HomeMy WebLinkAbout3638 RESOLUTION NO. 3638 A RESOLUTION OF THE CITY COUNCIL OF 1~E CITY OF ARCADIA, CALIFORNIA, ORDERING THE FORMATION OF A LIGHTING tllAINTENANCE DISTRICT, DESIGNATED AS "LIGHTING MAINTENANCE DISTRICT NO. ,21", TO PAY THE COSTS AND EXPENSES FOR THE MAINTENANCE AND OPERATION OF A STREET LIGHTING SYSTEM ON PORTIONS OF ALTURA ROAD, CAMPESINA ROAD, VALl DO ROAD, MONTE VISTA ROAD, GOLDEN WEST AVENUE, CORTO ROAD, CABRILLO ROAD, DE ANZA PLACE, CATALPA ROAD, ,VOLANTE DRIVE, MONTE VERDE DRIVE, LA RosA ROAD, PALOMA DRIVE, ENCANTO DRIVE; PANORAMA DRIVE AND COLUMBIA ROAD IN SAID CITY. THE CITY COUNCIL OF THE CITY OF ARCADIA, CALIFORNIA, DOES HEREBY ORDER, FIND AND RESOLVE AS FOLLOWS: SECTION 1. That pursuant to the provisions of Resolution of Intention No. 3631, passed, approved and adopted December 17, 1963, and after a public hearing on the matter in conformance with the provisions of the Municipal Lighting Maintenance District Act of 1927, being D:lvision 14, Part 3, of the Streets and Highways Code of the State of California, it is hereby ordered that a light- ing maintenance district be and the same is hereby formed and that the boundaries of such lighting maintenance district, which district is to pay the cost and expenses for the maintenance and operation of a street lighting system on portions of Altura Road, Campesina Road, Valido Road, Monte Vista Road, Golden West Avenue, Corto Road, Ca- brillo Road, De Anza Place, Catalpa Road, Volante Drive, Monte Verde Drive, La Rosa Road, Paloma Drive, Encanto Drive, Panorama Drive and Columbia Road in said City, over and above the fifty per cent (50%) of the total maintenance and operation costs and expenses thereof to be paid out of the treasury of the City of Arcadia from the general fund of said City, shall be and the same are hereby finally estab- lished in conformance with and shown on that certain map entitled "Diagram of Lighting Maintenance District No. 21", heretofore pre- pared by the City Engineer and approved and adopted by Resolution No. 3630 of the City Council of the City of Arcadia on December 17, 1963 and on file in the office of the City Clerk of said City. That the boundaries of said Lighting Maintenance District No. 21 and the prop- erties included therein are defined, bounded and described as follows: Beginning at the northeasterly corner of Lot 4, Tract No. 11913, per map recorded in Book 258, pages 9 and 10 of Maps, in the office of the Recorder of the County of Los Angeles, said point of beginning being in the southerly line of Colorado Street, 80 feet wide; thence southerly along the easterly boundary of said Tract 'No. 11913, and following the same through its various courses and distances to the northerly line of Volante Drive, 60 feet wide; thence south- easterly in a straight line to the most easterly corner of Lot 59, Tract No. 12411, per map rec~rded in Book 234, pages 39 and 40 of Maps, in the office of said Recorder; thence southwesterly along the southeasterly line of said Lot 59 to the southeasterly corner thereof, said corner being in the northeasterly boundary of Tract No. 12542 as recorded in Book 259, pages 34 and 35 of Maps, in the office of said Recorder; thence southeasterly along'the northeasterly boundary of said Tract No. 12542 to the easterly line of Golden West Avenue, 60 feet wide; thence southerly along the easterly line of Golden West Avenue to the northeasterly corner of Lot 1, Tract No. 13312 as recorded in Book 268, pages 5 and 6 of Maps, in the office of said Recorder; thence southerly along the boundary of said last mentioned tract and following the same through its various courses and distances to the most easterly corner of Lot 15 of said Tract No. 13312; thence southwesterly along the southeasterly line of said Lot 15 and its southwesterly prolongation to the northeasterly line of Lot 20 of said Tract No. 13312; thence southeasterly, southerly, southwesterly and westerly along the boundary of said Lot 20 to the southwesterly corner of said Lot 20; thence northerly along the westerly line of said Lot 20 to the north- westerly corner thereof; thence northwesterly in a straight line to the most easterly corner of Lot 27 of said Tract No. 13312; thence southwesterly along the southeasterly line of Lot 27 of said Tract No. 13312 to the most southerly corner of said last mentioned lot, said point being in a curve in the south- westerly line of said Lot'27; thence northwesterly along the last mentioned curve to its point of tangency with the straight line portion of the westerly line of Said lot; thence northwesterly in a direct line to the southeasterly corner of Lot 65 of said Tract No. 13312; thence westerly along the southerly line of said Lot 65 to the southeasterly corner of Lot 42, Tract No. 13594, as recorded in Book 288, pages 20 and 21 of ' Maps, in the office of said Recorder; thence westerly along the southerly line of said Lot 42 to the easterly line of Corto Road, 60 feet wide; thence southwesterly in a direct line to the south- easterly corner of Lot 39 of said Tract No. 