RESOLUTION NO. 3220 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ARCADIA FINDING AND DETERMINING THAT THE PUBLIC INTEREST, CONVENIENCE, AND NECESSITY REQUIRE THE ACQUISITION OF CERTAIN PROPERTY FOR STREET PUR- POSES . THE CITY COUNCIL OF THE CITY OF ARCADIA DOES RESOLVE AS FOLLOWS: SECTION 1. That the City Council hereby finds, determines, and declares that the public interest, convenience, and necessity require the acquisition of rights of way in, on, over, and under the hereinafter described real property for public street purposes and all uses appurtenant thereto. That the location of the land for said street has been planned and located in the manner which will be most compatible to the greatest public good and the least private injury. SECTION 2. That the City Council hereby finds, determines, and declares that in order to acquire said rights of way in, on, over, and under said land for said street purposes, and use the same for said purposes, the public interest, convenience, and neces- sity require the acquisition of said righmof way by the City of Arcadia in, on, over, and under that certain real property herein- after described, and the City Council hereby declares that it is the intention of the City of Arcadia to acquire in its name said rights of way in, on, over, and under said hereinafter described real property by condemnation in accordance with the provisions of the Code of Civil Procedure and the Constitution of the State of California authorizing the exercise of the right of eminent domain. SECTION 3. That said real property, the acquisition of which is required by the public interest, convenience, and neces- sity, for the purposes set forth in Sections 1 and 2 hereof is described as follows: Parcel 1 All that portion of Lot 122, Arcadia Acreage Tract, as recorded in Book 10, page 18, of Maps, records of Los Angeles County, California, described as follows: Beginning at a point on a line which is parallel with and distant northerly 106.25 feet (measured at right -l- 3220 angles) from the south line of the north one-half of said Lot 122 and distant on said parallel line 804.68 feet easterly from the center line of Sixth Avenue, 60 feet wide, as shown on map of Tract No. 14339, recorded in Book 306, pages 29 and 30, of Maps, records of Los Angeles County, California; thence continuing easterly along said parallel line to the beginning of a tangent curve concave to the southwest and having a radius of 15 feet, said curve being tangent to the above described parallel line and also tan- gent to a line which is parallel with and distant westerly 30 feet (measured at right angles) from the west line of Tract No. 22279, as shown on map recorded in Book 612, pages 31 and 32, of Maps, records of Los Angeles County, California; thence southeasterly along said curve to the point of tangency on said last described parallel line; thence northerly along said parallel line to the beginning of a curve concave to the northwest and having a radius of 15 feet, said curve being tangent to the last described parallel line and also being tangent to a line which is parallel with and distant northerly 166.25 feet (measured at right angles) from the south line of the north one-half of said Lot 122; thence southwesterly along said curve to its point of tangency on the last described parallel line; thence westerly along last said described parallel line to an intersection with a line which is parallel with the center line of Sixth Avenue~and which passes through the point of beginning; thence southerly along said parallel line to the point of beginning. Parcel 2 All that portion of Lot 122, Arcadia Acreage Tract, as recorded in Book 10, page 18, of Maps, records of Los Ange- les County, California, described as follows: Beginning at the northwest corner of Tract No. 22279, as shown on map recorded in Book 612, pages 31 and 32, of Maps, records of Los Angeles County, California, said point being on the south line of Camino Real, 60 feet wide, as shown on map of said Tract No. 22279; thence westerly along said south line to the beginning of a curve concave to the southwest and having a radius of 15 feet, said curve being tangent to the south line of Camino Real and also tangent to a line which is parallel with and 30 feet westerly (measured at right angles) from the west line of Lot 12 of said Tract No. 22279; thence southeasterly along said curve to a point of tangency on the last described parallel line; thence southerly along said parallel line to a point on the south line of the north one-half of said Lot 122; thence easterly along said south line of the north one-half of said Lot 122, 30 feet to the west line of said Lot 12; thence northerly along said west line of Lot 12, a distance of 447.52 feet, more or less, to the point of beginning. SECTION 4. That the City Attorney of the City of Arcadia and Burke, Williams & Sorensen hereby are authorized and empowered and directed to prepare, institute, and prosecute in the name of the City of Arcadia, such proceedings in the proper court having jurisdiction thereof as are necessary for the condemnation of said rights of way on said real property described in Section 3 of this -2- 3220 resolution. Said attorneys hereby are authorized and empowered to take such procedure as may be necessary to secure an order of im- mediate possession for the use and occupancy of said property. SECTION 5. The City Clerk shall certify to the adoption of this resolution. APPROVED AND ADOPTED this 16th day of February, 1960.
