HomeMy WebLinkAbout3469 RESOLUTION NO. 3469 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ARCADIA, CALIFORNIA, DENYING A REQUESTED VARIANCE TO ALLOW THE USE OF PROPERTY AT 930 AND 950 WEST FOOTHILL BOULEVARD IN SAID CITY FOR THE RESEARCH, DEVELOPMENT, ENGINEERING, FABRICATION, ASSEMBLY AND SERVICING OF ELECTRONIC AND. ELECTRO-MECHANICAL MATERIALS, PRODUCTS AND SYSTEMS. THE CITY COUNCIL OF THE CITY OF ARCADIA, CALIFORNIA, DOES HEREBY DETERMINE AND RESOLVE AS FOLLOWS: SECTION 1. That there was filed with the City Planning Commission on November 1, 1961, the applications of S. V. Hunsaker and Ruth J. HunSaker, and of Mrs. George Morris, as owners, for a zone variance to permit the research, development, engineering, fabrication, assembly and servicing of electronic and electro- mechanical materials, products and systems on prqperty located at 930 and 950 West Foothill Boulevard in the City of Arcadia, County of Los Angeles, State of California, described as follows: A portion of Lots 10, 11 and 12, Los Robles de Santa Anita Tract, as shown on map recorded in Book 33, page 20, of Maps, records of said County, described as follows: Beginning at a point in the south line of Foothill Boulevard (80 feet wide) distant East 162.5 feet from the west line of said Lot 10; thence South along a line parallel with and distant 162.5 feet East from the west line of said lot a distance,of 433 feet, more or less, to the north line of proposed Foothill Freeway; thence West along said north line 812.5 feet, more or less, to the west line of said Lot 12; thence North thereon 445 feet, more or less, to the south line of Foothill Boulevard; thence East thereon 812.5 feet to the point of beginning. That after due notice as required by the Zoning Ordinance of said City, as amended, a publiC hearing was duly held on the matter by and before said City Planning Commission on January 9, 1962, at which time all interested persons were given a full opportunity to -1- 3469 be heard and to present evidence. That on January 23, 1962, said . City Planning Commission adopted its certain Resolution No. 439 wherein and whereby it recommended the denial of the requested variance. SECTION 2. That there were many protests, both oral and written to the granting of the requested variance on the grounds that any industrial use would be incompatible with the present high- class residential development on Foothill Boulevard; that the value of such residential property would decrease; and that once an in- dustrial use were allowed in a portion of the area, it would be difficult to keep it from expanding to the balance thereof. SECTION 3. That subject property is a site with an 812.5 foot frontage on the south side of Foothill Boulevard and a depth of 440 feet to the north line of the proposed Foothill Freeway, con- taining 8.15 acres; that it is zoned R-1; that there are two resi- dences on the easterly portion of subject property and the westerly portion thereof is vac,ant. That all of the lots on the south side of Foothill Boulevard are large lots containing two and one-half to five acres each, and all are zoned R-1; that the property in the neighborhood on the north side of Foothill Boulevard is zoned R-O and developed with fine homes, well above the average in the City. Th~t it has not been shown that there are any exceptional or extra- ord~nary circumstances or cond~tions applicable to subject property that do not apply generally to other property in the same vicinity; nor has it been shown that the requested variance is necessary for the preservation and enjoyment of a substantial property right of the applicants possessed by other property in the same zone and vicinity. -2- 3469 SECTION 4. That the granting of a variance to allow an industrial use in such neighborhood of exceptionally high-class residential property would be materially detrimental to the prop- erty and improvements in the zone and vicinity in which subject property is located. That while the plans and description of the requested use indicate that the building and the business to be conducted therein would be a desirable addition to the City of Ar- cadia, there is ample property in the City presently zoned for in- dustrial use; and the granting of the requested variance would ad- versely affect the comprehensive general plan. That on January 30, 1962, applicants in writing requested that their said application for a zone variance be withdrawn. SECTION 5. That for the foregoing reasons the request for a variance to allow the use of property at 930 and 950 West Foothill Boulevard in the City of Arcadia for the research, ,development, en- gineering, fabrication, assembly and servicing of electronic and electro-mechanical materials, products and systems is hereby denied. SECTION 6. The City Clerk shall certify to the adoption of this resolution.
