HomeMy WebLinkAbout3639 RESOLUTION NO. 3639 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ARCADIA, CALIFORNIA, ORDERING THE FORMATION OF A LIGHTING MAINTENANCE DISTRICT, DESIGNATED AS "LIGHTING MAINTENANCE DISTRICT NO. 22", TO PAY THE COSTS AND EXPENSES FOR THE MAINTENANCE AND OPERATION OF A STREET LIGHTING SYSTEM ON PORTIONS OF EL SERENO DRIVE, LEAFWOOD LANE, SHARON ROAD, EL MONTE AVENUE, WINNIE WAY, ANDRBiS ROAD, LA RAMADA AVENUE, PALM DRIVE, PALM CIRCLE, BIRCHCROFT STREET, RODELL PLACE, LA SIERRA DRIVE, ALTERN STREET, TENTH AVENUE AND LINDA WAY IN SAID CITY. THE CITY COUNCIL OF THE CITY OF ARCADIA, CALIFORNIA, DOES HEREBY ORDER, FIND AND RESOLVE AS FOLLOWS: SECTION 1. That pursuant to the provisions of Resolution of Intention No. 3633, passed, approved and adopted December 17, 1963, and after a public hearing on the matter in conformance with the pro- visions of the MW1icipal Lighting Maintenance District Act of 1927, being Division 14, Part 3, of the Streets and Highways Code of the State of California, it is hereby ordered that a lighting maintenance district be and the same is hereby formed and that the boundaries of such lighting maintenance district, which district is to pay the cost and expenses for the maintenance and operation of a street lighting system on portions of El Sereno Drive, Leafwood Lane, Sharon Road, El Monte Avenue, ~Iinnie Way, Andrews Road, La Ramada Avenue, Palm Drive, Palm Circle, Birchcroft Street, Rodell Place, La Sierra Drive, Altern Street, Tenth Avenue and Linda Way in said City, over and above the fifty per cent (50%) of the total maintenance and operation costs and expenses thereof to be paid out of the treasury of the City of Arcadia from the general fund of said City, shall be and the same are hereby finally established in conformance with and shown on that certain map entitled "Diagram of Lighting Maintenance District No. 22", heretofore prepared by the City Engineer and approved and adopted by Resolution No. 3632 of the City Council of the City of Arcadia on De- cember 17, 1963, and on file in the office of the City Clerk of said City. LL CITY OF ARCADIA ,Parcel 22-1 Beginning at the northeast corner of Lot 6, Tract No. 28312, as per map recorded in Book 712, pages 22 and 23 of Maps in the office of the Recorder of Los Angeles County; thence southerly along the boundary of said Tract, and following the same through its various courses and distances to the point of beginning. Parcel 22-2 Beginning at the southeast corner of Lot 4, Tract No. 28438, as per map recorded in Book 712, pages 29 and 30 of Maps in the office of the Recorder of Los Angeles County; thence northerly in a straight line through the northeast corner of Lot 6 of said Tract to the southerly line of Longden Avenue, 60 feet wide, as shown on map of Tract; thence westerly along said southerly line to an intersection with the northerly prolongation of the westerly line of Lot 3 of said Tract; thence southerly along said northerly prolongation and westerly' 'line to the southwest corner of said Lot 3; thence 'easterly in a straight line to the point of beginning. Parcel 22-3 Beginning at the southeast corner of'Lot I, Tract No. 24140, as per map recorded in Book 696, pages 91 and 92 of Maps in the office of the Recorder of Los Angeles County, ,said corner lying in the westerly line of El Monte Avenue, 80 feet wide as shown on map of said Tract; thence northerly along said westerly line of El Monte Avenue to the southeast corner of Lot 42, Tract No. 10928, as per map recorded in Book 191, pages 1 and 2 of Maps in the office of the Recorder of said County; thence northerly, northwesterly and westerly along the boundary of said Lot 42 to the north- west corner of said Lot 42; thence southerly along the westerly line of said Lot 42 to the northeast corner of Lot 38 of said Tract No. 24140; thence westerly along the boundary of said Tract No. 24140, and following the same through its various courses and distances to a point lying 10 feet southerly of the northeast corner of Lot 36 of said Tract'No. 24140, measured along the easterly line of said Lot 36; thence westerly, parallel with the northerly line of said Lot 36 to the westerly line thereof; thence southerly along the boundary of said Tract No. 24140, and following the same through its various,courses and distances to the easterly line of Lot 24 of said Tract No. 10928; thence northerly, westerly and'southerly along the boundary of said Lot 24 to the northeast corner of Lot 21 of said Tract No. 24140; thence westerly along the boundary of last mentioned Tract to the easterly line of Holly Avenue, 60 feet wide, as shown'on map of said Tract No. 24140; thence southerly along said last mentioned