RESOLUTION NO. 3426
A RESOLUTION OF THE CITY COUNCIL OF
THE CITY OF ARCADIA, CALIFORNIA,
APPROVING THE MODIFICATION OF FRONT
SETBACK AND YARD REQUIREMENTS FOR
REAL PROPERTY LOCATED AT 920 SOUTH
SECOND AVENUE IN SAID CITY.
THE CITY COUNCIL OF THE CITY OF ARCADIA, CALIFORNIA,
DOES HEREBY DETERMINE AND RESOLVE AS FOLLOWS:
SECTION 1. That petitioner Dr. Clinton M. Baxter on
June 28, 1961, filed an application for a zone variance to allow
the moving of two duplexes onto subject property and their mainte-
nance thereon. That after notice given as required by the Zoning
Ordinance of said City, a public hearing was duly held on the mat-
ter before the Planning Commission on July 11, 1961. That subject
property is located directly across an alley from C-l property and
could be used for a three or four-family dwelling pursuant to Sec-
tion 9253.1.3 of the Arcadia Municipal Code. That at said hearing
all interested persons were given full opportunity to be heard but
that there were no protests, either oral or written, to the grant~
ing of the variance; that at the close of said hearing said Commis-
sion adopted its Resolution No, 414 recommending the granting of
the requested variance, That the time for appeal having elapsed
the City Council of the City of Arcadia on August 1, 1961, adopted
its Resolution No. 3406 granting a variance to permit the placing
and maintenance of two duplexes and garages on subject property,
SECTION 2. That when said duplexes were moved onto the
property at 920 South Second Avenue, it was found that a mistake
had been made in calculating their size in that the eave-overhang
and the bay window projection had not been included in the measure-
ments, and that therefore they could not be placed on the lot in

exact conformity with the plot plans submitted with the request for
a variance; that in order to locate the buildings on the lot with
the least detriment to surrounding property, a modification of the
front setback and side yard requirements would be necessary. That
Dr. Clinton M, Baxter thereupon on August 25, 1961, filed an appli-
cation for a modification of the front yard requirements to permit
the placing of two duplexes 43 feet 6 inches from the present curb,
instead of 46 feet therefrom as required by applicable regulations,
and for modification of applicable side yard requirements to permit
eave-overhang, on property located at 920 South Second Avenue in
said City of Arcadia, County of Los Angeles, State of California,
described as follows:
The southerly 80 feet of the westerly 120.46
feet of Lot 33, Tract No, 808, excepting the
westerly 12 feet thereof, as shown on map
recorded in Book 16 of Maps, pages 82 and 83,
in the office of the County Recorder of said
County;
That after notice as required by the Zoning Ordinance of said City,
a public hearing was duly held on the matter by and before the Modi-
fication Committee on Tuesday, September 5, 1961, at which time said
matter was referred to the Planning Commission for consideration and
decision, That a hearing was held by and before the City Planning
Commission on September 12, 1961. That at each of said hearings
all interested persons were given a full opportunity to be heard
and to present evidence. That on September 26, 1961, said City
Planning Commission adopted its certain Resolution No. 420, wherein
and whereby it approved the requested modification of the front
setback line and side yard requirements to allow the bay window
projection and eave-overhang, That thereafter a written appeal
from said decision was filed with the City Clerk by interested per-
sons pursuant to which a public hearing on the matter was duly held
by and before this Council on October 17) 1961, at which time all
interested persons were given full opportunity to be heard and to
present evidence.

SECTION 3. That although there were many who protested
the granting of the requested modifications at the hearing on Sep-
tember 12, 1961, before the said Planning Commission and at the
hearing held before this Council on October 17, 1961, it was shown
that inasmuch as subject property is located between commercial
zoning and R-l zoning a setback line graduated between that required
for commercial zoning and that required for R-l zoning would not
constitute poor planning, That the requested modification is neces-
sary to prevent unreasonable hardship under the circumstances.
SECTION 4. That for the foregoing reasons, the decision
of the Planning Commission contained in its said Resolution No, 420
is affirmed, the appeal therefrom is hereby denied, and the modifi-
cation of front setback and yard requirements is hereby approved on
the real property located at 920 South Second Avenue in said City
and hereinabove described to permit the bay window projection and
eave-overhang as requested in the application,
SECTION 5. The City Clerk shall certify to the adoption
of this resolution,
I HEREBY CERTIFY that the foregoing resolution was adopted
at a regular meeting of the City Council of the City of Arcadia held
on the 7th
day of November, 1961, by the affirmative vote of at
least three Councilmen, to wit:
