HomeMy WebLinkAbout3570 RESOLUTION NO. 3570 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ARCADIA, CALIFORNIA, DENYING A REQUESTED VARIANCE AND/OR SPECIAL USE PERMIT TO DRILL TWO WATER WELLS, CONSTRUCT BUILDINGS AND WATER TANK AND INSTALL APPURTENANT EQUIPMENT ON 'rHE SOUTH SIDE OF CLARK STREET 400 FEE'r EAST OF PECK ROAD IN SAID CITY. THE CITY COUNCIL OF THE CITY OF ARCADIA, CALIFORNIA, DOES HEREBY DETE~INE AND RESOLVE AS FOLLOWS: SECTION 1. That there was filed with the City Planning Commission on November 15; 1962, the application of the San Gabriel Valley Water Company, as owner, by J,ohn E. Skelton, Vice-President, for a variance an~/or special use permit to drill two water wells; to erect a ground-level, welded steel water storage tank 88 feet in diameter by 40 feet in height; to erect one concrete booster pump building approximately 16 feet by 36 feet and two corrugated metal turbine pump buildings 10 feet by 10 feet; and to install pumps and appurtenant equipment therein; and thereafter to maintain and operate said wells, tank, buildings, pumps and equipment on property in the County of Los Angeles, State of California, described as follows: Lots 1357 through 1361 of Chicago Park Tract as shown on map recorded ~n Book 30, p~g~ 100, of Miscellaneou::l Records in the office of the County Recorder of said County. That after due notice as required by the Zoning O~dinance of said City, a public hear'ing was duly held on the matter by and before said City Planning Commission on December ll, 1962, at which time all inter- ested persons were given a full opportunity to be heard and to pre- sent evidence, at the conclusion of which hearing said Commission adopted its certain Resolution No. 466, wherein and whereby it recom- mended the denial of the requested variance and/or special use permit. -1- 3570 That within ten (10) days thereafter a written appeal from said de- cision and recommendation was duly filed, p~rsuant to which, after notice duly given, a public hearing was held by and before this City Council on February 19, 1963, which hearing was duly continued to March 5, 1963, at which times all interested persons were given full opportunity to be heard and to present evidence. SECTION 2. That subject property consists of five lots, each 25 feet by 133 feet, containing a total area of 16,625 square feet, and is zoned M-l and D, as are all the lots in that area. That subject property is vacant as is much of the property in the area, but several new modern industrial buildings have been constructed in the adjacent area thus zoned and another is in the process of construc- tion. That water Inains and fire hydrants have been installed on Clark Street by the Arcadia Water Department, and the City of Arcadia has ample water and water facilities to completely and adequately serve the area. SECTION 3. That it was not shown that there are excep- tional or extraordinary circumstances applicable to subject property that do not apply generally to the property or class of use in the same zone or vicinity, nor was it shown that a variance is necessary for the preservation of any property right of the applicant possessed by other property in the same zone or vicinity in that industrial development under its present zoning with the present architectural restrictions would be a desirable and profitable use of subject prop- erty. That the development of subject property with sheds and a tall water storage tank would not comply with the applicable archi- tectural overlay and would be detrimental to the present and pro- spective industrial development and would materially deter the fur- ther and proper improvement of the area in which the property is lo- cated. That a variance from the high type of industrial development -2- 3570 planned for the area in which subject property is located, and particu- larly in view of the manner in which applicant proposes to construct and maintain its facilities, would constitute poor planning practice and would adversely affect the comprehensive general plan. SECTION 4. That for the foregoing reasons. the request for a variance and/or special use permit to drill two water wells, con- struct buildings and water' tank and install appu~tenant equipment on the above-described property is hereby deni~d. SECTION 5. The City Clerk shall certify to the adoption of this resolution.
