HomeMy WebLinkAbout3640 RESOLUTION NO. 3640 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ARCADIA, CALIFORNIA, ORDERING THE FORMATION OF A LIGHTING MAINTENANCE DISTRICT, DESIGNATED AS "LIGHTING MAINTENANCE DISTRICT NO. 23", TO PAY THE COSTS AND EXPENSES FOR THE MAINTENANCE AND OPERATION OF A STREET LIGHTING SYSTEM ON PORTIONS OF HUNTINGTON DRIVE, SANTA CLARA STREET AND FIRST AVENUE IN SAID CITY. THE CITY COUNCIL OF THE CITY OF ARCADIA, CALIFORNIA, DOES HEREBY ORDER, FIND AND RESOLVE AS FOLLOWS: SECTION 1. That pursuant to the proviSions of Resolution of Intention No. 3635, passed, approved and adopted December 17, 1963, and after a public hearing on the matter in conformance with the provisions of the Mun~9ipal Lighting Maintenance District Act of 1927, being Division 14, Part 3, of the Streets and Highways Code of the State of California, it is hereby ordered that a lighting maintenance district be and the same is hereby formed and that the boundaries of such lighting maintenance district, which district is to pay the cost and expenses for the maintenance and operation of a street lighting system on portions of Huntington Drive, Santa Clara Street and First Avenue in said City, over and above the fifty per cent (50%) of the total maintenance and operation costs and expenses thereof to be paid out of the treasury of the City of Arcadia from the general fund of said City, shall be and the same are hereby finally established in conformance with and shown on that certain map entitled "Diagram of Lighting Maintenance District No. 23", heretofore prepared by the City Engineer and approved and adopted by Resolution No. 3634 of the City Council of the City of Arcadia on December 17, 1963, and on file in the office of the City Clerk of said City. That the boundaries of said Lighting Maintenance District No. 23 and the properties included therein are defined, bOWlded and " described as follows: \ -1- 3640 LIGHTING HAINTENANCE DISTRICT NO. 23 CITY OF ARCADIA Parcel 23-1 Beginning at the northwest corner of Lot 1, Tract No. 2731, as per map recorded in Book 33, page 29 of Maps, in the office of the Recorder of Los Angeles County; thence easterly along the northerly line of said lot and its easterly prolongation to an intersection with the southerly prolongation of the straight line portion of the east ,line of Cortez Road, 60 feet wide, as shown on map of Tract No. 14846, recorded in Book 314, pages 8 and 9 of Maps, in the office of said Recorder; thence northerly along said'southerly prolongation and said easterly line to an intersection with the westerly prolongation of the southerly line of Lot 11 of Tract No. 11688, as shown on map recorded in Book 214, pages 15 and 16 of Maps, in the office of said Recorder; thence easterly along said last mentioned prolongation and southerly line and continuing easterly along the easterly prolongation thereof to the southeast corner of Lot 1 of said last mentioned tract; thence easterly in a straight line to the southwest corner of Lot 24 of said last mentioned tract; thence easterly in a straight line to the southwest corner of Lot 5 of Tract No. 12104, as shown on map recorded in Book 226, pages 37, 38 and 39 of Maps, in the office of the Recorder of said County; thence' easterly and northeasterly along the boundary of said last men- tioned tract to an intersection'with a line parallel with and 200 feet westerly, measured at right angles, from the southerly prolongation of the easterly line of Lot 22 of said Tract No. 12104; thence southerly along said parallel line to an intersection with ,a line parallel with and 105 feet northerly of, measured at right angles, from the north line of Huntington Drive. 80 feet wide. as shown on map of said Tract No. 12104; thence easterly along said last'mentioned parallel line 106 feet; thence northerly parallel with said easterly line of Lot 22 a distance of 19.67 feet; thence easterly parallel with said north line of Huntington Drive to an intersection with the southerly prolongation of the easterly line of said Lot 22; thence northeasterly in a straight line to the southwest corner of that parcel of land described in the deed to T. O. Glover, recorded as Instrument No. 580 in Book 30996, page 364, Official Records' in the office of the Recorder of said County; thence easterly along said last mentioned southerly line to an intersection with a line that is parallel with and 140 feet westerly of, measured at right angles, from the east line of Lot 6, Tract No. 949 as per map recorded in Book 17, page 13 of Maps, in the office of the Recorder of said County; thence northerly parallel with said last mentioned east line, 69.22 feet; thence easterly perpendicular to said last mentioned east line to a point thereon; thence southerly along said last mentioned east line to an intersection with a line that is parallel and concentric with and 240 feet northerly