HomeMy WebLinkAbout3204 ':'" '. . . . ~ ~ . . . .. e ~, ... .. ..' ~ RESOLUTION NO. 3204 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ARCADIA, CALIFORNIA, GRANTING A VARIANCE FOR PUBLIC PARKING AND DRIVEWAY ON PROPERTY LOCATED AT 639 NAOMI AVENUE IN SAID' CITY. THE CITY COUNCIL OF THE CITY OF ARCADIA, CALIFORNIA, DOES HEREBY DETERMINE AND RESOLVE AS FOLLOWS: SECTION 1. That there was filed with the City Planning Commission on December 22, 1958, the application of Professional Square, Inc., for a variance for public parking and driveway from Naomi Avenue upon Lot 11, Tract No. 461+, as per map recorded in Book 51 of Maps, page 82, in the office of the County Recorder of Los Angeles, which said property is located at 639 Naomi Avenue, Arcadia, California; pursuant to which application a public hearing was, after notice duly given, held by and before the City Planning Commission on January 13, 1959, at which time all interested per- sons were given full opportunity to be heard and to present evi- dence, That thereafter said Commission adopted it's certain reso- lution No. 323 wherein it recommended the denial of the requested variance for reasons therein specified. That within ten days of the adoption of said resolution, petitioners dUly appealed there- from to the City Council pursuant to which a public hearing was held by and before this Council on February 3, 1959. SECTION 2. That although there were numerous protests filed by the owners of property in the vicinity against the grant- ing of the requested variance, proceedings have been concluded to reclassify such protestants' property as well as subject property to Zone C-3 which would permit automobile parking among other com- mercial.uses, -1- 3204 (..~. ".. . ~ . ~ " ~ .. . - e ~ ~ - - SECTION 3. That in view of the impending reclassifica- tion of subject 'properties and other adjacent properties in the vi- cinity, the granting of the variance upon the terms hereinafter specified will not be materially detrimental to the public health or welfare or injurious to the property or improvements in such zone or vicinity in which the property is located. That the grant- ing of such variance will not adversely affect the comprehensive general plan. That the extensive commercial and parking areas north of, adjacent to and held under common ownership with subject property, without adequate ingress or egress thereto or therefrom except across subject property, constitute an exceptional circum- stance applicable to subject property or to the intended use thereof that does not apply generally to the property or class of use in the same zo~e or vicinity. That such variance is neces- sary for the preservation and enjoyment of a substantial property right of the applicant,possessed by other property in the same zone and vicinity. SECTION 4. That for the foregoing reasons a variance is hereby granted to permit the use of the above described property for public parking and for access from Naomi Avenue to and from the commercial properties north of subject property, upon condi- tion that applicant tender to the City of Arcadia a deed to the southerly 12 feet of subject property for the ultimate widening of Naomi Avenue, and that while subject property be used for a parking lot by virtue of the within variance, the existing parkway adjacent to subject property as well as the southerly 12 feet of subject property be landscaped and planted in accordance with the require- ments of the City Engineer.
