HomeMy WebLinkAbout3475 RESOLUTION NO. 3475 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ARCADIA, CALIFORNIA, GRANTING A ZONE VARIANCE UPON CERTAIN SPECIFIED CONDITIONS FOR THE ERECTION OF A CHURCH AND RELATED FACILITIES AT 110 and 118 'WEST DUARTE ROAD IN SAID CITY. THE CITY COUNCIL OF THE CITY OF ARCADIA, CALIFORNIA DOES DETERMINE AND RESOLVE AS FOLLOWS: SECTION 1. That there was filed with the City Planning Commission on November 27, 1961, the application of the American Lutheran Church of Arcadia by W. F. Danneman, Pastor, for a zone variance to permit the erection of a church, including Sunday School classrooms, kitchen facilities and automobile parking, on property located at 110 and 118 West Duarte Road in the City of Arcadia, County of Los Angeles, State of California, described as follows: The West 230.24 feet of the east 300.24 feet of Lot 4, Santa Anita Colony, except the south 400 feet thereof, as shown on map recorded in Book 42, page '87, Miscellaneous Records of said County; That after notice as required by the Zoning Ordinance of said City, a public hearing was duly held on said matter by and before said , I Com~lssion on December 12, 1961, at which time all interested \ ' persons were given a full opportunity to be heard and to present evidence. That at the conclusion of said hearing said City Plan- ning Commission adopted its certain Resolution No. 436, wherein and whereby it recommended the granting of the requested variance upon certain specified conditions. That within ten (10) days thereafter a written appeal from said decision and recommendation of the City Planning Commission was duly filed, pursuant to which, after notice duly given, a pUblic hearing was held by and before this City Council on February 20, 1962, at which time all interested parties were given full opportunity to be heard and to present evidence. -1- 3475 SECTION 2. That there were oral protests to the granting of the variance on the grounds of possible detriment to the residential property at the rear arising from the drainage of subject property, the height of the proposed building, increased traffic in the area resulting from the proposed use of the pro- perty, and on the ground that the granting of the requested variance would in fact constitute spot zoning. SECTION 3. That subject property is 230 feet wide, 319 feet deep, contains approximately 1.68 acres and comprises two lots which are too large for residential purposes. That the property across the street is owned by the Arcadia Unified School District and is developed with the Arcadia High School Buildings and an athletic field. That on the east subject property adjoins property recently purchased by ~he City as a site for a possible future auditorium. To the west of subject property are five large lots. That because of the depth of the lots in this area, much of which is deteriorating, the properties can better be deve- loped for public or semi-public use than for any residential use. That the requested variance is necessary for the preservation and enjoyment of a substantial property right of the applicant pos- sessed by other property in the same zone and vicinity. SECTION 4. That a previous request of applicant for a variance for the construction of a church on properties just west of subject property was denied because of the proposed location; that subject property would better serve the needs of a church site; that the nature of church activities constitutes an excep- tional or extraordinary circumstance applicable to the intended use of the property which does not apply generally to property in the vicinity. That under certain conditions the granting of the variance requested will not be detrimental to public health or -2- 3475 .. welfare and,wil1 not adversely affect the comprehensive general plan. That the church will be compatible with the school and city use and will not be harmful or detrimental to the residential pro- perty to the west or to the south. SECTION 5. That for the foregoing reasons, aforesaid appeal from the decision and recommendation of the Planning Com- mission is denied and a variance is hereby granted to permit the use of the above-described property for the erection of a church and related facilities upon the following conditions: a. That 12 feet be dedicated for the widening of Duarte Road. b. That all existing structures be removed from the site. c. That the driveways and parking lot be paved and a 6- foot masonry wall separating the driveway and parking area from ad- jacent residential property be constructed. d. That drainage from the parking area be provided to the satisfaction of the Director of Public Works. e. That a suitable landscaped strip and tree planting along the south property line be provided. f. That the plans be submitted to and be approved by the Planning Commission prior to the issuance of a building permit and shall be substantially in compliance with the plans and elevations submitted with the application. SECTION 6. The City Clerk shall certify to the adoption of this resolution. I HEREBY CERTIFY that the foregoing resolution was adopted at a regular meeting of the City Council of the City of Arcadia held on the 20th day of February, 1962, by the affirmative vote of at least three Councilmen, to wit: -3- 3475 ..
