterly
along the northerly lines of said Lots 13 and
14 a distance of 112 feet; thence southerly in
a direct line to a point in the southerly line
of Lot 14 distant 6 feet easterly from the
southwest corner thereof; thence westerly along
the southerly lines of Lots 14 and 13 a distance
of 110.96 feet; thence northerly in a direct
line to the point of beginning. EXCEPT there-
from the northerly 12 feet, measured at right
angles to said land. ALSO EXCEPT the southerly
272 feet of said land;

frpm the southerly 326 feet. ALSO EXCEPT that portion
of said Lot described in the deed to the City of Arcadia,
recorded 12/28/55 as Document No. 2439 in Book 49904.

PARCEL 6:

Book 16, page 82, of Maps. EXCEPT therefrom
the easterly 12 feet;
should be reclassified and established in Zones C-l and C-2, and also in
Zone D (Architectural Overlay), and has adopted its Ordinance No. 1265
classifying and establishing said property in Zones C-l, C-2 and D
(Architectural Overlay).
SECTION 2. That for the protection of properties in the
vicinity, for the integration of subject property with the uses in
effect or permissible in the area, and to promote the full and proper
utilization of the aforesaid property, the following restrictions
should be and the same hereby are imposed upon the above-described
property, pursuant to Division 2 of Part 7 of Chapter 2 of Article IX
of the Arcadia Municipal Code, to wit:

2. A five (5) foot planting strip shall be installed and
maintained on the south side of the proposed alley, densely planted
with trees or bushes to effectively screen the site from the R-1
properties to the south. The size, type, and location of such plant-
ings shall meet the approval of the Planning Department. To accomplish
this condition the alley shall be irrevocably offered for dedication
to the City but not accepted until it is determined if it is required

for the welfare of the general public. In the meantime it shall remain
a ~r~vate accessway and may be reduced in width to fifteen (15) feet.
Because of this shallow width, only one way, westbound traffic shall'
be permitted on such private accessway. Signs designating the re-
quired direction of traffic flow shall be located in areas meeting the
approval of the Department of Public Works. The six (6) foot masonry
wall shown on the plot plan as well as the trees and planting areas
adjacent to the southern part of the buildings shall also be required.
The wall height shall be measured from adjoining properties, and shall
in no case be less than five feet six inches (5'6") high when measured
from within the site at random points adjacent to the wall.
3. There shall be no advertising signs on the south or
west sides of the buildings.
4. Mechanical equipment for the buildings shall be placed
within the buildings or in other enclosures which may, under the
following conditions, be placed on the roofs.
If said equipment protrudes beyond the roof line of the
market structure, it shall do so only on the north side, shall not
project above the roof peak, and shall be screened from view in a
manner approved by the Planning Department. If said equipment is
Placed on the roofs of other store buildings, it shall be limited to
the northerly one-half of each building, shall not exceed a height of
two (2) feet above the parapet walls, and shall be screened from view
in a manner approved by the Planning Department.
The noise from any such equipment, when measured at random
points five (5) feet in height and twenty-five (25) feet south of the
southerly property line, shall not exceed the ambient noise level at
said locations for the respective times of day, when measured in the
absence of said equipment in operation.

5. On-site cleaning and maintenance and trash c,ollection
for all bu~ld1ngs shall only be permitted during the hours of 7:00 a.m.
to 9:00 p.m. Deliveries to all buildings except the market shall be
similarly limited to the same hours. Noise from such activities and
~!:o~ marketdeliveries, when measured at random points five (5) feet
in.h~ight and twenty-five (25) feet south of the southerly property

line. shall not exceed the normal ambient noise level at such measur-
i~g ~ocation for the respective time of day, as measured in the
absence of the activity involved.
6. The service station shall not be operated or advertised
as a self service type. It shall not sell, store, lease, or provide
storage trailers. It shall not sell peat moss. toys or anything not
clearly incidental to the automotive industry. Service bays shall
have access from the rear.
7. Walls thirty-six inches (36") high shall be prOVided
along the north and east property lines, except in areas where curb
cuts are permitted.
8. All planting areas shall be separated from paving bear-
ing vehicular traffic by a six (6) inch concrete curb and irrigated
with a permanent underground irrigation system.
9. The entire site shall be developed contemporaneously as
one building site.
10. All utilities, including electrical and telephone, shall
be installed underground in a manner meeting with the approval of the
Department of Public Works. Vault space, when required, shall be

provided either at surface level or underground, but not elevated, in
a manner meeting with the approval of the Department of Public Works.
11. The illumination of buildings and parking areas shall
be directed away from the neighboring properties and the publiC right-
of-way. The parking lot light standards shall not exceed fourteen (14.)
feet in height.

