HomeMy WebLinkAbout3325 - RESOLUTION NO. 3325 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ARCADIA, CALIFORNIA, GRANTING A SPECIAL USE PERMIT FOR A RIDING ACADEMY ON CERTAIN REAL PROPERTY WITHIN ANNEXATION NO. 20, SOUTHEAST ARCADIA (UNINHABITED). THE CITY COUNCIL OF THE CITY OF ARCADIA, CALIFORNIA, DOES DETERMINE AND RESOLVE AS FOLLOWS: SECTION 1. That proceedings were duly instituted and public hearings duly held by and before the City PlannIng Commis- sion and the City Council of the City of Arcadia for the granting of a special use permit for a riding academy on certain real prop- erty hereinafter described, concurrent with the proceedings for the annexation to the City of Arcadia of that territory designated as Annexation No. 20, Southeast Arcadia (Uninhabited). SECTION 2. That there are exceptional circumstances applicable to the intended use of the property hereinafter described that do not apply generally to the class of use in the same zone and vicinity; that this exceptional circumstance has been recognized under the provisions of the Zoning Ordinance and particularly Sec- tion 9275.1.24 of the Arcadia Municipal Code wherein the use of property for a riding academy is declared to be a use possessing characteristics of such unique and special form as to make imprac- tical its being automatically included in any class of use as set forth in the various zones. That the granting of such special use permit will not be materially detrimental to the public health or welfare or injurious to the property or improvements in such zone or vicinity in which the property is located. That in accordance with the foregoing. such a special use permit is necessary for the preservation and enjoyment of a substantial property right of the -1- 3325 applicant possessed by other property in the same zone and vicinity. That the granting of such special use permit will not adversely affect the comprehensive general plan; to the oontrary, the property hereinafter described is located in the immediate vicinity of area- wide county riding trails, and is in an area zoned for and developed and used for industrial purposes. SECTION 3. That for the foregoing reasons a special use permit for a riding academy is hereby granted, for a period not to exceed ten (10) years from and after the date of adoption hereof, on the following described property in the County of Los Angeles, State of California, to wit: All that property bounded on the north by Dearborn Street, on the east by Myrtle Avenue, on the south by Clark Street and on the west by Peck Road. SECTION 4. That the within special use permit is granted upon the condition that all health and sanitation regulations of the City of Arcadia and of the County of Los Angeles be at 'all times complied with, and the violation of any such regulations shall con- stitute grounds for the revocation or modification of the special use permit hereby granted; and upon the further condition that if for a period of six (6) months the use authorized by the special use per- mit hereby granted is, or has been, unused, abandoned or discontinued, or any of the conditions herein specified have not been complied with, such special use permit shall become null and void and of no e~fect. SECTION 5. The City Clerk shall certify to the adoption of this resolution.