13594; thence westerly along the southerly line of said Lot 39 to a point in the easterly line of Lot 29 of said Tract No. 13594; thence southerly and westerly along the easterly and southerly lines of said Lot 29 to the easterly line of Altura Road, 60 feet wide; thence westerly in a direct line to the southeasterly corner of Lot 7 of said Tract No. 13594; thence westerly in a straight line to the southeasterly corner of Lot 2 of said Tract No. 13594; thence southwesterly along the southerly lines of Lots 2 and 1 of said Tract No. 13594 to the most southerly corner of said last mentioned Lot 1; thence westerly along the southerly line of said last mentioned Lot 1 to the southeasterly line of Columbia Road, 60 feet wide; thence southwesterly along said last mentioned southeasterly line to its inter- section with the easterly prolongation of the southerly line of'Lot 17 of said Tract No. 13594; thence westerly along said prolongation to the westerly' boundary of said Tract No. 13594; thence northerly along the boundary of said last mentioned tract and following the same through its various courses and ' distances to the southwesterly corner of Lot 9, Tract No. 15960, per map re- corded in Book 354, pages 9 and 10 of Maps, in the office of said Recorder; thence northerly along the boundary of said Tract No. 15960 and following the same through its various courses and curves to the northwesterly corner of Lot 12 of said Tract No. 15960, said corner being in the easterly prolongation of the southerly line of Tract No., 15928, per map recorded in Book 356, pages 4 and 5 of Maps, in the office of said Recorder; thence westerly along said prolongation and along the boundary,of said last mentioned tract to the south- westerly corner of Lot 36 of said Tract No. 15928, the westerly line of said last mentioned lot and tract being in the westerly boundary of the City of Arcadia as same existed on October 1, 1963; thence northerly' alo~g said last mentioned boundary to the northwesterly corner of Tract No. 17430, per map re- corded in Book 429, pages 30 and 31 of Maps, in the office of said Recorder; thence easterly along the boundary of said last mentioned tract, and following the same through its various courses and distances to a point in a l~tte parallel with and 160 feet westerly, measured at right angles, from the westerly line of Altura Road, formerly Placiente Road, as shown on map of Tract No. 12900, re- corded in Book 262, pages 47 and 48 of Maps, in the office of saiq Recorder; thence northerly, parallel with said last mentioned westerly line to the south- erly line of Colorado Street, 80 feet wide; thence easterly along said last mentioned southerly line to the point of beginning. SECTION 2. That the items of expense of maintenance and operation of the said lighting system in said District to be fur- nished and to be assessed in part against the lands within the dis- trict (exclusive of improvements) for the first year, commencing January 31, 1964, are the rate charge by the utility company for electric power (Which rate includes the cost of repairs, replace- ments, maintenance, labor and materials) and the cost of publica- tion, posting of notices and engineering costs in the formation of the District. That the estimated amount of electric power neces- sary for said system for each year is one hundred twenty-three thousand, seven hundred eighty-nine (123,789) kilowatt hours and the estimated cost of said electric power for the first year of maintenance and operation is the sum of two thousand, four hundred sixty-two and 40/100 dollars ($2,462.40) and the estimated cost of other items of maintenance and operation for the first year is one thousand, four hundred forty-seven and 45/100 dollars ($1,447.45). That the total e:,timated cost of the first year's maintenance and operation is three thousand, nine hundred nine and 85/100 dollars ($3,909.85). SECTION 3. That the percentage of the total expenses of the aforesaid maintenance and operation to be paid by the afore- said district, as set forth in aforesaid Resolution No. 3631 of the City Council of the City of Arcadia, shall be paid by special assessment taxes levied upon all lands, ,exclusive of improvements, within ~aid district as hereinabove formed and established. SECTION 4. That fifty percent (50%) of the total expenses of maintenance and operationC~f,said district shall be paid out of the treasury of the City of Arcadia from the general fund of said City and the remainder of the total expenses of maintenance of said district shall be paid by said district. SECTION 5. That a certified copy of this resolution shall be filed with the Assessor who makes the assessments for the general city taxes, and thereafter the Assessor in making up the city -3- 3638 assessment roll shall segregate the property included within the district hereby formed on the assessment roll under the district designation contained in the resolution, to wit: "Lighting Main- tenance District No. 21". SECTION 6. The City Clerk shall certify to the adoption of this resolution.
