HomeMy WebLinkAbout3333 " , RESOLUTION NO. 3333 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ARCADIA, CALIFORNIA, DECLARING ITS INTENTION TQ FORM A LIGHTING MAINTENANCE DISTRICT, WHICH DISTRICT IS TO PAY THE COST AND EXPENSES FOR THE MAINTENANCE AND OPERATION OF A STREET LIGHTING SYSTEM ON PORTIONS OF BALDWIN AVENUE, ALLEY, EAST OF BALDWIN AVENUE, DUARTE ROAD, HUNTINGTON DRIVE, NAOMI AVENUE,MORLAN PLACE, SANTA ANITA AVENUE,AND SUNSET BOULEVARD IN SAID CITY, AND FIXING A TIME AND, PLACE FOR HEARING OBJECTIONS TO THE FORMATION OF SAID DISTRICT OR TO THE EXTENT THEREOF. THE CITY COUNTIL OF THE CITY OF ARCADIA, CALIFORNIA, DOES HEREBY RESOLVE AS FOLLOWS: SECTION 1. That the publiC interest and convenience re- quire and it is the intention of the City Council of the City of Arcadia to form a lighting maintenance district to be known as Lighting Maintenance Dis,trict No. 16, for the purpose cif assessing , said district to pay a portion of the cost and expenses of main- taining and operating a street lighting system consisting of seventy- seven (77) 20,000 lumen mercury vapor lamps in said district on por- tions of Baldwin Avenue, Alley east of Baldwin Avenue, Duarte Road, Huntingt~n Drive, Naomi Avenue, Morlan Place, Santa Anita Avenue and Sunset Boulevard. SECTION 2. The items of expense of maintenance and op- er~tion of the said lighting system to be furnished and to be as- sessed in part against the lands within the district (exclusive of improvements), are electric power, repairs, replacements, mainte- nance, labor, materials, engineering, printing and advertising. The estimated amount of electric power necessary for said system for each year is one hundred forty thousand, one hundred fifty-four (140,154) kilowatt hours and the estimated cost of said electric -1- 3333 power for the first year of maintenance and operation is the sum of eight thousand three hundred fifty-five and 38/100 dollars ($8,355.38). SECTION 3. That the said contemplated maintenance and operation of said lighting system in the opinion of the City Coun- cil of the City of Arcadia is of more than local or ordinary public benefit and said City Council hereby makes the expense of said maintenance and operation, exclusive of the amount to be paid by said City as stated in Section 5 hereof, chargeable upon a district, which district said City Council hereby declares to be ,the district benefited by said maintenance and operation ,and to be assessed to pay the cost and expense thereof; which said district shall, in general, include all of those lots fronting on said portions of said streeti. A plat or map of said district, indicating by a boundary line the extent of the lands included in the proposed district, and,indicating by symbol showing the type of lighting, was ap- proved and adopted by the City Council of said City of Arcadia, and is on file in the office of the City Clerk of the City of Ar- cadia. Reference is hereby made to said plat or map for further, full and complete descript~on of said Lighting Maintenance Dis- trict No. 16, and said map so on file shall govern for all details. as to the extent of such district. SECTION 4. That said maintenance and operation shall be furnished for said system for a period from the date of the forma- tion of said district to and including January 31, 1966. SECTION 5. The City Council of the City of Arcadia hereby orders that forty percent (40%) of the total maintenance and opera- tion cost and expenses of said system be paid out of the treasury of said City from the general fund of said City. -2- 3333 SECTION 6. Notice is hereby given that on Tuesday, the 17th day of January, 1961, at the hour of 8:00 o'clock p.m. of said day, in the Council Chamber of .said City Council of said City of Ar- cadia, in the City Hall of said City, 240 West Huntington Drive, any and all persons owning land 'or having any interest in lands within , the district liable to be assessed for the expenses of said mainte- nance and operation or any portion thereof, may be heard 'and any of said persons may present any objections that they may have by pro- test. SECTION 7. All the proceedings for the aforesaid mainte- nance and operation of said system shall be had and taken under and in accordance with the provisions of an act of the Legislature of the S~ate of California, known and designated as the Municipal Light- ing Maintenance District Act of 1927, being Division 14, Part 3 of the Streets and Highways Code of the State of California. SECTION 8. The Superintendent of Streets shall post or cause to be posted, copies of this resolution headed "Notice of formation of lighting maintenance district" along all open streets within said district liable to be assessed, in the manner and form required by law. SECTION 9. The City Clerk shall certify to the adoption of this resolution and shall cause the same to be published twice, to wit: on December 22, 1960 and on December 29, 1960, in the Arcadia Tribune and Arcadia News, a newspaper of general circulation published and circulated in the City of Arcadia and hereby desig- nated for that purpose.
