HomeMy WebLinkAbout3618 u RESOLUTION NO. 3618 A R~SOLUTION OF THE CITY COUNCIL OF THE CITY OF ARCADIA, CALIFORNIA, DECLARING ITS INTENTION TO ORDER CERTAIN LIGHTING FIXTURES AND APPLIANCES ON CERTAIN STREETS AND PUBLIC PLACES IN THE CITY OF ARCADIA, TO BE FURNISHED, INSTALLED AND MAINTAINED AND ELECTRIC CURRENT TO BE FURNISHED FOR LIGHTING SAID FIXTURES FOR A PERIOD OF MONTHS ENDING JANUARY 31, 1966. THE CITY COUNCIL OF THE CITY OF ARCADIA, CALIFORNIA, DOES HEREBY RESOLVE, DECLARE, DETERMINE AND ORDER AS FOLLOWS: SECTION 1. That the public interest and convenience re- quire, and that it is the intention of the City Council of the City of Arcadia to order the certain lighting fixtures and appliances on portions of streets, roads, drives and avenues within said City, all as shown on the diagram entitled "Street Lighting Santa Anita Village Lighting Maintenance District 20" on file in the office of the City Clerk, to be furnished, installed and maintained and electric current to be furnished for lighting said fixtures and appliances for a period of months, beginning and ending in accordance with the report of the City Engineer dated August, 1963, entitled "Preliminary Report of Street Lighting - Santa Anita Village - Street Lighting Act of 1919" and on file in the office of the City Clerk and which is hereby referred to and by this reference incorporated herein and made a part hereof. The period of time for the furnishing of electric current and maintenance for the fixtures and appliances on each street (or right-of-way) stated above shall be set forth in detail in a "NOTICE OF IMPROVEMENT" which said Notice the law requires to be both pub- lished and posted. That all of the work and improvement above specified shall be done in accordance with the specifications and plans therefor re- ferred to in the aforesaid report of the City Engineer dated August, -1- 3618 1963, on file in the office of the City Clerk and which is hereby re- ferred to and by this reference incorporated herein and made a part hereof. SECTION 2. That all monies collected by the tax collector pursuant to the provisions of Section 6 of this Resolution, as soon as said monies have been transferred to the City, shall be placed in a special fund to be known as "Lighting Maintenance District No. 20 Account". Payments shall be made out of said special fund only for the purpose prOvided for in this Resolution. To expedite the making of this improvement, the City Council shall transfer into said special fund, out of any money in the General Fund, such sums as it may deem necessary, and the sums so transferred, excepting the sum mentioned in Section 5 hereof, shall be deemed a loan to such special fund, and shall be repa:ld to the "Abatements Receivable Account" out of the proceeds of the assessments prOVided for in this Resolution. SECTION 3. WHEREAS, said contemplated work and improvement, in the opinion of the City Council, is of more than local or ordinary benefit, said Council hereby makes the expense of said work and im- provements chargeable upon a district, which district said Council hereby declares to be the district benefited by said work and improve- ment, and to be assessed to pay the cost and expense thereof, which said district is that portion of the City of Arcadia as shown on afore- said Diagram on file in the office of the City Clerk, on which map the extent of said assessment district is indicated, and the exterior boundaries thereof' are described by a dashed heavy boundary line, and to which map reference is hereby made for a complete and detailed de- scription of said district, excepting from said district any portion of any publiC street or alley which may be included therein. The said diagram so on file shall govern for all details as to the extent of said assessment district. -2- 3618 SECTION 4. Any lots or parcels of land known as public property, as the same is defined in Section 18014, Part :1, Division 14, Streets and Highways Code, as amended (street Lighting Act of 1919), hereinafter referred to, which are included in the said assess- ment district, shall be omitted and exempt from the assessment to be made to cover the costs and expenses of said contemplated improvement. SECTION 5. That the City shall pay, out of the treasury of said City from the general fund of said City, the full cost of in- stalling four (4) lighting fixtures adjacent to the Hugo Reid School property, 50% of the cost of installing six (6) intersection lights, and 50% of the cost of energy provided for said system. SECTION 6. That the improvement contemplated by this Reso- lution of Intention shall be done under the provisions of the "Street Lighting Act of 1919" (now Part 1 of Division 14 of the Streets and Highways Code of the State of California), as amended, and under the alternative procedure for installment assessments provided for in Chapter 8 of said "Street Lighting Act of 1919." SECTION 7. The City Clerk shall certify to the adoption of this Resolution.
