HomeMy WebLinkAbout3691 RESOLUTION NO. 3691 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ARCADIA, CALIFORNIA, DENYING A SPECIAL USE PERMIT TO ALLOW THE CONSTRUCTION AND OPERATION OF A DRAG STRIP FOR AUTOMOBILE RACING AND RELATED PURPOSES ON PROPERTY LOCATED IN SAID CITY. WHEREAS, there was filed with the City Planning Commission on January 16, 1964, the application of Soland Corporation as Lessee for a special use permit to allow the construction and operation' of a drag strip for automobile racing and related purposes on property located in the City of Arcadia, County of Los Angeles, State of California, described as follows: That portion of Lot 1 of Tract No. 10369, in the City of Arcadia, County of Los Angeles, State of California, per map recorded in Book 149, pages 95 and 96, of Maps, in the office of the County Recorder of said County, lying westerly and northwesterly of the westerly line of the land described in the Condemnation Action Case No. 574211 Superior Court of said County, a certified copy of the Decree had in said action was . recorded in Book 38373, page 153, Official Records of said County; EXCEPT an undivided 75 per cent of all oil, gas and other hydrocarbon substances in and under said land, with right of ingress and egress necessary for the mining and removal of same, as reserved by Martin Wunderlick, E. Murielle Wunderlick, George P. Leonard and Wilma Leonard, by deed recorded February 4, 1955, as Instrument No. 470, in Book 46821, page 149, Official Records. That after due notice as required by the Zoning Or~inance of said City, a public hearing originally scheduled for February 11, 1964, and duly continued, was held on the matter by and before said City Planning Commission on March 24, 1964, at which time all interested persons were given full opportunity to be heard and to present evi- dence. That said City Planning Commission thereafter on April 14, 1964, adopted its certain Resolution No. 511 wherein and whereby it recommended the denial of the requested special use permit. That within ten (10) days thereafter a written appeal from said decision and recommendation was duly filed by applicant, pursuant to which after notice duly given a public hearing was held before the City -1- 3691 Council of the City of Arcadia on June 3, 1964, which hearing was con- tinued to July 7, 1964, at each of which times all interested persons were given full opportunity to be heard and to present evidence; NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF ARCADIA, CALIFORNIA, DOES DETERMINE AND RESOLVE AS FOLLOWS: SECTION 1. That the site proposed is partially in Arcadia and partially in the City of Irwindale. That the portion of the drag strip proposed in Arcadia is located just north of the intersection of Lower Azusa Road with the Los Angeles County Flood Control Channel. That the entrance to the site is located in Arcadia approximately 650 feet easterly of the intersection of Roseglen Street, Durfee Avenue and Lower Azusa Road. That in the unincorporated territory both to the west and southwest of subject property, there are sub- stantial residentially developed areas adjacent to the subject site. That the granting of the requested special use permit will be ex- tremely detrimental and harmful to the public health or welfare and particularly injuriOUS to such properties and improvements in the Vicinity in which the property is located. That according to the applicant's testimony the racing facility will parallel and be im- mediately adjacent to the proposed County Equestrian Trail. That when the proposed drag strip is in use it will be potentially dangerous to horses and horsemen. That subject property is pres- ently zoned M-2 with a special use permit for the development of natural resources, particularly rock, sand and gravel. That at the time such property was granted such special use permit it was alleged by the owner and found by said City Planning Commission to be true that the material in subject property is prime aggregate in high de- mand and very valuable. That the granting of the special use permit is not necessary to prevent financial hardship to the property owner and if anything the presently proposed use of the property will only tend to postpone the profitable extract~on of the natural resources Contained therein. That there appears to be no exceptional or -2- 3691 - . extraordinary circumstances or conditions applicable to the property involved that do not apply generally to the property or class of use in the same zone. That the granting of the requested special use permit is not necessary for the preservation or enjoyment of a sub- stantial property right possessed by other property in the same zone or vicinity; on the contrary, the denial of the requested special use permit is necessary for the preservation and enjoyment of the sub- stantial property rights of the immediately adjacent residential properties, the peaceful use and enjoyment of their homes. SECTION 2. That for the foregoing reasons the request for a special use permit to allow the construction and operation of a drag strip for automobile racing and related purposes on the above- described property is denied. SECTION 3. The City Clerk shall certify to the adoption of this resolution.