and northwesterly, measured at right angles and radially, from the center line of that certain 80 foot strip of land (formerly Huntington Drive) as described in Parcel No.2 of the deed to the City of Arcadia. recorded in Book 9396, page 145 of Official Records, in the office of the Recorder of said County; thence easterly and northeasterly along said last mentioned parallel and concentric line to a line that is parallel with and 240 feet northwesterly, measured at right angles, from that certain course in said last mentioned center line described as having a bearing and length of South 380 33' West 2843.37 feet; thence northeasterly along said last mentioned parallel line to an intersection with the southwesterly line of Colorado Place. 80 feet wide, as shown on map of Tract No. 13154, recorded in Book 264, pages 3 and 4, of Maps, in the office of said Recorder; thence easterly in a straight line ,to a point in a curve concave to the northeast and having a radius of 676.78 feet in the northeasterly line of said Colorado Place, said point lying 444.51 feet northwesterly along said last mentioned curve from the southeasterly end thereof; thence northeasterly in a straight line to the angle point in the southwesterly line of Lot 30 of said last mentioned tract; thence southeasterly and easterly along the boundary of said last mentioned tract to the southwest corner of Lot 26 of said last mentioned tract; thence South 890 22' 59" East along the southerly line of said Lot 26 to the southeast corner of Lot 26 of said last mentioned tract; thence South 60 29' 29" West 127.48 feet; thence South 880 56' 29" East to an intersection with the west line of San Rafael Road, 60 feet wide. as shown on map of said Tract No. 13154; SECTION 2. That the items of expense ,of maintenance and operation of the said lighting system in said District to be furnished and to be assessed in part against the lands within the district (ex- clusive of improvements) for the first year, commencing January 31, 1964, are the rate charge by the utility company for electric power (which rate includes the cost of repairs, replacements, maintenance, labor and materials) and the cost of publication, posting of notices and engineering costs in the formation of the District. That the estimated amount of electric power necessary for said system for each year is two hundred sixty-one thousand, four hundred thirty and five hundred forty-four thousandths (261,430.544) kilowatt hours and the estimated cost of said electric power for the first year of mainten- ance and operation is the sum of thirteen thousand seventy-two and 80/100 dollars ($13,072.80) and the estimated cost of other items of maintenance and operation for the first year is one thousand, seven hundred forty-seven and 28/100 dollars ($1,747.28). That the total estimated cost of the first year's maintenance and operation is fourteen thousand, eight hWldred twenty and 08/100 dollars ($14,820.08) . SECTION 3. That the percentage of the total expenses of the aforesaid maintenance and operation to be paid by the aforesaid district, as set 'forth in aforesaid Resolution No. 3635 of the City Council of the City of Arcadia, shall be paid by special assessment taxes levied upon all lands, exclusive of improvements, within said district as hereinabove formed and established. SECTION 4. That fifty percent (50%) of the total expenses of maintenance and operation of said district shall be paid out of the treasury of the City of Arcadia from the general fund of said City and the remainder of the total expenses of maintenance of said dis- trict shall be paid by said district. SECTION 5. That a certified copy of this resolution shall be filed with the Assessor who makes the assessments for the general city taxes, and thereafter the Assessor in making up the city assess- ment roll shall segregate the property included within the district -6- 3640 hereby formed on the assessment roll under the district designation contained in the resolution, to wit: "Lighting Maintenance District No. 23". SECTION 6. That Lighting Maintenance District No. 18 was formed by Resolution No. 3453 of the Arcadia City COWlcil, adopted January 16, 1962; that all properties included within aforesaid Light- ing Maintenance District No. 18 as described in Section 1 of the afore- said Resolution No. 3453 is included within Lighting Maintenance Dis- trict No. 23 hereinbefore ordered formed. That no further assessments will be levied under aforesaid Lighting Maintenance Distr.ict No. 18. That Resolution No. 3453, adopted January 16, 1962, is hereby ,re- scinded and the City Council hereby directs and requests that all tax code areas heretofore established by the County of Los Angeles solely by reason of aforesaid Lighting Maintenance District No. 18 be abolished and discontinued. SECTION 7. The City Clerk shall certify to the adoption of this resolution.
