RESOLUTION NO. 3398
A RESOLUTION OF THE CITY COUNCIL OF
THE CITY OF ARCADIA, CALIFORNIA,
GRANTING A ZONE VARIANCE TO PERMIT
THE CONSTRUCTION OF A NEW DWELLING
ON THE FRONT PORTION OF THE LOT AND
TO RETAIN THE EXISTING DWELLING ON
THE REAR PORTION OF THE LOT AT 535
EAST CAMINO REAL IN SAID CITY.
THE CITY COUNCIL OF THE CITY OF ARCADIA, CALIFORNIA, DOES
HEREBY DETERMINE AND RESOLVE AS FOLLOWS:
SECTION 1. That there was filed with the City Planning
Commission on April 25, 196~, the application of Ralph G. and Vir-
ginia S. Rose, as owners, for a zone variance to permit the con-
struction of a new dwelling on the front portion of the lot, and
to retain the existing dwelling on the rear portion of the lot at
535 East Camino Real in the City of Arcadia, County of Los Angeles,
State of California, described as follows:
The west 96.92 feet of the east 184.92 feet
of the south one-half of Lot 58, Tract No.
808, as shown on map recorded in Book 16,
pages 82 and 83, of Maps, records of said
County.
That after notice as required by the Zoning Ordinance of said City,
as amended, a public hearing was duly held on the matter by and
before said City Planning Commission on May 9, 1961, which hearing
was duly continued to May 23, 1961, at each of which times all in-
terested persons were given a full opportunity to be heard and to
present evidence. That on June 13, 1961, said City Planning Com-
mission adopted its certain Resolution No. 411, wherein and where-
by it recommended the granting of the requested variance upon speci-
fied conditions.
SECTION 2. That there were no protests to the granting
of the proposed variance, either oral or written, and while no one

other than applicants appeared to speak in favor of the variance,
owners of five surrounding properties to the east, north and west
signed consent to the granting of the variance. That although the
existing house and garage on the rear of the lot do not meet all
the requirements of the present Building Code, a report from the
Chief Building Inspector stated that minor wiring, roofing, paint-
ing and proper venting of the kitchen range would put the house
and garage in as good a condition as other small structures built
in Arcadia in 1939. That plans for the proposed new house indicate
it will have approximately 1800 square feet and that there is ample
room on the lot for it to meet all yard requirements.
SECTION 3. That although the property is located in an
R-1 Zone, the lot contains 20,959 square feet which is considerably
more area than the area required for two houses in such zone. That
of the four lots facing Camino Real in this block, two of the lots
now have two houses each. That the only Zone R-l requirement for
two houses which this lot does not meet is that no portion of it
has been resubdivided; that because of the size, shape and location
of the lot, resubdivision thereof is impracticable. That the fore-
gOing constitutes an exceptional circumstance applicable to subject
property which does not apply generally to other properties in the
same zone, and the requested variance is necessary for the preser-
vation and enjoyment of substantial property rights possessed by
other property in the same zone and vicinity. That the granting of
the variance under the conditions hereinafter recommended will not
be detrimental to the public health or welfare, and will not be
inconsistent with good planning practice or with the present or
prospective development of the neighborhood in which the property
is located, but rather will increase the value of the property and
upgrade the area.

SECTION 4. That for the foregoing reasons, a variance
is hereby granted to allow the construction of a new dwelling on
the front portion of the property at 535 East Camino Real and to
retain the existing dwelling on the rear portion of the lot upon
the following conditions:
a. That minor wiring repairs and proper venting of the
kitchen range be made to the satisfaction of the Building Inspector.
b. That the roof be recovered and the building be re-
painted.
SECTION 5. The City Clerk shall certify to the adoption
of this resolution.
I HEREBY CERTIFY that the foregoing resolution was
adopted at a regular meeting of the City Council of the City of
Arcadia held on the 5th day of July , 1961, by the affirmative
vote of at least three Councilmen, to wit:.
