I...!~"- ~ GRANTING A SPECIAL USE PERMIT UPON ' SPECIFIED CONDITIONS FOR THE ~ DEVELOPMENT OF NATURAL RESROUCES !/<::/ f), ~ UPON AND FROM PROPERTY EAST OF PECK a ~ 7 . ~ ;:2.-&'-70 THE CITY COUNCIL OF THE CITY OF ARCADIA, CALIFORNIA, ROAD. DOES DETERMINE AND RESOLVE AS FOLLOWS: SECTION 1. That proceedings were duly instituted and pUblic hearings duly held by and before the City Planning Commis- sion and the City Council of the City of Arcadia, concurrent with the proceedings for the annexation to the City of Arcadia of the property hereinafter described, for the purpose of considering and making recommendat'ions concerning the granting of a special use permit for the development of natural resources. SECTION 2. That under the provision of the City Zoning Ordinance, the development of natural resources, together with the necessary buildings, apparatus or appurtenances incident thereto, is declared to be a use possessing characteristics of such unique and special form as to make impractical its being automatically included in any class of use as set forth in the various zones. That the use of property for the development of natural resources is permissible in any zone upon the granting of a special use permit therefor. SECTION 3. That this Council deems that the imposition of certain conditions is necessary in the granting of the special use permit to insu~e that the spirit and purpose of the City Zoning Ordinance will be observed, public safety and welfare secured . and substantial justiq done; that the granting of the special use -1- 3327 permit for the production of natural resources, to wit, rock, sand and gravel, upon the conditions hereinafter set forth will not be unreasonably or materially detrimental to the public health or welfare, nor injurious to the property or improvements in the vi- cinity in which the subject property is located. That the special use permit, under such specified conditions, is necessary for the preservation and enjoyment of a substantial property right of the applicant. possessed by other property in the same vicinity and in the same zone. That there are -exceptional conditions applicable to the property involved and particularly to the intended use of the property that do not apply to all property in the vicinity, namely, the fact that subject property, located near the Rio Hondo, , contains a deposit of prime material of high quality for rock, sand and gravel. That the City Zoning Ordinance recognized this excep- tional condition in permitting the production of natural resources in any zone upon the granting of a special use permit therefor. That by their very nature, natural resources must be produced in their natural location and cannot be produced elsewhere. That the granting of the special use permit as hereinafter recommended will not adversely affect the comprehensive general plan nor will it be adverse to the ,land use plan of the City of Arcadia. That the City Zoning Ordinance, as and when adopted, stated in part that "The City Planning Commission and the City Council recognize, and hereby de- clare, that the City of Arcadia is a component part of a large metropolitan area, within which larger areas are contained facili- ties which in amount, location, physical characteristics and available services are preeminently suited for use by industrial enterprises; . . . that should the City of Arcadia, by provisions of this ordinance or subsequent ordinances, make no actual provision for the location of heavy industries, such determination will not constitute prohibition, but rather would conform to comprehensive -2- 3327 regulation on the metropolitan area basis." That subject property was not a part of the City of Arcadia at the time of such decla- ration nor at'the time of the adoption of said Zoning Ordinance but constituted a part of the adjacent unincorporated metropolitan area contemplated thereby. SECTION 4. That for the foregoing reasons, a special use permit for the quarrying of rock, sand and gravel for a period of ten (10) years from and after the date of the adoption hereof, is hereby granted with respect to the following described property in the County of Los Angeles, Stat~ of Califurnia, to wit: Beginning at-the intersection of ~he northerly line of Dearborn.Street with the easterly line of Myrtle Avenue; thence southerly along said easterly line of Myrtle Avenue to the northerly line of Clark Street; thence easterly along the said northerly line of Clark Street to the present easterly Arcadia Coty boundary; thence northerly thereon to the northerly line of Dearborn street; thence westerly thereon to the point of beginning. That the within special use permit, is granted upon each of the fol- lowing conditions: a. That all operations conducted on the above-described property be conducted in compliance with all valid requirements of the Los Angeles County Air Pollution Control District. b. That if necessity requires the installation of rock and sand processing equipment, an additional special use permit with suitable regulations shall be required. c. That a chain link wire fence of a minimum height of six feet, topped with three strands of barbed wire, or a masonry type wall of a minimum height of six feet, be installed completely . around the property, except that along the northerly side of Clark Street from Cogswell Road to Durfee Road, said masonry type wall shall be installed; and provided further, that if any of the property on the south side of Clark Street east of Durfee Road -3- 3327 . . be improved with res:idential structures prior to the .commencement of quarrying operations on the above-described property, a masonry type wall shall be constructed along the north side of Clark Street east of ' DUrfee Road opposite the properties thus devel~ oped residentially. All fences and walls required hereby are to be installed prior to beginning any such quarrying operations. d. That all private roads connecting quarry, process- ing plant and stock pile shall be paved or be kept wetted down while being used, and shall be serviced and maintained so as to eliminate all dust so far as is practical. e. That all excavations from an open pit shall resu~t in a finished slope no steeper than one foot horizontal to one foot vertical. f. That all excavating operations shall be conducted only between the hours of 6:00 o'clock a.m. and 7:00 o'clock p.m., except in case of a public emergency or whenever reasonable . ' . J _ and necessary repairs of equipment are required. Any variation of the above-mentioned hours shan :t;1eq uire approval of the City of Arcadia. g. That there shall be a 25-foot buffer strip along the northerly side of Clark Street and that a row of trees be planted and maintained along this buffer strip. h. That at:least_onceeach calendar year during the effective period of the special use permit hereby granted the external boundaries of the above, des?ribed property shall be posted with signs stating in letters not less than four (4) inches in height, "Rock Quarry "Zone", and stating in letters not less than one (1) inch in height, ,"This property may be used at any time for the quarryJng.and stocJ.<:"pil:ing_of._rock,: sanct,;and, ~ve~ pursuant to and as specified in Resolution No. 3226 of, the City of Arcadia." That said signs shall be posted not less than -4- 3327 lIP- :s . . five hundred (500) ~eet apart and at each change of direction of said outer boundary line. i. That operations for any purpose authorized by the special use permit hereby granted may be commenced at any time during the effective period of the special use permit hereby granted; provided, however, that, after such operations have once commenced the special use permit hereby granted shall terminate if such operations be discontinued or abandoned-for a period of six months. SECTION 5. The City Clerk shall certify to the adoption of this resolution. I HEREBY CERTIFY that the foregoing resolution was ad?pted at a regular meeting of the City Council of the c~ty of Arcadia, held on the 6th day of December , 1960, by the affirmative vote of at least three Councilmen, to.wit: " AYES: Councilmen Butterworth, Phillips, Reibold and Camphouse NOES: None ABSENT: Councilman Balser r2h~j~ City Clerk of the City of Arcadia SIGNED AND APPROVED this 6th ~ da, of December , 1960.
