HomeMy WebLinkAbout3559 RESOLUTION 'NO. 35~ A RESOLUTION OF THE CITY COUNCIL OF TIIE CITY OF ARCADIA, CALIFORNIA, APPROVING REVISED PLANS FOR A CHURCH TO BE CONSTRUCTED AT 110-118 WEST DUARTE ROAD UNDER A VARIANCE HERETOFORE GRANTED FOR SUCH PURPOSES. THE CITY COUNCIL OF THE CITY OF ARCADIA, CALIFORNIA, DOES HEREBY DETERMINE AND RESOLVE AS FOLLOWS: SECTION 1. That on November 27, 1961 there was filed with the City Planning Commission th~, application of the American Lutheran Church of Arcadia by W. F.'Danneman, Pastor, for a zone varianc~ to permit the construction of a church, including Sunday School class-, ' , rooms, kitchen facilities and automobile parking, on property loca- ted at EO anli 118 West Duarte Road in the City of Arcadia, County " of Los Angeles, state of California, described as follows: The West 230.24 feet of the East 300.24 feet of Lot 4, Santa Anita Colony, 'except the South 400 feet thereof, as shown on Map recorded in Book 42, page 87, Miscel- laneous Records of said County; That after due notice as required by the Zoning Ordinance of said City, a public hearing was duly held on said matter by and before said City Planning Commission on December 12, 1961, at ,which time . - ,\:. all interested persons were given a full opportunity to be heard and to present evidence. That at the conclusion of said hearing said City Planning Commission adopted its certain Resolution No. 436, wherein and whereby it recommended the granting of the reques- - ". . - ~ -. - ted variance upon certain specified conditions. - . -' . ~ ., That within ten {10) days thereafter a w~~ ~~eI1 ~ ap.pe_a.~ _ !rom said decision and recom- mendation of said City Planning Commission was duly filed, pursuant to which, after notice duly given, a'public hearing wa~_h~l~ by an~ before the City Council of the City of Arcadia on February 20, 1962, at which time all interested parties were given full opportunity to -1- 355" be heard and to present evidence. That at the conclusion of said hearing this City Council adopted its certain Resolution No. 3475, wherein and whereby it granted the requested variance upon certain specified conditions. That in August of 1962 upon application duly made a six months' extension of said variance was granted. That ,in January of 1963, upon application again duly made, another six months' extension of said variance was granted and is still in effect. SECTION 2. That a plot plan and elevation of the struc- tures proposed to be constructed upon subject property were sub- mitted with the initial application for a variance and said Resolu- tion No. 3475 granting the variance as aforesaid provided in part that the plans be submitted to and approved by the City Planning Commission prior to the issuance of a building permit and substan- tially in compliance with the plans and elevations submitted with the application. That in January of 1963 a revised plot plan and elevation was submitted by applicant. That such revised plot plans and elevations d:Lffered somewhat from those submitted with the original application. That proceedings were instituted and on Febru- ary 13, 1963 a public hearing was after notice duly held by and be- fore the City Planning Commission for the purpose of reviewing and acting upon such revised plot plans and elevations. That said City Planning Commission thereupon adopted its Resolution No. 471 wherein & whereby it recommended the approval of such revised plans. SECTION 3. That no-one protested or objected orally or in writing, to the revised plot plan and elevation. That the re- vised plot plan indicates exactly the same use of subject property as shown in the original application, but at slightly different lo- cations. That the revised plot plan differs from the original in that it proposes a development of contemporary architecture rather than Gothic as originally proposed, and a maximum height of fifty (50) feet overall as contrasted to a tower height of fifty-five (55) feet in the previous proposal. That the revised plot plan -2- 355f and elevation are in the opinion of this Council an improvement over the original plot plans and elevations, will provide for better in- tegration of the facilities in the neighborhood, and provide better use of subject p~operty. SECTION 4. That for the foregoing reasons, the revised plot plan and elevation are hereby approved upon the condition that sub- paragraph f of Section 5 of this City Council's Resolution No. 3475 be amended to read as follows: f. That construction plans be submitted to and be approved by the City Planning Commission prior to the issuance of a building permit therefor, which plans shall be substantially in compliance with the plot plan and elevation submitted by applicant in January of 1963 and hereby approved; and that the variance heretofore granted by said Resolution No. 3475 be and the same is hereby re- approved and affirmed in all other respects. SECTION 5. The City Clerk shall certify to the adoption of this resolution.
