RESOLUTION NO. 3616
II RESOLUTION OF THE CITY COUNCIL OF
THE CITY OF ARCADIA, CALIFORNIA,
GRANTING A ZONE VARIANCE FOR THE
CONSTRUCTION OF AN EIGHT STORY OFFICE
BUILDING ON THE SOUTHWEST CORNER OF
FIRST AVENUE AND WHEELER STREET IN THE
CITY OF ARCADIA.
THE CITY COUNCIL OF THE CITY OF ARCADIA, CALIFORNIA, DOES
HEREBY DETERMINE AND RESOLVE AS FOLLOWS:
SECTION 1. That pursuant to Section 9291.1 of the Arcadia
Municipal Code the City Planning Commission on its own motion initi-
ated proceedings for the purpose of considering and making recommen-
dations concerning the granting of a variance for the construction of
an eight story office building upon the following described property
in the City of Arcadia, County of Los Angeles, State of California,
to wit:
All of Lots 18, 19 and 20, except the easterly
ten (10) feet thereof, and all of Lot 21, of
Block '74, Arcadia Santa Anita Tract, per map
recorded in Book 15, Page 89, Miscellaneous
Records of said county.
That after due notice as required by the Zoning Ordinance of said
City, a public hearing was duly held on the matter by and before said
City Planning Commission on August 13, 1963, at which time all inter-
ested persons were given a full opportunity to be heard and to present
evidence. That said City Planning Commission thereafter on August 13,
1963, adopted its certain Resolution No. 494 wherein and whereby it
recommended the granting of the requested variance.
SECTION 2. That subject property has three lots fronting
on First Avenue a.nd one lot fronting on Wheeler Avenue, consisting of
160 feet width along First Avenue and 191.69 foot depth along Wheeler
Street with a total area of approximately 30,670 square feet. That
said property is presently located in Zone C-2 which restricts bui1d-
ing height to four (4) stories or forty-five (45) feet in height.

That one parking space for each 500 square feet of building floor
area is required.
SECTION 3. That subject property is the site of the former
Arcadia City Public Library. That upon the construction and occupation
of a new Library building at a different location the City Council
adopted general plans for the improvement by private capital of sub-
ject property and invited and received proposals for the improvement
of subject property in accordance with such plans. That the City has
entered into an agreement for the sale of subject property upon con-
dition that a building no less than 6 stories in height and no more
than 8 stories in height be constructed upon said property, provided
that the same may be lawfully so constructed. That the Town Center
portion of the Central Area Plan under consideration for adoption by
the City envisages a multi-story building in the area of subject prop-
erty as the focal point of the Town Center. Furthermore, the creation
of a height district zone encompassing subject property is now and
for some time has been under study and if adopted would automatically
permit the construction of a building as herein proposed. That the
combination of the foregoing factors constitute exceptional circum-
stances applicable to subject property that do not apply to other
properties in the same vicinity and zone. That the granting of a
variance as hereinafter recommended will not be materially detri-
mental to the public health or welfare or injurious to the property
or improvements in the zone or vicinity in which the property is
located. That inasmuch as the property is in public ownership and
as such is not subject to the restrictions of the zoning ordinance,
it is necessary that a variance be granted so that the structure which
may now be lawfully constructed will not become nonconforming when
title to the property passes into private ownership. That the granting
of a variance as hereinafter recommended will not adversely affect the

comprehensive general plan. That the leasing for parking purposes of
the three city~owned lots adjacent to subject property for parking in
conjunction with the proposed s~ructure, the proximity of subject
property to the public parking lots of Vehicle Parking District No.
2 and the contractual agreement to maintain and improve the city-
owned lots the same as the parking district lots and the assessability
of subject property for both improvement and maintenance of parking
lots and the provision of additional off-street parking spaces warrants
the variance of the off-street parking spaces for the proposed im-
provement of subject property to that number which may be provided on
the city-owned property adjacent thereto.
SECTION 4. That for the foregoing reasons a zone variance
is hereby granted to permit the construction of an eight story office
building upon the above-described property subject to the following
conditions:
a. The variance shall not be operative until complete
working drawings in substantial compliance with approved preliminary
plans, including landscape and irrigation plans prepared by a quali-
fied landscape architect, and grading and drainage plans prepared by
a licensed civil engineer, have been submitted to and approved by the
Planning Commission within one year from the date of City Council
approval of the variance.
b. Water services shall comply with standards of the Uni-
form Plumbing Code and grading and drainage plans shall be submitted
to and approved by the Department of Public Works prior to their sub-
mission to the Planning Commission.
c. The exterior walls of all buildings, other than brick
or natural field materials, shall be of pastel colors and shall comply
with the requirements of buildings and occupancies in Fire Zone No.1.

d. Towers, chimneys, spires, gables, roof structures shall
not exceed a height of fifteen (15) feet above the roof of the bUilding.
e. Signs shall be located as specified in Zone C-2 and
their size and location shall be approved by the Planning Commission.
There shall be no blinking lights or moving parts on such signs.
f. Interior electrical power facility vaults shall be pro-
vided for future underground commercial power installation.
g. Sidewalks shall be installed as required by Section 7212
of the Arcadia Municipal Code in accordance with the plans and speci-
fications prepared by the City Engineer and approved by the City Council.
h. The off-street parking provided on aforesaid property
in accordance with city-approved plans, together with the off-street
parking provided on city-owned property now or hereafter under lease to
applicant, shall be deemed to fulfill the off-street parking require-
ments as to all buildings on subject property the construction of which
is commenced prior to December 31, 1964 and completed prior to Decem-
ber 31, 1965. As to all buildings on subject property the construction
of which is commenced after December 31, 1964 or completed after Decem-
ber 31, 1965, the property owner shall be required to furnish such
additional off-street parking as will be necessary to meet the require-
ments then applicable to such additional buildings and the intended
uses thereof, or to tender to the City of Arcadia a sum determined by
the City as the amount necessary for the City to acquire such additional
off-street parking spaces in the immediate vicinity of subject property
and to improve the same.
i. The Planning Commission or City Council shall reserve
the right, without necessity of further notice or hearing, to make
minor modifications of any of the foregoing conditions, if such modi-
fication will achieve substantially the same results and will be no
more detrimental to adjacent properties or improvements than will the
strict compliance with said conditions.

SECTION 5. The City Clerk shall certify to the adoption of
this resolution.
I HEREBY CERTIFY that the foregoing resolution was adopted
at a regular meeting of the City Council of the City of Arcadia held
on the 17th day of September, 1963, by the affirmative vote of at
least three Councilmen, to wit:
