RESOLUTION NO. 3319
A RESOLUTION OF THE CITY COUNCIL OF
THE CITY OF ARCADIA, CALIFORNIA,
GRANTING A ZONE VARIANCE TO PERMIT
STRUCTURAL ALTERATIONS AND ADDITIONS
TO PROPERTIES ABUTTING THE NORTH SIDE
OF HUNTINGTON DRIVE BETWEEN SANTA
ANITA AND FIRST AVENUES IN SAID CITY
UNDER SPECIFIED CONDITIONS.
THE CITY COUNCIL OF THE CITY OF ARCADIA, CALIFORNIA,
DOES HEREBY DETERMINE AND RESOLVE AS FOLLOWS:
SECTION 1. That portions of the business district of the
City of Arcadia were developed and improved prior to the enactment
of the zoning regulations applicable to said properties. That the
strict application of such zoning regulations to properties that
were improved prior to the enactment thereof have tended to retard
rather than promote the.further development of said properties and
have hindered rather than encouraged their fullest, best and highest
use. That, because of the foregoing the Planning Commission did,
at the request of this Council, initiate proceedings pursuant to
Resolution No. 372 for the purpose of considering and making recom-
mendations concerning the amendment of Ordinance No. 760 of said
City by amending Sections 15 and 16 thereof and any other pertinent
sections so as to permit structural alterations of and additions to
nonconforming buildings under specified conditions and to permit
the Modification Committee to grant minor modifications of the
parking reqUirements applicable thereto, pursuant to which a publiC
hearing thereon was duly held by and before this Commission on
April 26, 1960, which hearing was from time to time duly continUed
to September 27, 1960, at each of which hearings all interested
persons were given full opportunity to be heard and to present
evidence.

SECTION 2. That the City Planning Commission thereupon
determined that although problems exist in portions of the City
resulting in large part from the application of regulations con-
cerning yard requirements, off-street parking and parking access,
many of which were enacted subsequent to the construction of build~
ings in such portions of the City, such regulations for the most
part constitute good zoning practice and their amendment to pro-
vide relief for specific portions of the City will undermine the
entire regulatory structure with respect to the balance of the
City. That the problem areas can better be dealt with by the
granting of variances for the respective areas rather than by the
amendment of the regulations themselves, and the City Planning
Commission therefore recommended that no amendments to Ordinance
No. 760 be made as a result of the proceedings instituted by said
Commission under and pursuant to its said Resolution No. 372, and
that the proceedings instituted by said Commission by its said Res-
olution No. 372 be terminated. That thereupon this Council by its
Resolution No. 3312 did terminate the proceedings instituted by
the City Planning Commission by its Resolution No. 372.
SECTION 3. That the present parking requirements and
restrictions as to setbacks, alleys and parking lot access have so
restricted the enlargement, alteration and modernization of existing
bUildings and retarded the construction of new buildings on Lots 1
to l7, inclusive, Block 74, Santa Anita Tract, per map recorded in
Book 15, pages 89 and 90, of Miscellaneous Records of Los Angeles
County, situated on the north side of Huntington Drive between Santa
Anita Avenue and First Avenue, as to preclude the full or proper
utili~ation of said properties and of the off-street parking facil-
ities heretofore provided in connection therewith. That the majority
of the existing buildings on said lots were constructed thereon be-
fore the regulations presently in effect were established; that the

strict adherence to all regulations presently applicable to afore-
said properties will further retard rather than foster the modern-
ization of the existing structures and the fullest and best use of
the above described properties, and will not best accomplish the
aims and purposes of the overall purpose of aforesaid regulations.
SECTION 4. That because of such practical difficulties,
unnecessary hardships, and results inconsistent with the general
provisions of Ordinance No. 760 of the City of Arcadia, as amended,
said Ordinance No. 760, as amended, now being contained in Chapter
2 of Article IX of the Arcadia Municipal Code, the City Planning
Commission did, on its own motion, initiate proceedings for the pur-
pose of considering and making recommendations concerning the grant-
ing of a variance from the setback, alley, parking and parking lot
access regulations applicable to the property. described in Section
3 hereof, pursuant to which a public hearing was duly held by and
before said Commission on November 9, 1960, at which time all inter-
ested persons were given full opportunity to be heard and to present
evidence.
SECTION 5. That the facts found to be true in Sections
1 and 3 hereof constitute exceptional or extraordinary circumstances
or conditions applicable to the property or class of use in the
same zone or vicinity; that the granting of a variance as herein-
after recommended will not be materially detrimental to the public
health or welfare or injurious to the property or improvements in
such zone or vicinity in which the property is located; that such
variance is necessary for the preservation and enjoyment of a sub-
stantial property right of the property owners involved possessed
by other properties in the same vicinity and zone. That the grant-
ing of such a variance will not adversely affect the comprehensive
general plan.

SECTION 6. That for the foregoing reasons, a variance
from the provisions of the Zoning Ordinance is hereby granted so
as to permit structural alterations and additions to the properties
abutting the north side of Huntington Drive between Santa Anita
Avenue and First Avenue in the City of Arcadia and more particu:;' . ..
larly described in Section 3 hereof, upon the following terms and
conditions:
a. No new buildings shall be constructed and no exist-
ing building shall be extended to a line nearer than
25 feet south of the south line of the alley in
Block 74 of said Santa Anita Tract.
b. Buildings now existing and encroaching into such
25-foot area shall not be further extended or en-
larged into or in that area.
c.
When buildings are constructed, extended or altered
upon any of'subject properties, an 8-foot wide con-
crete sidewalk shall be constructed the full width
of the lot at the southerly line of said 25-foot area.
d.
Concurrent with any bUilding construction, a marquee
8 feet wide will be required over the sidewalk re-
quired by the preceding subsection.
e.
The 17-foot strip of land,between said sidewalk and
aforesaid alley shall be used as a loading zone only.
f.
Buildings may be constructed, enlarged or altered
as specified above without any further contribution
for parking, so long as the total floor area within
such building does not exceed the area of that por-
tion of the lot upon which a building may be con-
structed when complying with all applicable regula-
tions.
g.
Any construction or enlargement of a building to

provide more floor area than the area of the portion
of the lot upon which a building may be constructed
when complying with all applicable regulations shall
require compliance with the provisions of Division
4 of Part 8 of Chapter 2 of Article IX of the Arcadia
Municipal Code or a contribution to the Off-Street
Parking Fund as provided in Section 9284.2 thereof,
for all the floor area in excess of the area of that
portion of the lot upon which a building may be con-
s truc ted when. complying with all applicable regula':':.
tions.
h.
Additions and alterations allowed by this variance
are for the sole purpose of providing additional
entrance and display area for customers entering
from the p~blic parking lot. Such entrances shall
provide continuous access for customers through the

building to Huntington Drive. No such additions or
alterations shall be permitted solely by reason of
this variance, whether such additions or alterations
provide for one or more occupants additional cus-
tomer entryways or display areas, unless continuous
customer access to the front portion of the building
and to Huntington Drive is provided.
i. Any addition or extension of the main building on
Lot 8 shall require the removal of the existing
independent building now located within the rear
25 feet of the lot.
J. The City Planning Commission reserves the right,
without necessity of further notice or public hear-
ings, to make minor modifications of any of the
foregoing conditions so long as such modifications
do not materially affect or prevent the accomplish-
ment of the overall purpose and intent of the vari-
ance hereby recommended.
k. Plans for all such additions and alterations shall
be subject to approval by the Planning Commission.
1. That a variance from the provisions of Section
9291.2.11 of the Arcadia Municipal Code is hereby
also granted so as to permit structural alterations
and additions as hereinabove provided to be made
upon any of the above-described properties at any
time within years from and after the date
of adoption hereof.
SECTION 7. The City Clerk shall certify to the adoption
of this reSolution.
I HEREBY CERTIFY that the foregoing Resolution was adopted
at a regular meeting of the City Council of the City of Arcadia,
on the 6th
day of December ,1960, by the affirmative vote
of at least three Councilmen, to wit:
