HomeMy WebLinkAbout3549 RESOLUTION NO. 3549 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ARCADIA, CALIFORNIA, ORDERING THE FORMATION OF A LIGHTING MAINTENANCE DISTRICT, DESIGNATED AS "I,IGHTING MAINTENANCE DISTRICT NO. 19", TO PAY THE COSTS AND EXPENSES FOR THE MAINTENANCE AND OPERATION OF A STREET LIGHTING SYSTEM ON PORTIONS OF ALTERN STREET, ARTHUR AVENUE, AZURE WAY, DUARTE ROAD, ELLEN WAY, EWELL LANE, FJ:,AMINGO WAY, IVYLAND AVENUE, LELAND WAY, LONGDEN AVENUE, LOUISE AVENUE, MAGNA VISTA AVENUE, PAMELA ROAD, PAXSON LANE, SANTA ANITA TERRACE, TERRA LANE, THIRD AVENUE AND FIRST AVENUE IN SAID CITY. THE CITY COUNCIL OF THE CITY OF ARCADIA, CALIFORNIA, DOES HEREBY ORDER, FIND AND RESOLVE AS FOLLOWS: SECTION I. That pursuant to the provisions of Resolution of Intention No. 3545, passed, approved and adopted December 18, 1962, and after a public hearing on the matter in conformance with the provisions of the Municipal Lighting Maintenance District Act of 1927, being Division 14, Part 3, of the Streets and Highways Code of the State of california, it is hereby ordered that a lighting maintenance district be and the same is hereby formed and that the " boundaries of such lighting maintenance district, which district is to pay the cost and expenses for the maintenance and operation of a street lighting system on portions of Altern Street, Arthur Avenue, Azure Way, Duarte Road, Ellen Way, Ewell Lane, Flamingo Way, Ivylarid Avenue, Leland Way, Longden Avenue, Louise Avenue, Magna Vista Ave- nue, Pamela Road, Paxson Lane, Santa Anita Terrace, Terra Lane, Third Avenue and First Avenue in said City, over and above the fifty percent (50%) of the total maintenance and operation costs and ex- penses thereof to be paid out of the treasury of the City of Arcadia from the general fund of said City, shall be and the same are hereby -l- 3549 finally established in conformance with and shown on that certain map entitled "Diagram of Lighting Maintenance District No. 19", heretofore prepared by the City Engineer and approved and adopted by Resolution No, 3544 of the City Council of the City of Arcadia on December 18, 1962, and on file in the office of the City Clerk of said City. That the boundaries of said Lighting Maintenance District No. 19 and the properties included therein are defined, bounded and described as follows: -2- 3549 Parcel 19-1 Beginning at the northwest corner of Lot 1, Tract No. 26743, per map recorded in Book 680, pages 89 and 90 of Maps~ in the office of the Recorder of Los Angeles County, thence easterly along the boundary of said Tract through its various courses and distances to the point of beginning. Parcel 19-2 Beginning at the northwest corner of Lot 4, Tract No. 26537, per maps recorded in Book 679, pages 69 and 70 of Maps in the office of the Recorder of Los Angeles County, thence easterly along the boundary of said Tract through its various courses and distances to the southeast corner of Lot 8 of said Tract; thence continuing southerly along the easterly line of Lot 14, Tract No. 10994, per map recorded in Book 197, page 47 of Maps, in the office of said Recorder to the North line of LeRoy Avenue, as shown on map of said Tract No. 26537, 60 feet wide; thence westerly along said North line to the inter- section with the southerly prolongation of the westerly line of Lot 1 of above mentioned Tract No" 26537; thence northerly along said southerly prolongation and westerly line to a point 169.91 feet southerly of Magna Vista Avenue, as shown on map of said Tract No. 26537, 60 feet wide measured along the westerly boundary of said Tract No. 26537; thence westerly parallel with said last mentioned Avenue, 100.31 feet; thence northerly parallel with above mentioned westerly line and its northerly prolongation to the center line of said Magna Vista Avenue; thence westerly along said center line, 100.31 feet; thence northerly parallel with the westerly line of Lot 9 of, said Tract No. 26537 and its southerly prolongation to its intersection with the westerly prolonga- tion of the northerly line of said Lot 9; thence easterly along said westerly prolongation, and said northerly line, and the easterly prolongation of said northerly line to the point of beginning. Parcel 19-3 Beginning at the northwest corner of Lot 1, Tract No. 27403, per map recorded in Book 695, Pages 41 and 42 of Maps, in the office of the Recorder of Los Angeles County, thence easterly, along the boundary of said Tract through its various courses and distances of said Tract to the point of beginning. Parcel 19-4 Beginning at the northwest corner of Lot 1, Tract No. 27186, per map recorded in Book 693, pages 92 and 93 of Maps, in the office of the Recorder of Los Angeles County, thence easterly, along the boundary of said Tract through its various courses and distances to the point of beginning. Parcel 19-5 Beginning at the northeast corner of Lot 1, Tract No. 27219, per map recorded in Book 690, pages 11, 12 and 13 of Maps, in the office of the Re- corder of Los Angeles County, thence southerly, along the boundary of said Tract through its various courses and distances to the southeasterly corner of Lot 5 of said Tract; thence westerly in a direct line to the southwesterly corner of Lot 6 of said Tract; thence westerly in a direct line to the south- easterly corner of I~t 8 of said Tract; thence westerly along said boundary through its various courses and distances to the easterly line of Lot 7, Tract No. 8528, per map recorded in Book 131, page 16 of Maps, in the office of said Recorder; thence southerly along said easterly line to the North line of Longden Avenue, as shown on map of said Tract No. 27219, 60 feet wide; thence westerly along said North line to the West line of above mentioned Tract No. 27219; thence continuing northerly along the boundary of said Tract No. 27219 through the various courses and distances to the westerly line of Lot 