HomeMy WebLinkAbout3605 RESOLUTION NO. 3605 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ARCADIA, CALIFORNIA, DENYING A REQUESTED VARIANCE TO ALLOW A THREE STORY BUILDING ON PROPERTY LOCATED AT 1102 FAIRVIEW AVENUE IN SAID CITY.' , , THE CITY COUNCIL OF THE CITY OF ARCADIA, CALIFORNIA, DOES HEREBY DETERMINE AND RESOLVE AS FOLLOWS: SECTION 1. That there was filed with the City Planning Commission on April 29, 1963; the application of W~lliam J. Knight, as owner, for a zone variance to permit the const~uction of a third story penthouse above a proposed two-story apartment building on real property located at 1102 Fairview Avenue in the City of Arcadia, County. of Los Ange~e3, described as follows: The nor~herly 150 feet of Lot 53, Tract No. 2731, Map Book 33, Page 29, Records of said County. That after due notice as required by the Zoning Ordinance of said City, a public hearing was dUly held on the matter by and before said City Planning Commission on May 28, 1963, which hearing was duly continued to June 11, 1963, at which times all interested per- sons were given a full opportunity to be heard and to present evi- dence. That said City Planning Commission thereafter on June 25, 1963, adopted its certain Resolution No. 479 wherein and whereby it recommended the denial of the requested variance. SECTION 2. That subject property is in Zone R-3 which allows a maximum height limit of two stories or 35 feet. That there are no exceptional or extraordinary conditions applicable to the property involved or to the intended use of the property that do not apply generally to other properties or classes of use in the immed- iate vicinity and in the same zone. That the granting of the re- quested variance would adversely affect the comprehensive general -1- 3605 plan and would be materially detrimental to the public health and welfare and injurious to properties and improvements in the zone or vicinity in which the property is located. That a study of the de- scribed a~ea indicates that only two story buildings are appropriate now and for the foreseeable future. That to permit one building to be three stories would set an undesirable precedent in this area and accord subject property an advantage not enjoyed by adjacent prop- erties. That the requested variance is not necessary for the preser- vation or enjoyment of a substantial right of applicant possessed by other property in the same zone or vicinity. On the contrary, the City Planning Commission recently granted a modification to allow construction of the proposed apartment building within ten (10) feet of the side property line, thereby increasing the building site on subject property. SECTION 3. That for the foregoing reasons a variance to allow the construction of a third story penthouse above a proposed two story apartment building at 1102 Fairview Avenue is hereby denied. SECTION 4. The City Clerk shall certify to the adoption of this resolution. I HEREBY CERTIFY that the foregoing resolution was adopted at a regular meeting of the City Council of the City of Arcadia held on the 16th day of July , 1963, by the affirmative vote of at least three Councilmen, to wit: AYES: Councilmen Balser, Butterworth and Reibold NOES: None ABSENT: Councilmen SIGNED AND APPROVED this a ATTEST: ~~~ City Clerk (SEAL) 3605
