HomeMy WebLinkAbout3413 ~~--~- r y RESOLUTION NO. 3413 ,A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ARCADIA, CALIFORNIA, GRANTING A ZONE VARIANCE TO PERMIT THE USE OF PROPERTY AT 745 AND 751 NAOMI AVENUE IN SAID CITY AS A PUBLIC AUTOMOBILE PARKING AREA. THE CITY COUNCIL OF THE CITY OF ARCADIA, CALIFORNIA, DOES HEREBY DETERMINE AND RESOLVE AS FOLLOWS: SECTION 1. That there was filed with the City Planning Commission on June 26, 1961, the application of Arcadia Parking, Incorporated, as owner, signed by Marvin T. Launius, Jr., Vice President, for a zone variance to permit the use as a public, auto- mobile parking area of the property at 745 and 751 West Naomi Avenue in the City of Arcadia, County of Los Angeles, ,State of California, described as follows: The easterly 122 feet of the westerly 244.77 feet of Lot 2~ Santa Anita Land Company's Pumping ptant No. 1 Tract, as shown on map recorded in Book 10, page 1$3, of Maps; records of said county, excepting the northerly 20 feet and the southerly 25 feet 'thereof. ~ That after notice as required by the Zoning Ordinance of said City, as amended, a public hearing was duly held on the matter by and before said City Planning Commission July 11, 1961, at which time all interested persons were given full opportunity to be heard and to present evidence. That on August 8, 1961, said City Planning Commission adopted its certain Resolution No. 415, wherein and whereby it recommended the granting of the requested variance upon specified conditions, SECTION 2. That there were no protests, either oral or written, to the granting of the requested variance. That subject property is presently zoned R-2 and the lot at 745 Naomi Avenue could be used for parking without the requested variance under -1- 3413 - ,- T Section 9253.1.7 of the Arcadia Municipal Code. That the property to the east, owned by the applicant and zoned C-2, is used for a parking lot; to the north is a parking lot for a church; across the street to the southeast is the parking lot for a large market; and while the property adjoining on the west is zoned R-2, it is the headquarters for a transfer and storage company under a non- conforming use. That under prior ownership subject property was used as a commercial plant nursery. SECTION 3. That the fact that subject property is sur- rounded by parking lots and R-2 property developed to non-conforming commercial uses constitutes an exceptional circumstance applicable to subject property which does not apply generally to other proper- ties zoned R-2 in the neighborhood, and the requested variance is necessary for the preservation and enjoyment of a substantial prop- erty right possessed by other properties in the same zone and vicinity. That the granting of the requested variance under the conditions hereinafter recommended will not be detrimental to the, public health or welfare, will not be inconsistent with good plan- ning or with the present or prospective development of the neigh- borhood in which the'property is located, but rather will foster the development of the area by providing needed additional parking facilities. SECTION 4. That for the foregoing reasons, a variance is hereby granted to permit the use of the property at 745 and 751 West Naomi Avenue hereinabove described as a public automobile parking area upon the following conditions: a. That a concrete block wall be constructed along the west property line, the front twenty-five (25) feet thereof to be four (4) feet high and the remainder to be six (6) feet high; -2- 3413 . - ~ .. b. That curb, gutter and sidewalk be constructed along the front of subject property and along the 100.9 foot frontage of the lot adjacent on the east, in accordance'with City specifica- tions and to grades approved by the Director of Public Works; c. That the property used for parking be paved; d. That grading plans of subject property be approved by the Department of Public Works; e, That tree planting and landscaping shall be installed and maintained to conform with the landscaping and tree planting now existing on the parking lot adjacent and east of subject prop- erty and owned by applicant; f, That except as hereinbefore expressly provided to the contrary, said property shall be improved and maintained as provided in the Arcadia Municipal Code and'particu1ar1y Section 9284.4 thereof, with respect to public parking areas. SECTION 5, The City Clerk shall certify to the adoption of this resolution.
