HomeMy WebLinkAbout3697 ~ ." . . , ,~ . , . " . -< " / RESOLUTION NO. 3697 A RESOLUTION OF THE CITY COUNCIL OF THE CITY. OF ARCADIA, CALIFORNIA, GRANTING A .REQUESTED VARIANCE. TO PERMIT THE FILLI~G OF AN, ABANDONED QRAVEL PIT UPON.SPECIFIED CONDITIONS. THE CITY COUNCIL OF THE CITY OF ARCADIA, CALIFORNIA, DOES HEREBY FIND, DETERMINE AND RESOLVE AS FOLLO\'TS: SECTION 1. That there was filed with the City Planning , Commission the application of Max Goldring for a zone variance to permit the filling of an abandoned gravel pit located on Lots 121 through 155, 184 through 220, 249 through 291 and 315 through 359 of the Chicago Park Tract in the City of Arcadia, County of Los Angeles, State of California. That after due notice as required by the Zoning Ordinance of said City a public hearing was duly held on the matter by and before the City Planning Commission on June 23, 1964, at which time all interested persons were given a full opportunity to be heard and to present evidence. That said City Planning Commission there- after on June 20, 1964, adopted its certain Resolution No. 520 wherein and whereby it recommended the granting of the requested variance. SECTION 2. That subject property, though located in Zones M-l and D, consists for the most part of an abandoned gravel pit, , making subject property totally unfit for any surface use. That in order to be usable for any purpose permitted under its present zoning, the property must be brought up to grade. That the condition of the property constitutes an exceptional circumstance applicable to the property involved that does not apply generally to the property or class of use in the same zone or vicinity. That the granting of the requested variance, under the conditions hereinafter recommended, will not be materially detrimental to the public health or welfare or in- -1- 3697 , . . . ' . . , jurious to the property or improvements in the zone or vicinity in which the property is located. That the granting of the variance to permit the filling of the existing pit is necessary for the preservation and enjoyment of a substantial property right of the applicant possessed by other property in the same zone and vicinity, to wit, the use of the surface of his property. That the granting of such variance will not adversely affect the comprehensive general plan. SECTION 3. That for the foregoing reasons, a variance is hereby granted to permit the filling of an abandoned gravel pit located on property hereinbefore described in Section 1 upon the following conditions: 1. All filling operations shall be conducted to State of California Regional Water Pollution Control Board standards and specifications, and notice of their approval submitted to the City of Arcadia. 2. All fill must be of inert material as described in the regulations of the Water Pollution Control Board standards and specifications. 3. Compaction specifications and programming to the satisfaction of the Public Works Department shall be prepared by a soils engineer or a geologist approved by the City of Arcadia prior to the commencement of filling operations. 4. Site entrance locations shall be approved by the De- partment of Public Works. 5. That the variance shall expire fi~e (5) years after the date of adoption of this resolution by the City Council of the City of Arcadia, and all fill operations shall be completed within said time. -2- 3697 , ~ . , . . . ~ . . ~ .' .. I . .. .. .' ... SECTION 4. The City Clerk shall certify to the adoption of this resolution.
