HomeMy WebLinkAbout3241 -, RESOLUTION NO. 3241 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ARCADIA, CALIFORNIA, DENYING AN APPLICATION FOR A ZONE VARIANCE FOR THE CONSTRUCTION AND OPERATION OF A SERVICE STATION AT THE CORNER OF HUNTINGTON BOULEVARD AND SUNSET BOULEVARD IN SAID CITY. THE CITY COUNCIL OF THE CITY OF ARCADIA, CALIFORNIA, DOES FIND, DETERMINE AND RESOLVE AS FOLLOWS: SECTION 1. That there was filed with the City Planning Commission on February 1, 1960, the application of P. L. McNutt, John A. -Marshall and Prudence M. Marshall, as owners, for a zone variance to permit the construction and operation of an automobile service station on pr~perty ,located at the southwest corner of Hunt- ington and Sunset Boulevards in the City of Arcadia, County of Los Angeles, State of. Califqrnia, described as' follows: Part of Lot 4, 'Tract No.' 2731, as shown on map recorded in Book 33, page 29, of Maps, records of said County, beginning at the northeast corner of said lot; thence south along the east line 125 feet; thence west parallel with the north, line 112.88 feet; thence north 125 feet to the north line; thence east thereon ll2.88 ' feet to the point of beginning. That after notice as required by Ordinance No. 760 of said City, as amended, a public hearing was duly held by and before said Commis- sion on the 23rd day of February, 1960, at which time all interested persons were given a full opportunity to be heard and to present evidence; that on March 8, 1960, said Commission adopted its cer- tain Resolution No. 366 wherein and whereby certain findings, de- terminations and recommendations were made. SECTION 2. That there were many oral protests to the granting of the requested zone variance, and that only those di- rectly interested financially in the use of the property for a ser- vice station appeared to speak in favor of the variance. -1- 324l ! " ~. SECTION 3. That except for the business area on the north side'of Huntington Drive between Cortez Road and Michillinda Boule- vard, most of the property on Huntington Drive in that area is now devoted to R-3 uses and has been developed with exceptionally fine apartment buildings; that all of the recent development has been for R-3 uses and that subject property possesses no unusual character- istics of size or shape as to create exceptional or extraordinary circumstances to prevent the owners from developing it for a similar use. That subject property was zoned R-3 at the time it was pur- chased by applicants in September of 1959; that uses permissible in an R-3 zone have not changed since that time and the requested var~- ance is not necessary for the preservation of any property right of the applicants. SECTION 4. That applicants have not shown that the area is in any particular need of a servi~e station as there are many service stations within a mile radius; that the granting of a variance on this southwest corner would open the way for similar requests for the other three corners at this location, which would be detrimental to the property in the same neighborhood and zone. That the grant- ing of a variance for this particular lot would in effect constitute -' spot zoning which would adversely affect the comprehensive general plan. SECTION 5. That for the foregoing reasons, the appl~cation of P. L.' McNutt, John A. Marshall and PrudEmce M. Marshall for a zone variance to permit the construction and operation of a service station on the property hereinabove described is hereby denied. SECTION 6. The City Clerk shall certify to the adoption of this resolution. -2- ,324l .' ,. .... .'
