HomeMy WebLinkAbout3453 RESOLUTION NO. 3453 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ARCADIA, CALIFORNIA, ORDERING THE FORMATION OF A LIGHTING MAINTENANCE DISTRICT, DESIGNATED AS "LIGHTING MAINTENANCE DISTRICT NO. 18", TO PAY THE COSTS AND EXPENSES FOR THE MAINTENANCE AND OPERATION OF A STREET LIGHTING SYSTEM ON PORTIONS OF FIRST AVENUE IN SAID CITY. THE CITY COUNCIL OF THE CITY OF ARCADIA, CALIFORNIA, DOES HEREBY ORDER, FIND AND RESOLVE AS FOLLOWS: SECTION 1. That pursuant to the provisions of Resolution of Intention No. 3449, passed, approved and adopted December 19, 1961, and after a public hearing on the matter in conformance with the provisions of the Municipal Lighting Maintenance District Act of 1927, being Division 14, Part 3, of the Streets and Highways Code of the State of California, it is hereby ordered that a light- ing maintenance district be and the same is hereby formed and that the boundaries of such lighting maintenance district, which district is to pay the cost and expenses for the maintenance and operation of a street lighting system on portions of First Avenue in said City over and above the thirty-six percent (36%) of the total maintenance and operation costs and expenses thereof to be paid out of the treas- ury of the City of Arcadia from the general fund of said City, shall be and the same are hereby finally established in conformance with and shown on that certain map entitled "Diagram of Lighting Main- ~enance Dis~rict No. 18" heretofore prepared by the City Engineer and approved and adopted by Resolution No. 3447 of the City Council of the City of Arcadia on December 19, 1961, and on file in the office of the City Clerk of said City. That the boundaries of said Lighting Maintenance District No. 18 and the properties included therein are defined, bounded and described as follows: -1- 3453 Lighting Maintenance District #18, Sheet #27 Beginning at the northeast corner of Lot 36, Block 64, Santa Anita Tract, as per map recorded in Book 15, pages 89 and 90, of Miscellaneous Records, in the office of the Recorder of Los Angeles County; thence southerly along a line parallel with and distant 175 feet from the center line of First Avenue to the southeast corner of Lot 1, Block 62, Santa Anita Tract, as per map recorded in Book 16, page 58 of Miscellaneous Records, in the office of the Recorder of Los Angeles County; thence southwesterly along the southerly line of said Lot 1 and its southwesterly prolongation to a point in the southerly line of Lot 17, Block 3, Tract No. 101, as per map recorded in Book 13, page 52 of Maps, in the office of the Recorder of Los Angeles County, said point being 81 feet southwesterly of the southeast corner of said Lot 17; thence northerly along a line parallel with the east line of said Lot 17 and its northerly prolongation to a point in the south line of Lot 19, Block 3 of said Tract No. 101; thence westerly 58 feet along the southerly line of said Lot 19 to the southwest corner thereof; thence northerly along the west line of said Lot 19 to the northwest corner there- of; thence northerly on a direct line to the southwest corner of Lot 20, Block 2 of said Tract 101; thence northerly along the west line and its northerly prolongation of said Lot 20 to the northwest corner of Lot 21, Block 2 of said Tract No. 101; thence northerly in a direct line to the southwest corner of Lot 20, Block 1 of said Tract No. 101; thence northerly along the west line and its northerly prolongation of said Lot 20 to the nor'thwest corner of Lot 23, Block l'of said Tract No. 101; thence easterly along the north line of said Lot 23, 50 feet; thence northerly along a line parallel with the west line of Lots 22 and 21, Block 1 of said Tract No. 101 to a point in the north line of said Lot 21, thence northwesterly in a direct line to the southwest corner of Lot 15, Block 68-1/2, Tract No. 866, as per Map recorded in Book 16, pages 198 and 199 of Maps, in the office of the Recorder' of Los'Angeles County; thence northerly along a line parallel with and distant 181.70 feet from the center line of First Avenue to the northwest corner of Lot' 20, Block 67-1/2 of Santa Anita Tract, as per Map 'recorded in Book 15, pages 89 and 90 of Miscellaneous Records'in the 'office 'of the Recorder of Los Angeles County; thence easterly in a direct line to the point of beginning. -2- 3453 SECTION 2. That the items of expense of maintenance and operation of the said lighting system in said District to be fur- nished and to be assessed in part against the lands within the dis- trict (exclusive of improvements) for the first yea~ commencing January 31, 1962, are the rate charged by the utility company for electric power (which rate includes the cost of repairs, replace- ments, maintenance, labor and materials) and the cost of publica- tion, posting of notices, and engineering costs in the formation of the District. That the estimated amount of electric power neces- sary for said system in said District for each year is fifty-three thousand one hundred seventy (53,170) kilowatt hours and the esti- mated cost of said electric power for the first year of maintenance and operation is two thousand one hundred twelve and nO/lOO dollars ($2,112.00) and the estimated cost of other items of maintenance and operation'for the first year is one hundred fifty and nO/lOO dollars ($150;00). That the total estimated cost of the first year's maintenance and operation is two thousand two hundred sixty- two and nO/lOO dollars ($2,262.001. SECTION 3. That the percentage of the total expenses of the aforesaid maintenance and operation to be paid by the aforesaid district, as set forth in aforesaid Resolution No. 3449 of the City Council of the City of Arcadia, shall be paid by special assessment taxes levied upon all lands, exclusive of improvements, within said district as hereinabove formed and established. SECTION 4. That thirty-six percent (36%) of the total expenses of maintenance and operation of said district shall be paid out of the treasury of the City of Arcadia from the general fund of said City and the'remainder of the total expenses of main- tenance of said district shall be paid by said district. , -3- 3453 SECTION 5. That a certified copy of this Resolution shall be filed with the Assessor who makes the assessments for the general city taxes, and thereafter the Assessor in making up the city assess- ment roll shall segregate the property included within the district hereby formed on the assessment roll under the district designation contained in the resolution, to wit: "Lighting Maintenance District No. 18". SECTION 6. That Lighting Maintenance District No. 9 was formed bY,Resolution No. 2853 of the Arcadia City Council, adopted January 15, 1957; that all of the properties included within afore- said Lighting Maintenance District No. 9 as described in Section 1 of aforesaid Resolutio~ No. 2853 are included within Lighting Main- tenance District No. 18 hereinbefore ordered formed. That no fur- ther assessments will be levied under aforesaid Lighting Maintenance District No.9. That Resolution No. 2853, adopted January 15, 1957, is hereby rescinded, and the City Council hereby directs and re- quests that all tax code areas heretofore established by the County of Los Angeles solely by reason of aforesaid Lighting Maintenance District No.9, be abolished and discontinued. SECTION 7. ,The City Clerk shall c~rtify to the adoption of this resolution.
