HomeMy WebLinkAbout3494 ... RESOLUTION NO. 3494 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ARCADIA, CALIFORNIA, DENYING A REQUESTED VARIANCE FOR A SECOND DWELLING AT 931 SOUTH EIGHTH AVENUE. THE CITY COUNCIL OF THE CITY OF ARCADIA, CALIFORNIA, DOES HEREBY DETERMINE AND RESOLVE AS FOLLOWS: SECTION 1. That there was filed with the City Planning Commission on March 12, 1962, the application of Saeed E. Murad and Gloria H. B. Murad, as owners, for a zone variance to allow a second dwelling on property located at 931 South Eighth Avenue in the City of Arcadia, County of Los Angeles, State of California, described as follows: The south 87.5 feet of Lot 68, Tract No. 808, as shown on map recorded in Book 16, pages 82 and 83, of Maps, records of said county; that after due n~tice as required by the Zoning Ordinance of said City, as amended, a publiC hearing was duly held on the matter by and before said City Planning Commission on March 27, 1962, which hearing was duly continued to April 10, 1962, at each of which times all interested persons were given a full opportunity to be heard and to present evidence. That on April 10, 1962, said City Planning Commission adopted its certain Resolution No. 444 wherein and whereby it recommended the granting of the requested variance. TOat pursuant to Section 9291.2.8 of the Arcadia Municipal Code a written appeal from said decision of the, City Planning Commis- sion was duly filed with the City Council by persons aggrieved thereby, pursuant to which a public hearing on s,aid matter was held by and before the City Council on June 6, 1962, at which time all interested persons were given full opportunity to be heard and to present evidence. -1- 3494 SECTION 2. That there were protests, both oral and written to the granting of the variance. That although it is pos- sible to place the second house on subject property, there are other large properties in the immediate vicinity, and elsewhere throughout ,the City that do not enjoy the extra dwelling privileges. That subject property has not been maintained in accordance with the standards of the neighborhood. That applicants' claimed neces- sity for the variance is not supported but rather controverted by the facts set forth in the record of the within proceedings, and it has not been shown that the variance is necessary for the preser- vation of any property right of the applicant possessed by other property in the same zone or vicinity. That the granting of the requested variance from the zoning requirements would under the cir- cumstances be injurious to property and improvements 'in the vicinity. SECTION 3. That for the foregoing reasons the recommen- dation of the City Planning Commission contained in its Resolution No. 444 is hereby disapproved, the appeal from said recommendation is hereby sustained, and the request for a variance to allow a second house on subject property at 931 South Eighth Avenue in the City of Arcadia is hereby denied. SECTION 4. The City Clerk shall certify to the adoption of this resolution. I HEREBY CERTIFY that the foregoing resolution was adopted at a regular meeting of the City Council of the City of Arcadia held on the 19th day of June , 1962, by the affirmative vote of at least three Councilmen, to wit: -2- 3494 AYES: NOES: - Councilmen Balser, Phillips, Turner and Butterworth Councilman Reibold ,ABSENT: None , .