15, Tract No. 9860, per map recorded in Book 139, page 3 of Maps, in the office of said Recorder; thence northerly along said westerly line to the South line of Las Flores Avenue, as shown on map of said Tract No. 27219, 60 feet wide; thence easterly along said South line to the point of beginning. -3- 3549 Parcel 19-6 Beginning at the southwest corner of Lot 3, Tract No. 27240, per map re- corded in Book 687, page 50 of Maps, in the office of the Recorder of Los Angeles County; thence northerly along the boundary of said Tract through its various courses and distances to the northeast corner of Lot 17, Tract No. 13186, per maps recorded in Book 267, pages 26 and 27 of Maps, in the office of said Recorder; thence southerly along the easterly line of said Lot 17 to the North line of Woodruff Avenue, as shown on map of said Tract No. 27240, 60 feet wide; thence westerly along said North line to the southwest corner of Lot 15 of said Tract No.13186; thence northerly along the westerly line of said Lot 15 to the southerly line of Lot 1 of above mentioned Tract No. 27240; thence westerly along the southerly line of Lots 1 and 3 of said Tract No. 27240 to the point of beginning. Parcel 19-8 Beginning at the northwest corner of Lot I, Tract No. 22199, per map recorded in Book 694, pages 78 and 79 of Maps, in the office of the Recorder of Los Angeles County, thence easterly along the boundary of said Tract through its various courses and distances to the point of beginning. Parcel 19-9 Beginning at the northeast corner of Lot I, Tract No. 26938, per map recorded in Book 681, pages-55 and 56 of'Maps, in the office of the Recorder of Los Angeles County, thence southerly along the boundary of said Tract through its various courses and distances 'to a point in the southerly line of Lot 33, Tract No. 808, per Map recorded in Book 16,pages 82 and 83 of Maps, in the office of said Recorder, said point being 39.54 feet westerly of the southeast corner thereof; thence westerly 60.46 feet along said southerly line; thence ,northerly parallel with the easterly line of ' said Lot 33, 80 feet; thence easterly parallel with the aforementioned southerly line, 4.04 feet; thence northessterly 104.10 feet in a direct line to a point in the easterly line of saId Lot 33, said last mentioned point being distant north- erly, 120.31 feet, measured along said easterly line, from the southeast corner of said Lot 33; thence northerly along said easterly line to the westerly prolongation of the straight line portion of the northerly line of Lot 25 of said Tract No. 26938; thence easterly in a direct line to the point of beginning. -4- 3549 Parcel 19-10 Beginning at the northwest corner of Lot 1, Tract No. 21997, per map recorded in Book 694, page 75 of Maps, in the office of the Recorder of Los Angeles County, thence easterly along the boundary of said Tract through its various courses and distances to the point of beginning. Parcel 19-11 Beginning at the northwest corner of Lot 1, Tract No. 22335, per map recorded in Book 695, pages 71 and 72 of Maps, in the office of the Re- corder of Los Angeles County, thence easterly along the boundary of said Tract through its various courses and distances to a point in the westerly line of Lot 6 of said Tract, said point being 100 feet northerly of the southwest corner of said Lot 6; thence westerly parallel with the center line of Flamingo Way, as shown on Map of said Tract, to the East line of Sixth Avenue, as shown on Map of said Tract, 60 feet wide; thence north- erly along said East line to the point of beginning. -5- 3549 SECTION 2. That the items of expense of maintenance and operation of the said lighting system in said district to be fur- nished and to be assessed in part against the lands within the dis- trict (exclusive of improvements) for the first year, commencing January 31, 1963, are the rate charged by the utility company for electric power (which rate includes the cost of repairs, replace- ments, maintenance, labor and materials) and the cost of publica- tion, posting of notices and engineering costs in the formation of the District. That the estimated amount of electric power neces- sary for said system for each year is forty-five thousand, six hun- I dred thirty-one (45,631) kilowatt hours and the estimated cost of said electric power for the first year of maintenance and operation is the sum of two thousand five hundred ninety-seven and 40/100 dollars ($2,597.40) and the estimated cost of other items of main- tenance and operation for the first year is six hundred ninety-nine and 74/100 dollars ($699.74). That the total estimated cost of the first year's maintenance and operation is three thousand two hundred ninety-seven and'14/100 dollars ($3,297.14) SECTION 3. That the percentage of the total expenses of the aforesaid maintenance and operation to be paid by the afore- said district, as set forth in aforesaid Resolution No. 3545 of the City Council of the City of Arcadia, shall be paid by special assessment taxes levied upon all lands, exclusive of improvements, within said district as hereinabove formed and established. SECTION 4. That fifty percent (50%) of the total expenses of maintenance and operation of said district shall be paid out of the treasury of the City of Arcadia from the general fund of said City and the remainder of the total expenses of maintenance of said district shall be paid by said district. -6- 3549 SECTION 5. That a certified copy of this resolution shall' be filed with the Assessor who makes the assessments for the general city taxes, and thereafter the Assessor in making up the city assess- ment roll shall segregate the property included within the district hereby formed on the assessment roll under the district designation contained in the resolution, to wit: "Lighting Maintenance District No. 19". SECTION 6. The City Clerk shall certify to the adoption of this resolution.