12. Street lights and street trees shall be installed and
planted in locations approved by and to the standards of the Depart-
ment of Public Works.
13. Sidewalks shall be constructed along Duarte Road and
Second Avenue the full width of the parkway in accordance with City
standards.
14. Sewer connections shall be made in locations and to the
satisfaction of the Department of Public Works.
15. The parking stall size shall not be less than nine (9)
feet wide by twenty (20) feet long.
16. The asphaltic concrete surfacing shall comply with
Section 1318.1 of the Arcadia Municipal Code.
17. The appropriate corner cut-offs for Duarte and Second
Avenue shall be dedicated to the City for street purposes. Second
Avenue shall be dedicated and improved in accordance with the standards
on file in the Department of Public Works.
18. Building height including architectural features (but
excluding mechanical equipment specified in Condition 4) shall not
exceed twenty-five (25) feet at the market ridge line and fourteen

(14) feet at the northerly and southerly extremities. and fourteen
(14) feet at the parapet wall top of the satellite stores. All such

heights shall be measured from an elevation of 435.0 feet.
19. One free standing sign, not exceeding a height of twenty-
five (25) feet and an area of one hundred (100) square feet. shall be

permitted to identify the name of the service station.
20. One sign, not exceeding a height of twenty-five (25)

feet from an elevation of 435.0 feet and not exceeding an area of' one

Such sign may be either free standing or placed above the market, per-
pendicu1ar to and contiguous to the north property line and shall not
exceed the peak roof height.

21. The A1phaBeta Market facade sign placed within the roof
beams on the east side only, as depicted in the official elevation and
standard detail. are specifically permitted. All other buildings may
have an amount of sign area on the front facade which does not exceed
one and 0~e-ha1f (1~) square feet of sign area for each lineal foot

of building frontage. All such signs shall be mounted on the facades
of t~e buildings and shall pertain only to the name of the business or
the use conducted within the building.
22. .Signs shall not project above the roof line of the
building.
23. Billboards, attraction boards, and banners shall not be
permitted.
24. For sale or lease signs shall not exceed four (4) square
feet.
25. Moving or rotating signs, or signs having any moving
parts, or blinking, flaShing, or moving lights shall not be permitted.
26. All permanent and temporary storage of crates, bottles,
trash, or other materials shall either be within the buildings or in
areas enclosed by solid block walls not less than six (6) feet in
height, at locations and of a design approved by the Planning Depart-
ment. No materials stored outside shall exceed the height of the
surrounding wall enclosure.
27. Complete landscape planting and sprinkler irrigation
plans prepared by a registered landscape architect shall be submitted
as part of the working drawing package. Such plans shall be approved
by the Planning Department.
28. Complete grading and drainage plans showing existing
elevations and existing excavations shall be submitted as part of the
working drawing package. Such plans shall be subject to approval by
the Department of Public Works.

29. Complete working drawings in substantial compliance with
the approved revised plot plan shall be submitted within a one-year
period. These plans shall be approved by the Planning Commission prior
to the zoning becoming effective.
30. The drainage facilities shall meet with the approval of
the Department of Public Works.
31. That the construction of the proposed wall and the re-
quired planting shall be done at the outset of the development or as
soon as possible, to protect the residential properties to the south
and to allow for the maximum growth of the plants.
32. A ten (10) foot high solid wing building wall extension
-
shall separate loading activities from the properties to the south.
33. All market loading areas and ramps shall be roofed over
with sound absorbent materials.
34. The City Planning Commission shall reserve the right, with-
out necessity of further notice of hearing, to make minor modifications
of any of the foregoing conditions, if such modification will achieve
substantially the same results and will in no way be detriment~l ~o
adjacent properties or improvements than will the strict compliance with
said conditions.
SECTION 3. The City Clerk shall certify to the adoption of
this Resolution.
I HEREBY CERTIFY that the foregoing Resolution was adopted at
a regular meeting of the City Council of the City of Arcadia held on the
