HomeMy WebLinkAbout3317 . . ?I ,RESOLUTION NO. 3317 A,.RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ARCADIA, CALIFORNIA, GRANTING A ZONE VARIANCE TO ALLOW THE CONSTRUCTION OF A CUSTOMER SJ:;RVICE BUILDING AND ANNEX AT THE REAR OF PROPERTY LOCATED AT 1429 SOUTH BALDWIN AVENUE. THE CITY COUNCIL OF THE CITY OF ARCADIA, CALIFORNIA, DOES HEREBY DETERMINE AND RESOLVE AS FOLLOWS: SECTION 1. That there was filed with the City Planning Commission on the 26th day of July, 1960, the application of Elrovia Corporation and Hinshaw's Department Store, signed by Edwin U. Caron, Secretary of Hinshaw's Department Stores, Inc., as lessees, for a zone variance to allow the construction of a customer service build- lng and annex at the rear of property located at 1429 South Baldwin Avenue in the City of Arcadia, County of Los Angeles, State of Cali- fornia, described as follows: The East 263 feet of the west 363 feet' of the ' North 123.9 feet of Lot 8, Block A, Santa Anita Land Company's Tract, as shown on map recorded in. Book 6, page 137, of Maps, records of said County. . 760 That after .notice as required by Ordinance No. of said City, as - amended, a public hearing was duly held on the matter by and before said City Planning Commission on September 13, 1960, which hearing was duly continued to September 27, 1960, at each of which times all interested persons were given a full opportunity to be heard and to present evidence. That on August 23, 1960, said City Planning Com- mission adopted its certain Resolution No. 386, wherein and whereby it recommended the granting of the requested variance. That within the time specified by Ordinance No. 760 of the City of Arcadia and by Article IX, Chapter 2 of the Arcadia Municipal Code, an appeal in wr;tting was filed with this Council protesting the recommendation of the City Planning Commission set forth in its said Resolution No. 386, -1- 3317 . ~ . pursuant to which after notice duly given, a public hearing on the matter of aforesaid application for a variance and the City Planning Commission's recommendation relative thereto contained in its said Resolution No. 386, was dUly held by and before this Council on November 15, 1960, at which time all interested persons were again given full opportunity to be heard and to present evidel.ce. SECTION 2. That although there were oral and written pro- tests to the granting of the requested variance, there were also those who spoke in favor of it; that the protests were based princi- pally on possible detriment to surrounding residential property. SECTION 3. That subject property is a lot approximately 123 feet wide and 600 feet long, with the front portion zoned C-2 and developed for commercial uses and parking. That while the rear 263 feet of the property is zoned R-3, it is paved and used for parking at the present time and its development for R-3 uses with commercial buildings in front and no other access to streets is not desirable. SECTION 4. That the size, shape and location of the prop- erty constitute exceptional circumstances not usually applicable to property in the same zone, and the requested variance is necessary for the preservation and enjoyment of substantial property rights possessed by other property in the same zone and vicinity. That upon certain conditions hereinafter specified, the granting of the variance will not be detrimental to the public health or welfare, will not be inconsistent with good planning practice and the present or prospec- tive development of the neighborhood in which the property is located. SECTION 5. That for the foregoing reasons, a variance is hereby granted to permit the construction of a customer service build- ing and annex at the rear of property located at 1429 South Baldwin Avenue upon the following conditions: a. That the building be constructed substantially in ac- cordance with the plan submitted and at the location shown on the -2- 3317 ~- ~ . . plot plan. b. That no openings be permitted in the north, west and south walls of the building. c. That an ornamental concrete block wall; 6 feet high, be constructed at or adjacent to the north,west and south property lines. d. That a six-foot high chain link fence with gates be erected and maintained along. the east line of the property from the east ends of the wall required by the preceding subsection to the northeasterly and southeasterly corners of the building. e. That the building be used only for the purposes set out in the application. f. That the deliverY' of goods by vendors or common carriers to the building be limited to not earlier-than 8:00 o'clock a.m. and not later than 8:00 o'c:).ock p.m. SECTION 6. The City Clerk shall certify to the. adoption of this Resolution. I HEREBY CERTIFY that the foregoing resolution was adopted at a regular meeting of the City Council of the City of Arcadia, on the 15th day of November, 1960, by the affirmative vote of at least three Councilmen, to wit: AYES: Councilmen Balser, Butterworth, Phillips, Reibold and Camphouse NOES: None " ABSENT: None ~~_~>/1A_h'~ City Clerk of the City of Arcadia SIGNED AND APPROVED this 15th day of November, 1960.
