RESOLUTION NO. 3230 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ARCADIA, CALIFORNIA, GRANTING A VARIANCE FOR THE CONSTRUCTION, MAINTENANCE AND OPERATION OF A CHURCH AND FOR CHURCH PARKING AT THE NORTHVlEST CORNER OF SANTA ANITA AVENUE AND FOOTHILL BOULEVARD. THE CITY COUNCIL OF THE CITY OF ARCADIA, CALIFORNIA, DOES HEREBY DETERMINE AND RESOLVE AS FOLLOWS: SECTION 1. That there was filed with the City Planning Commission on January 26, 1960, the application of the Shepherd of the Hills Evangelical Lutheran Church, as owners subject to escrow, signed by Herbert I. Chambers, Chairman, Site Committee, for a zone variance to permit the construction of a church and for church park- ing upon the following described property located at the northwest corner of Santa Anita Avenue and Foothill Boulevard in the City of Arcadia, County of Los Angeles, State of California, to wit: Lot 77, Tract No. 11074, as shown on map re- corded in Book 197, pages 28 and 29, of Maps, records of Los Angeles County; and, A portion of Lot 5, Tract No. 948, as shown on map recorded in Book 17, page 21, of Maps, records of Los Angeles County, described as follows: Beginning at the intersection of the west line of Santa Anita Avenue (100 feet wide) with the north line of Foothill Boulevard (80 feet wide); thence west along the north line of Foothill Boulevard 250 feet; thence north parallel with the west line of Santa Anita Avenue 250 feet; thence east parallel with the north line of Foothill Boulevard 250 feet to the west line of Santa Anita Avenue; thence south thereon 250 feet to the point of beginning. That after notice as required by Ordinance No. 760 of the City of Arcadia, as amended, a public hearing was duly held by and before said Commission on February 9, 1960, at which time all interested persons were given a full opportunity to be heard and to present -1- 3230 '- evidence. That upon the conclusion of said hearing, said Commis- sion adopted its certain Resolution No. 361, wherein and whereby it made certain findings and recommendations to this Council. SECTION 2. That numerous property owners signed the peti- tion as favoring the requested variance and a majority of the audi- ence indicated they also were in favor of it. Only one spoke against the granting of the requested variance. SECTION 3. That subject property has a frontage of 349.79 feet on Foothill Boulevard and 250 feet on Santa Anita Avenue. That a 250 foot square on the corner of Foothill Boulevard and Santa Anita Avenue is zoned C-2; that present plans are to remove the ser- vice station now located thereon at the expiration of the lease in approximately 13 years and to erect the main church building. That Lot 77 is zoned R-O and has a frontage of 99.79 feet on Foothill Boulevard. That the rear portion of Lot 77 and the north portion of the C-2 property will be used for church parking. That the ap- plicant is also acquiring Lot 78, which is zoned R-O, upon which they plan to build a residence dwelling for the minister and which will act as a buffer between the church. and the residential prop- erty to the west. SECTION 4. That the intended use of the property for a church and church parking constitute exceptional circumstances that do not apply generally to properties or classes of use in the same zone or vicinity. . That the public welfare and convenience reasona- bly require the granting of the variance, and upon the conditions hereinafter set forth said variance will not be inconsistent with good planning practice, nor with the present or prospective de- velopment of the neighborhood in which the property is located. SECTION 5. That for the foregoing reasons a variance is hereby granted to permit the use of the above described property -2- 3230 ,,' ,'" for the construction, maintenance and operation of a church and for church parking upon the following conditions: a. That the entire development shall conform substan- tially with the plot plan submitted. b. That the parking lot shall be paved and separated from adjacent residential property held under separate ownership by a 6-foot masonry wall, and there shall be not less than 5 feet of landscaping installed adjacent to such wall except along the north line of said Lot No. 77, where said landscaping shall be not less than 10 feet wide. c. That a variance from the provisions of Fire Zone No. 1 be granted so that the construction of the church building may correspond with other churches outside the No. 1 Fire Zone. d. That the final plot plan, landscaping plans and build- ing plans shall be submitted to and first be approved by the Plan- ning Commission before issuance of a building permit. SECTION 6. The City Clerk shall certify to the adoption of this resolution. I HEREBY CERTIFY that the foregoing resolution was adopted at a regular meeting of the City Council of the City of Arcadia held on the 15th day of March, 1960, by the affirmative vote of at least three Councilmen, to wit: AYES: Councilmen Balser, Camphouse, Jacobi, Phillips and Reibold NOES: None ABSENT: None ~~~ .
