RESOLUTION NO. 3308 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ARCADIA, CALIFORNIA, INSTITUTING PROCEEDINGS FOR, SETTING A PUBLIC HEARING CONCERNING AND GIVING. NOTICE. OF THE TIME AND PLACE OF SUCH PUBLIC HEARING CONCERNING THE PROPOSED ANNEXATION TO THE CITY. OF ARCADIA OF CERTAIN TERRITORY .. ADJACENT AND CONTIGUOUS TO,THE PRESENT CITY LIMITS OF SAID,CITY, SAID TERRITORY BEING SITUATED NEAR THE SOUTHEASTERLY, PORTION OF THE CITY OF ARCADIA AND DESIGNATED AS "ANNEXATION NO. 20, SOUTHEAST ARCADIA (UNINHABITED). THE.CITY COUNCIL OF THE CITY OF ARCADIA, CALIFORNIA, DOES HEREBY DETERMINE AND RESOLVE AS FOLLOWS: SECTION l. That pursuant to the "Annexation of Uninhab- ited Territory Act of 1939", ~samended, ~~e City Council of the " City of Arcadia; on its own motion, does, hereby initiate proceed- ings for the annexation to the City of Arcadia of 'certain uninhab- . . . itedterritory ~ontiguousand adjacent to the citY'l1inits of'the City of Arcadia and situated near the southeasterly portion of the City o.f Arcadia as more particularly described' in Section 5 herein- after. SECTION 2. That the City Council of the City of Arcadia desires to annex such uninhabited territory to promote and insure the proper integration of said territory with the contiguous area already within ,the limits of the_City of Arcadia, and to comply with the stated desires of many owners of property in such area. SECTION 3. That the proposal for the annexation of said territory to the City of Arcadia has been submitted to and favorably reported. upon to the proponents by the '.BoundaryCommission of the County of Los Angeles as required by Section 35002 of the Government Code of the State of California. -1- 3308 . '. . .. . ... .. . . SECTION 4. That the said territory is uninhabited, is contiguous to the City of Arcadi~, and is not apart of any other municipal corporation. SECTION 5. That pursuant to the "Annexation of Uninhab- ited Territory Act of 1939," as amended, the City Council of the City of Arcadia does hereby give notice of said proposed annexa- tion; that ~aid territory is hereby designated as "Annexation.No.. 20, Southeast Arcadia (Uninha~ited)" and is particularly described and bounded as follows: -2- 3308 . .. . t! ~ - - "ANNEXATION NO. 20, SOUTHEAST ARCADIA (UNINHABITED)" TO THE CITY OF ARCADIA Beginning at a,point in the bounqary of the City of Ar- cadia, as same existed on July 1, 1960, (along the northwesterly line o~ Peck Road), said point being the point of intersection of said boundary with the northwesterly prolongation of the north- easterly line of Dearborn Street, 50 feet wide as shown on map of Chicago Park, recorded in Book 30, page 100 of Miscellaneous Rec- ords, in the office of the Los Angeles County Recorder; thence southwesterly 975.40 feet more or less, along said boundary and northwesterly line of Peck Road to a point of intersection with the northwesterly prolongation of the southwesterly line of vacated Randolph Street, 25 feet wide, said southwesterly line being along the northeasterly lines of Lots 1 and 7 of the Coffin and Armstrong Tract as per map recorded in Book 2, p.age 39 of Maps in the offic e of the Los Angeles County Recorder; thence southeasterly along the last mentioned prolongation and southwesterly line to the north- westerly line of Cogswell Road, 50 feet wide, as per map of Tract No. 13286 recorded in Book 268, pages 29 to 32 of Maps in the office of the Los Angeles County Recorder; thence northeasterly along the northwesterly line of said Cogswell Road to a point of intersection with the southwesterly line of Clark Street, 50 feet wide as shown on said map of Chicago Park; thence southeasterly 'along the south- westerly line of said Clark Street to a point of intersection with the existing boundary of said City of Arcadia; thence northeasterly and northwesterly along said boundary to the point of beginning. -3- 3308 . -. . '"' - . ~ SECTION 6. That the City of Arcadia hereby,'gives notice of and fixes November 30, 1960, at the hour of 9:00 o'clock p.m., in the Council Chamber of the Arcadia City Hall, 240 West Huntin~ton Drive, Arcadia, California, as the day, hour and place when and where the City Council of the City of Arcadia will hear protests made by any person owning real property within the territory above described. At any time before the hour set for hearing object~ons, any owner (as defined by Section 35312 of the California Government Code) of property within the above-described territory may file written protest against the annexation. The protest shall state the name of the owner of the property affected and the description and area of the property in general terms. SECTION 7. Notice is further given that at said place and at 7:30 o'clock p.m. on said date and prior to said hearing on said annexation, the City Council will consider the recommendation of the City Planning Commission for interim emergency zoning to be adopted, concurrent with such annexation, classifying said territory under the zoning regulations of the City of Arcadia. SECTION 8. The City Clerk of the City of Arcadia shall cer- tify to the adoption of this resolution, and shall cause a copy hereof to be published at least twice, but not oftener than once a week, in the Arcadia Tribune and Arcadia News, a newspaper of general circula- tion published in the City of Arcadia, and also in a newspaper of ' general circulation published outside of the City of Arcaaia but in the county of Los Angeles, said publication to be complete at least twenty (20) days prior to the date set for the hearing aforesaid; and the City Clerk shall also cause written notice of such proposed annexa- tion to be mailed to each person to whom land within the territory proposed to be annexed, is assessed in the last equalized county as- sessment roll available on the date the proceedings were initiated, at the address shown on said assessment roll or as known to said City -~ 3308 -----.'- r -. . .. .. - " . . Clerk, and to any person who has filed ~is name and address and the design~tion of the land in which he has any interest, either legal or equitable, with said City Clerk. In the event any land within the above-described territory is owned by a county, the City Clerk shall also cause written notice of such proposed annexation to be mailed to the Board of Supervis6rs of such county. The written notice by mail shall. be given not less than twenty (20) days before the first public hearing' on said proposed annexation. I HEREBY CERTIFY that the foregoing resolution was adopted at a regular meeting of the City Council of the City of Arcadia, held on the 4th day of October, 1960, by the affirmative vote of at least three Councilmen, to wit: AYES: Councilmen Balser, Phillips, Reibold and Camphouse NOES: None ABSENT: Councilman Butterworth ~~?;an~ City Clerk of the City of Arcadia.
