HomeMy WebLinkAbout3602 " RESOLUTION NO. 3602 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ARCADIA, CALIFORNIA, DENYING A REQUESTED VARIANCE TO ALLOW THE CONSTRUCTION OF SIX ADDITIONAL DWELLING UNITS BEHIND AN EXISTING HOUSE AT 250 OAKHURST LANE IN SAID CITY. THE CITY COUNCIL OF THE CITY OF ARCADIA, CALIFORNIA, DOES HEREBY DETERMINE AND RESOLVE AS FOLLOWS: SECTION 1. That there was filed with the City Planning Commission on April 19, 1963, the application of Helen C. ,Curci, as owner, for a zone variance to permit the construction of six (6) additional dwelling units behind an existing house on real prop- erty located at 250 Oakhurst Lane in the City of Arcadi~described as follows: Lot 7, Tract No. 13487, per map recorded in Book 272, pages 14 and 15, of Maps, records of Los Angeles County. That after due notice as required by the Zoning Ordinance of said City, a publiC hearing was duly held on the matter by and before said City Planning Commission on May 28, 1963, at which time all interested persons were given a full opportunity to be heard and to present evidence. That said City Planning Commission thereafter on June 11, 1963, adopted its certain Resolution No; 477 wherein and whereby it made findings and recommended that the requested variance be denied. SECTION 2. That in 1940 the Arcadia City Council adopted Ordinance No. 636 which granted a variance from the then Zoning Ordinance No. 439 to permit the construction of one or two unit residential bungalows on Lots 6, 7, 8 and 9 of Tract No. 13487, not to exceed eight (8) in number on anyone lot, and to construct a restaurant and cocktail lounge and twelve (12) bungalows on Lot 10 .~~'n.;"..., -1- 3602 ; of said tract. That two (2) residential units were built on Lots 6, 7, 8 and 9, and only eight (8) such units built on Lot 10, the restau- rant and cocktail lounge not having been built. That the former zoning ordinance was repealed in 1949 and all of said lots classi- fied in Zone R-l under the zoning ordinance adopted by Ordinance No. 760. That with the exception of a portion of Lot 10 of said tract located near the corner of Oakhurst Lane and Colorado Boule- vard upon which were constructed eight (8) bungalow type dwelling units, every other lot on Oakhurst Lane is improved with no more than one or two residential units and all of the rest of the area is zoned for and developed with single family dwellings. SECTION 3. That the granting of the requested variance is not necessary for the preservation or enjoyment of a substantial property right of the applicant possessed by other property in the same zone and vicinity inasmuch aS,Lots 6, 7, 8 and 9 were all given the same administrative relief and all have been developed and used in substantially the same ,manner. That there are no ex- ceptional or extraordinary conditions applicable to the property ihv~~ved or to the intended use of the property that do not apply generally to other properties or classes of use in the immediate vicinity and in the same zone. That the granting of the requested variance will adversely affect the comprehensive general plan and will be materially detrimental to the public health and welfare and injurious to properties and improvements in the zone or vicinity in which the property is located, not only by permitting excessive multiple-family development of subject property when only one and two family dwellings exist in the immediate vicinity and only single family dwellings in most of the surrounding area, but particularly for the reason that it would permit increasing at least fourfold the use of subject property which is located upon a private street -2- 3602 " , /tk only twenty (20) feet in width, which is inadequate even for its present usage, is far from adequate for the proposed usage, and would be hopelessly inadequate for ingress and egress by emergency vehicles and equipment. SECTION 4. That for the foregoing reasons the request for a variance to allow the construction of six (6) additional dwelling units behind an existing house at 250 Oakhurst Lane is hereby denied. SECTION 5. The City Clerk shall certify to the adoption of this resolution.
