HomeMy WebLinkAbout3692 RESOLUTION NO. 3692 A HESOLUTION OF THE CITY COUNCIL OF THE CITY OF ARCADIA, CALIFORNIA, DENYING A ZONE VARIANCE TO ALLOW THE CONSTRUCTION OF A 105 DWELLING UNIT PLANNED RESIDENTIAL PARK DEVELOPMENT ON PROPERTY LOCATED AT 82 THROUGH 160 WEST DUARTE ROAD IN SAID CITY. WHEREAS, there was filed with the City Planning Commission on November 29, 1963, the application of the Westman Development Corporation and the Thunderbird Realty Company, as owners, optionees and otherwise, for a zone variance to allow the construction of a 105 dwelling unit planned residential park development on said property and on city-owned property known as 82, 100, 110, 118, 122, 124, 130, 146, 152, 156 and 160 West Duarte Road in the City of Arcadia, County of Los Angeles, state of California, described as follows: The areas bounded by Duarte Road on the north; the west 108 feet of Lot 13 of Tract No. 6074 on the east; the northerly lines of Tracts No. 13856, 13495, 13726 and 13365 on the south; and the northerly prolongation of the westerly line of Tract No. 13365 on the west. That after due notice as required by the Zoning Ordinance of said City, a public hearing was duly held by and before said City Planning Com- mission on December 10, 1963, continued to January 14, 1964 and again continued to January 28, 1964, at which time revised plot plans were submitted, at all of which times all interested parties were given a full opportunity to be heard and to present evidence. That within ten (10) days thereafter a written appeal from said decision and recom- mendation was duly filed by applicants, pursuant to which after notice duly given a public hearing was held before the City Council of the City of Arcadia on May 5, 1964, at which time all interested persons were given full opportunity to be heard and to present evidence; NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF ARCADIA, CALIFORNIA, DOES DETERMINE AND RESOLVE AS FOLLOWS: -1- 3692 SECTION 1. That all of said property is in Zone R-l as are the properties south and west thereof. That the Arcadia Unified High School occupies the property on the north side of Duarte Road from Santa Anita Avenue to El Monte Avenue. That the City Planning Commission has heretofore determined and recommended and this Council concurred that the Duarte Road frontage on the south side of the street between Santa Anita Avenue and El Monte Avenue, if to be used for any purpose other than single-family residential purposes, should be devoted to public and semi-public purposes. That in accord- ance with said determination and recommendation, all of the Duarte Road frontage on the south side of the street between the above- described property and Santa Anita Avenue have already been improved with or are proposed to be improved with a public library, public parking lot, a Masonic Temple and a Church, and further' public need of property in the immediate vicinity is negligible. That although the subject property will not soon develop with one residence per lot, it is adjacent to an area of fine R-O and R-l homes and should be developed in a manner compatible with and beneficial to such area, rather than in a manner detrimental and harmful thereto. That applicants' various proposals for the development of subject prop- erty contemplate too many residential units in relation to land area, too little open area, too many multiple story structures es.- pecially in close proximity to adjacent single-family dwellings, too many dwelling units per building, or poorly planned parking and overall layout, or a combination of some of such factors. That the granting of the requested variance in accordance with any of applicants' proposals would be detrimental to adjacent properties and improvements in the vicinity and contrary to the general plan of the area. That applicants have no legal interest at all in a substantial portion of the subject property and are only optionees as to a large portion of the remainder, and the granting of the -2- 3692 requested variance as to the entire property is obviously unnecessary for the protection or preservation of substantial property rights of the applicants. SECTION 2. That for the foregoing reasons the requested zone variance to allow the construction of a 105 dwelling unit planned residential park development on the above-described property is hereby denied. SECTION 3. The City Clerk shall certify to the adoption of this resolution.
