' A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ARCADIA, CALIFORNIA, DETERMINING AND ESTABLISHING ' REGULATIONS TO ,BE APPLICABLE TO CERTAIN REAL, PROPERTY BOUNDED BY DUARTE ROAD, LOVELL AVENUE, CAMINO REAL AND BALDWIN AVENUE UNDER ITS CLASSIFICATION IN ZONE D (ARCHITECTURAL OVERLAY) IN ADDITION TO THE BASIC C-3 ZONING APPLICABLE THERETO. THE CITY COUNCIL OF THE CITY OF ARCADIA, CALIFORNIA, DOES DETERMINE AND RESOLVE AS FOLLOWS: SECTION 1. That pursuant to Ordinance No. 760 of the City of Arcadia, as amended, proceedings were duly and regularly held by and before the City Planning Commission and the City Council of the City of Arcadia, as a result of which said City Council determined that the following described property in the County of Los Angeles, State of California, to wit: Lots 1 to 9, inclusive, Tract No. 8487, as shown on map recorded in Book 114, page 48, of Maps, records of said County, Lots 5 to 14, inclusive, and Lots 16 to 27, inclusive, Tract No. 4611, as Sh01VD on map recorded in Book 51, page 82, of Maps, re- cords of said County. The East 100 feet of Lots 1, 2 and 3, and all of Lots 4 to 9, inclusive, Tract No. 5907, as shown on map recorded in Book 63, page 67, of Maps, records of said County, should be reclassified and established in Zone C-3, and has further determined that the above described property be concurrently estab- lished in Zone D (ArChitectural Overlay) in addition to the afore- said basic zoning. SECTION 2. That the following restrictions should be and the same are hereby imposed upon and made applicable to the above described property, pursuant to Section 12.1 of Ordinance No. 760, -1- 3206 ,..., : ',. , ~ ! . ~ .' '! " ... . '! ~ .. ~ to wit: a. The westerly 10 feet of the easterly 34 feet of Lots 1, 5, 6, 7, 8 and 9 of said Tract No. 8487, and of Lots 16 and 17 of said Tract No. 4611, and of Lo~ 9 of ,said Tract No. 5907, shall be landscaped and suitably maintained at all times and an orna- mental masonry wall, ranging from 4~'to 5~ feet in height, shall be constructed and maintained along the westerly line of the plant- ing strip herein described. The first sixty (60) feet of the above described properties lying west of the wall herein described and required, including the easterly 20.44 feet of Lot 2 of said Tract No. 8487, shall be used solely for off-street parking and vehicular access, and no buildings shall be erected'or' maintained thereon. b. No building shall be erected or maintained on the southerly 27 feet of Lots 5 to 14, inclusive, and Lot 16, or on the northerly 27 feet of Lots 17 to 27, inclusive, of said Tract No. 4611. At least 9 feet of the northerly 15 feet of the south- erly 27 feet of Lots 5 to 14, inclusive, and Lot 16, and at least 9 feet of the southerly 15 feet of the northerly 27 feet of Lots 17 to 27, inclusive, of said Tract No. 4611, shall be suitably landscaped and maintained. c. The northerly 10 feet of the southerly 34 feet of the easterly 100 feet of Lot 3 and the northerly 10 feet of the southerly 34 feet of Lots 4 to 9, inclusive, of said Tract No. 5907, shall be suitably landscaped and maintained and no building shall be erected nor maintained thereon. An ornamental masonry wall ranging from 4~ to 5~ feet in height, shall be constructed and maintained along the northerly line of the planting strip herein described. The first 60 feet of the above described properties lying northerly of the wall herein described and required shall be used solely for off-street parking and vehicular access, and no buildings shall, be erected or maintained thereon. d. No vehicular access shall be provided or allowed to any of the above described properties from either Lovell Avenue -2- 3206 c", ',i ~ ! ! . ",' ~ '. . " '!' ... . - - or Camino Real except at and by means of the alleys hereinabove spec~ fied and required. e. The ,southwest corner of Duarte Road and Lovell Avenue shall have special spectacular landscape treatment. f. Signs shall be limited to one square foot of area for each foot of building frontage. All signs to be mounted flat against the building and no flashing or roof signs to be allowed. g. All lighting of the above described areas and the buildings thereon shall be directed away from 'adjoining residential property. h. All plans shall be submitted to the Planning Commission for approval as to plot plan, architectural treatment, walls, land- scaping and signs before issuance of a bUilding permit. i. The Planning Commission or City Council may modify any of the foregoing conditions if such modification will not ad- versely affect property or improvements in the vicinity and if such modification will equally accomplish substan~ially the same results as will the adherence to the foregoing conditions. SECTION 3.
