HomeMy WebLinkAbout3539 RESOLUTION NO. 3539 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ARCADIA DECLARING ITS INTENTION TO IMPROVE ALTUM ROAD AND arHER STREETS BY THE CONSTRUC- TION AND INSTALLATION OF AN ORNAMENTAL STREET LIGHTING SYSTEM IN THE CITY OF ARCADIA; DETERMIN- ING THAT BONDS SHALL BE ISSUED TO REPRESENT THE COST THEREFOR, DECLARING THE WORK TO BE OF MORE THAN LOCAL OR ORDINARY PUBLIC BENEFIT, AND THAT THE EXPENSE THEREOF SHALL BE ASSESSED UPON A DISTRICT (JOB NO. 277) WHEREAS, the City Council of the City of Arcadia, by Resolution No. 3538-- adopted December 4, 1962, set a hearing, pursuant to Section 17 of Article XIII of the Constitution of the State of California, for January 15- , 1963, to determine whether the publiC convenience and necessity require the tmprovement described in said resolution; and NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF ARCADIA DOES RESOLVE AS FOLLOWS: SECTION 1. That the public interest and convenience require, and it is the intention of the City Council of the City of Arcadia to order the following work to be done, to wit, the improvement of: 3539 Catalpa Road between Altura Road and the easterly line of Tract No. 11913, Map Book 52, pp. 47 and 48; Volante Drive between Altura Road and the rortherly prolongation of the southeasterly line of Lot 59, Tract No. 12411, Map Book 234, pp. 39 and 40; Volante Drive between Michillinda Avenue and Altura Road; Monte Verde Drive, Paloma Drive, Ercanto Dr1ve, and Panorama Drive between Michillinda Avenue and Golden West Avenue; La Rosa Road between Michillinda Avenue and Altura Road; De Anza Place between its northerly termination 1n Tract No. 15350, Map Book 354, pp. 9 and 10 and Altura Road; Columbia Road between the westerly prolongation of the 60utherly line of Lot 1, Tract No. 13594, Map Book 288, pp. 20 and 21 and Altura Road; Altura Road between Hugo ,Reid Drive and Colorado Street; Campes1na Road and Valido Road between Volante Drive and Catalpa Road; Monte Vista Road between Paloma Drive and Colorado Street; Corto Boad between Altura Road and the easterly prolongation of the southerly line of Lot 39, Tract No. 13594, Map Book 2P.8, pp. 20 and 21; Cabr11lo Road between its junction with Panorama Drive and the easterly prolongation of the southerly line of Lot 55, Tract No. 133l2, Map Book 25P., pp. 5 and 5; ~ Golden West Avenue between the southwesterly prolongation of the southeasterly line of Lot 15, Tract No. 13312, ~ap Book 25R, pp. 5 and 5 and the easterly prolongation of the northerly line or Lot 1, Tract No. 12542, Map Book 259, PP. 34 and 35; The common intersections 'of Altura Road with Catalpa Road, Volante Drive, Monte Verde Drive, La Rosa Road, Paloma Drive, Encanto Drive, Panorama Drive, Cor to Road, De Anza Place, and Columbia Road; The common intersections of Catalpa Road with Campesina Road, Valido Road and Monte Vista Road; The common intersections of Monte Vista Road with Volante Drive, Monte Verde Drive and Paloma Drive; The common intersections of Golden West Avenue with Monte Verde Drive, Paloma Drive, Encanto Drive, Tallac Drive,and Panorama Drive. The junction of Panorama Drive with Cabrillo Road; The common intersections of IVolante Drive with Campesina Road and Valido Road; 3539 -~ by the in6tallation and placing in operation of an ornamental street,l1ghting system, including the installation of ornamental concrete lighting standards, foundations, luminaires, lamps, cable, conduit, pull boxes, cutouts, cutout boxes, and appurtenant work thereto. That all of the foregoing work shall be done in accordance with the profile and improvement plan, No. K-l-l, and any supplemental drawings mentioned thereon, which said profile and improvement plan was adopted by Resolution No. 3536 ' of the City Council on December 4, 1962, and is on file in the office of the City Engineer of the City of Arcadia, and in accordance with 6pecification entitled Job No. 277 which was adopted by Resolution No. 3536 of the City Council on December 4, 1962. SECTION 2. The estimated cost of this improvement is $10~,~19.6l. That said proposed work or improvement, in the opinion of the City Council of the City of Arcadia, is of more than local or ordinary public benefit, and the Council hereby propo6es that the distr'ict in the City of Arcadia to be benefited by said work or improvement and to be aS6essed to pay the cost and expenses thereof is 6hown on that certain plan or map, No. W-93, indicating the exterior boundary thereof, approved by Resolution No. 3537 of the City Council on December 4, 1962, and on file in the office of the City Engineer. Said plan or map hereby is referred to and shall govern for all details as to the extent of the assessment district. The assessment district ,includes, in general, the lots and parcels of land abutting upon or contiguous to the hereinabove described streets, but reference hereby is made to said plan or map for all details as to the extent of said assessment district and for any variation between the last mentioned general description and the extent of the assessment district as shown on the plan or map. All public streets or alleys, or portions thereof, hereby are excepted from said district. SECTION 3. That serial bonds, bearing interest at the rate of ~ per annum, shall be issued to represent each assessment of -3- 3539 $50.00 or more remaining unpaid for thirty (30) days after the date of the recordation of the warrant. Said 6erial bonds shall extend over a period ending nine (9) years from the second day of January next succeeding the next September 1st following their date. Payments on the principal of unpaid assessments and interest shall be made by property owners to the City Treasurer, and the sums shall be disbursed by him or as provided in the Improvement Act of 1911 hereinafter referred to. SECTION 4. Notice hereby is given that on January 15 , 196:3, at 8:00 jL. m., in the Council Chamber of said City in the City Hall located at 240 West Huntington Drive, Arcadia. California. any and all persons having any objection to the proposed work or improvement, to the extent of the assessment district. or both, may appear before the City Council and show cause why the proposed work or improvement should not be carried out in accordance with this Resolution of Intention. Protests must be in writing. must contain a description of the property sufficient to :ldentify it. and must be delivered to the City Clerk not later than the hour set for hearing. SECTION 5. The Superintendent of Streets immediately shall cause notice of the passage of this Resolution of Intention to be posted conspicuously along the line of the contemplated work or improvement and along all the open streets within said district. in the manner and form prescribed by law. The City Clerk hereby is directed to mail notices. in the manner and form prescribed by law. of the adoption of this resolution to all persons owning real property in the hereinbefore described assessment district. whose names and addresses appear on the last equalized assessment roll for City taxes or as known to the City Clerk. 3539 -4- SECTION 6. The City Council of the City of Arcadia, in making the' improvement and in doing the work prescribed herein, elects to proceed under and in accordance with the provisions of the Improvement Act 01',1911, being Division 7 of the Streets and Highways Code of the state of California. SECTION 7. The City Clerk shall certify to the adoption of this Resolution of Intention and shall cause the same to be published twice in the "Arcadia Tribune," a newspaper published and. circulated in the City of Arcadia, the first of which public- ations shall be not less than ten (IO) days prior to January 15 , 196'3, the date of said hearing, and which hearing shall be not less than fifteen (15), nor more than sixty (60) days after the date of adoption of this resolution. SECTION 8. The City Clerk shall certify to the adoption of this resolution, and thenceforth and thereafter the same shall be in full force and effect.
