HomeMy WebLinkAbout3387 . - RESOLUTION NO. 3387 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF'ARCADIA, CALIFORNIA, GRANTING A ZONE VARIANCE TO PERMIT THE ERECTION OF FOUR ADDITIONAL APARTMENT UNITS AND TO USE THE EXISTING DRIVEWAY AND CARPORTS AT 918 WEST HUNTINGTON DRIVE UPON SPECIFIED CONDITIONS. THE CITY COUNCIL OF THE CITY OF ARCADIA, ,CALIFORNIA, DOES HEREBY DETERMINE AND RESOLVE AS FOLLOWS: SECTION 1. That there was filed with the City Planning Commission on March 27, 1961, the application of J. Ray Risser, as owner, for a zone variance to permit the erection of four additional apartment units at the rear of the property and to continue the use, without modification, of the existing driveway and covered carports on the property at 918 West Huntington Drive, in the City of Arcadia, County of Los Angeles, State of California, specifically described as follows: The east 78.75 feet of Lot 11, Tract No. 2731, as shown on map recorded in Book 33, page 29, of Maps, records of said county. That after notice as required by Ordinance No. 760 of said City, as amended, a public hearing was duly held on the matter by and before said City Planning Commission on April 11, 1961, which hear- ing was duly continued to April 25, 1961, at each of which times all interested persons were given a full opportunity to be heard and to present evidence. That on May 9, 1961, said City Planning Commission adopted its certain Resolution No. 408 wherein and whereby it recommended the granting of the requested variance upon specified conditions. SECTION 2. That there were no protests to the granting of the proposed variance and there were both written and oral com- -1- 3387 munications in favor of the variance. That although the driveways do not exactly conform to the present driveway requirements, a re- port from the Fire Chief reported that the existing driveways afford sufficient clearance for fire trucks. That the sixteen (16) existing apartments were lawfully constructed in 1954; that more parking spaces were provided at that time than was then required by the Zoning Ordinance. SECTION 3. That the original plans for the development of the property included the four units presently requested and space was left and utility connections installed for their con- struction at a later date. That said plans conformed with the Zoning Ordinance as the same was then in effect, and more than twenty (20) units could lawfully have been constructed on the property at that time. That this condition constitutes an excep- tional circumstance and the requested variance is necessary foX' the preservation and enjoyment of substantial property rights pos- sessed by other property in the same zone and vicinity. That the existing driveway is presently non-conforming only in the fact that at three isolated pOints it is less than the required width; that because of open areas on each side, the driveway for the most part has more useable width than many conforming driveways flanked by solid walls. That the granting of the variance under the condi- tions hereinafter recommended will not be detrimental to the public health or welfare, and will not be inconsistent with good planning practice or with the present or prospective development of the neighborhood in which the property is located, but rather will add to the appearance of the property as presently developed. SECTION 4. That for the foregoing reasons, a variance is hereby granted to allow the erection of four additional apart- ment units at the rear of the property at 918 West Huntington -2- 3387 Drive and to continue the use without modification of the existing driveway and covered carports, upon the following conditions: a. That the electric service wires be raised enough to allow access of fire equipment and other services; and, b. That the additional required parking spac~ be pro- vided at the front of the building back of the front setback line. SECTION 5. The City Clerk shall certify to the adoption of this resolution. I HEREBY CERTIFY that the foregoing resolution was adopted at a regular meeting of the City Council of the City of Arcadia, held on the 6th day of June ,1961, by the affirmative vote of at least three Councilmen, to wit: AYES: Councilmen Butterworth, Camphouse, Phillips, Reibold and Balser NOES: None ABSENT: None ~ VtMV City Clerk of the City of Arcadia SIGNED AND APPROVED this 6th day of June ,1961.
