HomeMy WebLinkAbout3743 RESOLUTION NO. 3743 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ARCADIA, CALIFORNIA, GRANTING A ZONE VARIANCE TO PERMIT THE REMODELING AND ENLARGEMENT OF A NONCONFORMING' STRUCTURE AT 1415, 1417 AND 1421 SIXTH AVENUE IN SAID CITY. THE CITY COUNCIL OF THE CITY OF ARCADIA, CALIFORNIA, DOES DETERMINE AND RESOLVE AS FOLLOWS: SECTION 1. That there was filed with the City Planning Commission, on October 7, 1964, the application of Vincent and Josephine Gallina, as owners, for a zone variance to permit the re- modeling and enlargement of a nonconforming structure on property located at 1415, 1417 and 1421 South Sixth Avenue in the City o~ Arcadia, County of Los Angeles, State of California, which property is described as follows: The south 92.5 feet of the north 254.20 feet of the easterly 284.92 feet of Lot 57, of Tract No. 808, per map recorded in Book 16, page 82, of Maps in the office of the County Recorder of Los Angeles County. That after due notice as required by the Zoning Ordinance of said City a public hearing was duly held on the matter by and before the City Planning Commission on October 27, 1964, at which time all in- terested persons were given a full opportunity to be heard and to present evidence. That said City Planning Commission thereafter on November 9, 1964, adopted its certain Resolution No. 536 wherein and whereby it recommended the granting of the requested variance. SECTION 2. That subject property is presently zoned R-l but contains four separate dwelling units thereon constructed prior to the applicability o~ the present one dwelling restriction. That it is proposed to entirely remove one dwelling structure and remodel one of the existing dwelling structures. That there are exceptional circumstances applicable to the intended use of the property that apply generally to the property or class of use in the same zone or vicinity, in that though there are other properties -1- 3743 in the vicinity with more than one dwelling unit, the applicant will remove one existing dwelling unit and thus make subject property more closely conform to the use contemplated by the R-l Zone in comparison to other similar properties in the vicinity. That the granting of the variance will not be materially detrimental to the public health or welfare or injurious to the property or improvements in the zone or vicinity in which it is located but rather will be beneficial thereto by reducing the land use density and improving the appearance of an existing dwelling unit. That the granting of a variance is necessary for the preservation and enjoyment of a substantial property right of the applicant possessed by other property in the same zone and vicinity, namely the improvement and better utilization of property resulting from the reduction of the number of dwelling units on the property. That the granting of such variance will not adversely affect the comprehensive general plan but rather will enhance it by more closely conforming' the use of the subject property to that con- templated by the general plan. SECTION~. That for the foregoing reasons a variance is hereby granted. to permit the remodeling and enlargement of a noncon- forming structure on the above described property upon the following conditions: L That the exis ting garage wi th a dwelling uni t above and a shed in back of the front structure shall be removed and a carport shall be constructed for the front dwelling unit. 2. That complete working drawings for all such construc- tion and alteration shall be submitted to the Division of Building and Safety for approvaL -2- 3743 SECTION 4. The City Clerk shall certify to the adoption of this Resolution.
