JOSEPH STREET, SANDRA AVENUE, SANTA ANITA AVENUE, SANTA ANITA TERRACE, SHARON ROAD, SOUTHVIEW ROAD, STANDISH STREET, SYCAMORE AVENUE, WILSON AVENUE, WINNIE WAY, WISTARIA AVENUE, SECOND AVENUE, 'THIRD AVENUE, SIXTH AVENUE, EIGHTH AVENUE AND NINTH ,AVENUE IN SAID CITY. , , THE CITY COUNCIL OF THE CITY OF ARCADIA, CALIFORNIA, DOES HEREBY ORDER, FIND AND RESOLVE AS FOLLOWS: SECTION 1. That pursuant to the provisions of Resolution of Intention No. 3448, passed, approved and adopted December 19, 1961, and after a public hearing on the matter in conformance with the provisions of the Municipal Lighting Maintenance District Act of 1927, being Division 14, Part 3, of the Streets and Highways Code of the State of California, it is hereby ordered that a lighting maintenance district be and the same is hereby formed and that the bo~daries of such lighting maintenance district, which district is to pay the cost and expenses for the maintenance and operation of a street lighting system on portions of Alster Avenue, Alta Oaks -1- 3452 Avenue, Andrews Road, Beverly Drive, Birchcroft Street, Burnell Oaks Lane, Camino Real, Canyon Road, Cielo Place, Danimere Avenue, Doshier Avenue, El Monte Avenue, Encino Avenue, Florence Avenue,(!1loothi~Boulevard, Grandview Avenue, Greenfield Place, Haven Avenue, Highland Fairview Avenue, Avenue, Greenfield Oaks Drive, Hun- . gate Lane, Ivyland Avenue, La Ramada Avenue, Las Flores Avenue, Lee Avenue, Lenta Lane, LeRoy Avenue, Loganrita Avenue, Lorena Avenue, Louise Avenue, Magna Vista Avenue, Magnolia Lane, Monte Place, Newman Avenue, Oakglen Avenue, Palm Drive, Pamela Road, Rosemarie Drive, Rolyn Place, St. Joseph Street, Sandra Avenue, Santa Anita Avenue, Santa Anita Terrace, Sharon Road, Southview Road, Standish Street, Sycamore Avenue, Wilson Avenue, Winnie Way, Wistaria Avenue, Second Avenue, Third Avenue, Sixth Avenue, Eighth Avenue and Ninth Avenue in said City, over and above the fifty per- cent (50%) of the total maintenance and operation costs and expenses thereof to be paid out of the treasury of the City of Arcadia from the general fund of said City, shall be and the same are hereby i finally established in conformance with and shown on that certain map entitled "Diagr8J1l of Lighting Maintenance District No. 17", heretofore prepared by the City Engineer and approved and adopted by Resolution No. 3446 of the City Council of the City of Arcadia on December 19, 1961, and on file in the office of the City Clerk of said City. That the boundaries of said Lighting Maintenance District No. 17 and the properties included therein are defined, bounded and described as follows: -2- 3452 Parcel 17-1, Sheet #2 Beginning at the southwest corner of Lot I, Tract No. 22220 as per map recorded in Book 626, pages 32 and 33, of Maps in the Office of the Recorder of Los Angeles County; thence northerly along the westerly line of said lot to the northwest corner thereof; thence northerly along the northerly pro- longatio~ of said westerly line 20 feet to a point in the northerly line of the alley contiguous to the northerly line of said Lot 1; thence easterly and southerly along said northerly alley line through its various courses and distances to the most easterly north-east corner of Tract No. 24499 as per Map recorded in Book 647, pages 10 and 11 of Maps in the Office of the Recorder of Los Angeles County; thence southerly and westerly along the boundary of said Tract through its various courses and distances to the northeast corner of Lot 27, Tract No. 2731 as per Map recorded in Book 33, page 29, of Maps in the office of said Recorder; thence southerly along the easterly line of Lot 27 of said Tract No. 2731 to the northerly line of Fairview Avenue 60 feet wide; thence westerly along the last mentioned northerly line to a point 70 feet east of the westerly line of Lot 28 of said Tract No. 2731; thence 270.05 feet, more or less, northerly parallel with the westerly line of said Lot 28 to the northerly line thereof; thence northwesterly in a direct line to the southwest corner of Lot 6 of previously mentioned Tract No. 22220; thence northerly along the westerly line of said Lot 6 to the northwest corner thereof; thence easterly along the northerly line of said Lot 6 to an intersection with the southerly prolongation of the westerly line of Lot 1 of said Tract 22220; thence northerly along said prolongation to the point of beginning. That the items of expense of maintenance and operation of the said lighting system in said District to be fur- nished and to be assessed in part against the lands within the dis- trict (exclusive of improvements) for the first year, commencing January 31, 1962, are the rate charged by the utility company for electric power (which rate includes the cost of repairs, replace- ments, maintenance, labor and materials) and the cost of publica- tion, posting of notices and engineering costs in the formation of the District. That the estimated amount of electric power neces- sary for said system for each year is ninety-five thousand, nine hundred thirty-seven (95,937) kilowatt hours and the estimated cost of said electric power for the first year of maintenance and operation is the sum of nine thousand six hundred ninety-four and 80/100 dollars ($9,694.80) and the estimatedcost of other items o~ maintenance and operation for the first year is one thousand four hundred nine and 48/100 dollars ($1,409.48). That the total esti- mated cost of the first year's maintenance and operation is eleven thousand one hundred four and 28/100 'dollars ($11,104.28). SECTION 3. That the percentage of the total expenses of the aforesaid maintenance and operation to be paid by the afore- said district, as set forth in aforesaid Resolution No. 3448 of the City Council of the City of Arcadia, shall be paid by special assessment taxes levied upon all lands, exclusive of improvements, within said district as hereinabove formed and established. SECTION 4. That fifty percent (50%) of the total expenses of maintenance and operation of said di~trict shall.be paid out of the treasury of the City of Arcadia from the general fund of said City and the remainder of the total expenses of maintenance of said district shall be paid by said district. -14- 3452 SECTION 5. That a certified copy of this Resolution shall be filed with the Assessor who makes the assessments for the general city taxes, and thereafter the Assessor in making up the city assess- ment roll shall segregate the property included within the district hereby formed on the assessment roll under the district designation contained in the resolution, to wit: "Lighting Maintenance District No. 17". SECTION 6. That Lighting Maintenance District No. 11 was formed by Resolution No. 2855 of the Arcadia City Council, adopted January 22, 1957; that Lighting Maintenance District No. 13 was formed by Resolution No. 3099 of the Arcadia City Council, adopted January 20, 1959; that Lighting Maintenance District No. 14 was formed by Resolution No. 3210 of the Arcadia City Council, adopted January 19, 1960; that all properties included within aforesaid Lighting Maintenance Districts Nos. 11, 13 and 14, as described in Section 1 of each of aforesaid Resolutions No. 2855, 3099 and 3210, respectively, are included within Lighting Maintenance District No. 17 hereinbefore ordered formed. That no further assessments will be levied under aforesaid Lighting Maintenance Districts Nos. 11, 13, and 14. That Resolutions No. 2855, adopted January 22, 1957; No. 3099 adopted January 20, 1959; and No. 3210, adopted January 19, 1960, are hereby rescinded, and the City Council hereby directs and requests that all tax code areas heretofore established by the County of Los Angeles solely by reason of aforesaid Lighting Main- tenance Districts Nos. 11, 13 and 14, be abolished 'and discontinued. SECTION 7. The City Clerk shall certify to the adoption of this Resolution.
