V/Tl RESOLUTION NO. 3429 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ARCADIA,CALIFORNIA, GRANTING A ZONE VARIANCE TO PERMIT THE CONSTRUCTION OF ONE ADDITIONAL DWELLING AT 517 TO 519~ SOUTH THIRD AVENUE IN SAID CITY UPON SPECIFIED CONDITIONS. THE CITY COUNCIL OF THE CITY OF ARCADIA, CALIFORNIA, DOES HEREBY DETERMINE AND RESOLVE AS FOLLOWS: SECTION 1. That there was filed with the City Planning Commission on the lOth day of August, 1961, the application of Ignazio Guardalabene and Hazel M. Guardalabene, as owners, for a zone variance to permit the erection of one additional dwelling unit on property at 517 to 519~ South Third Avenue in said City of Arcadia, County of Los Angeles, State of California, described as follows: Part of Block 60, Santa Anita Tract, as shown on map recorded in Book 34, pages 41 and 42, Miscellaneous Records of said County: Beginning 202.41 feet south from the southwest corner of Eldorado Street and Third Avenue; thence South 87.11 feet; thence West 205 feet; thence North 136.11 feet; thence East 87 feet; thence South 49 feet; thence East 118 feet to the point of beginning, That after notice required by the Zonjng Ordinance of said City, a public hearing was duly held on the matter by and before said Commission on the 12th day of September, 1961, at which time all interested persons were given a full opportunity to be heard and to present evidence. That at the conclusion of said hearing said City Planning Commission adopted its certain Resolution No. 421 wherein and whereby it made certain findings and recommended the denial of the requested variance. That thereafter a public hear- ing on aforesaid application was held by and before the Council -1- 3429 after due notice, at which time all interested persons were given full opportunity to be heard and to present evidence. SECTION 2. That subject property is an L-shaped lot on the west side of Third Avenue between Eldorado Street and Genoa Street with a frontage of 87,11 feet on Third Avenue and an area of 22,120 square feet; that it is zoned R-2 and developed with four living units. That although there is not available the additional 7500 square feet required for either a duplex or two single-family residences, there is proportionately more than enough area for one additional dwelling unit. However, there is no provision in the Zoning Ordinance for the addition of one single-family dwelling on less than the full 7500 square feet required for a duplex or for two single-family residences. That the above constitute excep- tional or extraordinary circumstances applicable to subject prop- erty or to the intended use thereof that do not apply generally to the property or class of use in the same zone or vicinity; that the variance is necessary for the preservation of any property right 9f the applicant possessed by other property in the same zone or vicinity; that the granting of the requested variance will not con- stitute poor planning practice and would not be injurious to prop- erty and improvements in the neighborhood nor to the comprehensive general plan. SECTION 3. That for the foregoing reasons, a variance is hereby granted to on property at 517 allow the construction of one additional dwelling 1 to 51~ South Third Avenue hereinabove described upon the condition that a 12t-foot driveway be constructed to the garages and parking area now existing on the southerly portion of the lot. -2- 3429 - . ~ ~ SECTION 4. The City Clerk shall certify to the adoption of this resolution.