easterly line to the westerly prolongation of the southerly line of Lot 19 of said Tract No. 24140; thence easterly along said prolongation to the southwest corner of said Lot 19; thence easterly along the boundary of said Tract No. 24140, and following the same'through its various courses and distances to the point of beginning. Parcel 22-7 Beginning at the northeast corner of Lot 9, Tract No. 27992 as per map recorded in Book 710, pages 23 and 24 of Maps in the office of the Recorder of Los Angeles County; thence southerly along the easterly line of said Tract to the northwest corner of Lot 1 of said Tract; thence southerly along the westerly lines of Lots 1 and 2 of said Tract to the southwest corner of said Lot 2; thence southerly along the easterly lines of Lots 5 and 4 of said Tract to the northeast corner of Lot 3 of said Tract; thence easterly along the easterly prolongation of the northerly line of said Lot 3 to the westerly line of Tenth Avenue, 60 feet wide, as shown on map of said' Tract; thence southerly along said westerly line 181.35 feet; thence westerly. parallel with the northerly line of Lot 89, Tract No. 808, as per map recorded in Book 16. pages 82 and 83 of Maps in the office of the Recorder of said County. to the easterly boundary of said Tract No. 27992; thence southerly along the boundary of said Tract No. 27992. and following the same through its various courses and distances to the point of beginning, Parcel 22-8 Beginning at the northwest corner of Lot I, Tract No. 14257, as per map recorded in Book 407, pages 15 and 16 of Maps in the office of the Recorder of Los' Angeles County; thence southerly along the boundary of said Tract, and following the same through its various courses and distances to the southeast corner of Lot 18 of said Tract; thence westerly along the southerly line of said Lot 18 to the southwest corner LIGHTING MAINTENANCE DISTRICT NO. 22 CITY or ARCADIA (Continued) Parcel 22-8 (Continued) thereof; thence northerly along the westerly line of said Lot 18 to the southeast corner of Lot 17 of said Tract: thence westerly along the southerly lines of Lots 17 and 16 of said Tract to the southwest corner of said Lot 16: thence northerly along the westerly line of said Lot 16 to the northwest corner of said Lot 16; thence westerly in a straight, line to the point of beginning. SECTION 2. That the items of expense of maintenance and operation of the said lighting system in said District to be furnished and to be assessed in part against the lands within the district (ex- clusive of improvements) for the first year, commencing January 31, 1964, are the rate charge by the utility company for electric power (which rate includes the cost of repairs, replacements, maintenance, labor and materials) and the cost of publication; posting of notices and engineering costs in the formation of the District. That the estimated amount of electric power necessary for said system for each year is thirty-three thousand, seven hundred eighty-five and three hundred eight-four thousandths (33,785.3811) ]<ilowatt hours and the estimated cost of said electric power for the first year of main- tenance and operation is the sum of one thousand nine hundred thirty- two and 60/100 dollars (:;;1,932.60) and the es tima ted c os t of other items of maintenance and operation for the first year is six hundred thirty-three and 26/100 dollars ($633.26). That the total estimated cost of the first year's maintenance and operation is two thousand five hundred sixty-five and 86/100 dollars ($2,565.86). SECTION 3. That the percentage of the total expenses of the aforesaid maintenance and operation to be paid by the aforesaid district, as set forth in aforesaid Resolution No. 3633 of the City Council of the City of Arcadia, shall be paid by special assessment taxes levied upon all lands, exclusive of improvements, within said district as hereinabove formed and established. SECTION 4. That fifty per cent (50%) of thetctal expenses of maintenance and. operation of said district shall be paid out of the treasury of the City of Arcadia from the general fund of said City and the remainder of the total expenses of maintenance of said district shall be paid by said district. SECTION 5. That a certified copy of this resolution shall be filed with the Assessor who makes the assessments for the general city taxes, and thereafter the Assessor in making up the city assess- ment roll shall segregate the property included within the district -5- 3639 hereby formed on the assessment roll under the district designation contained in the resolution, to wit: "Lighting ~laintenance District No. 22". SECTION 6. The City Clerk shall certify to the adoption of this resolution.
